Abstract

Mahar atau maskawin dalam syari’at bukan merupakan harga beli dari seorang wanita. Sebutan ṣadāq, nihlah, farīḍah dan ajrdalam bahasa al-Qur’an memberikan isyarat bahwa mahar pada hakikatnya dimaksudkan untuk memuliakan perempuan bukan untuk ukuran kemuliaan perempuan seperti dalam tradisi jahiliah. Perbedaan interpretasi terhadap hadis uzawwijuka bi mā ma’aka min al-Qur’an berimplikasi terhadap perbedaan hukum tentang mahar hafalan al-Qur’an. Mayoritas ulama memahami bahwa pesan hukum dalam hadis tersebut adalah diperbolehkannya mejadikan pekerjaan mengajar al-Qur’an sebagai mahar, karena mengajar merupakan manfaat yang bisa diambil ujrahnya. Abstract

The dowry (mahr) is a consequence of the marriage contract, traditionally given in various forms, such as property, teaching Qur'an, or other valuable contributions. However, societal dynamics have introduced new forms, including shares as dowry. This study explores the legality and minimum value of shares as dowry according to Imam Shafi'i and Imam Quduri. The research employs a qualitative library study with primary sources including al-Umm by Imam Shafi'i and al-Quduri by Imam Quduri, and secondary sources such as Bidayatul Mujtahid and Roudhatut Thalibin. Data is collected through documentation and analyzed using content analysis. Imam Quduri considers shares valid as dowry, setting a minimum value of ten dirhams (approximately Rp. 42,494.29). If the shares are below this amount, the dowry is invalid and must be replaced with a mahr mithil (customary dowry). He emphasizes preserving the dignity of the bride. Imam Shafi'i, referencing Surah al-Baqarah (2:237) and relevant hadiths, adopts a more flexible stance, allowing shares as dowry without specifying a minimum value. Both scholars base their views on the Qur'an and Hadith but differ in interpretation, reflecting a textualist approach. This study highlights the evolving understanding of dowry in Islamic jurisprudence.

Abstract

This community service activity aims to develop the literary creativity of students at SPM Madrasah Ulya PP. Miftahul Mubtadiin Krempyang Nganjuk through the mentoring of anthology writing. The mentoring was conducted by a team of lecturers from various disciplines over six months, including writing training, workshops, and critique sessions. During the activity, students received materials on the basics of creative writing, narrative techniques, character creation, and story structure. The workshops featured professional writers and editors who shared their experiences and provided valuable additional materials. The critique sessions allowed students to present their work and receive constructive feedback from lecturers and peers. The results showed a significant improvement in students' writing skills, as evidenced by more structured writing, better language use, and deeper story development. Additionally, students' interest in writing and appreciation for literacy increased, as seen in more active class discussions, enthusiasm in participating in literacy activities, and improving the quality of their work. This program successfully sparked literacy and creativity among students.

Abstract

Every individual has the right to establish a family through the institution of marriage. Children who grow and develop within the family structure are expected to become a high-quality and competitive generation for the nation. To realize this expectation, the government has enacted legislation setting a minimum age requirement for marriage. However, this regulation has sparked debate due to its perceived negative impacts and overlooked positive aspects. Using a qualitative descriptive-analytical method, this article examines the age restriction for marriage as stipulated in Law No. 16 of 2019, which amends Law No. 1 of 1974 on Marriage, through the lens of muwāzanah principles formulated by Izzuddīn ibn Abdissalām. The muwāzanah framework is essential as an analytical tool, serving as a parameter to guide decisions when facing conflicting or equally weighted benefits (mashālih) and harms (mafāsid) -ijtima’ baina al-mashalih wa al-mafāsid al-muta’aridlatain maupun al-mutasawiyatain-. The age limitation policy, grounded in the protection of children's rights, the prevention of various risks, and the preparation of a competent and competitive future generation, does not deviate from the tenets of Islamic law. On the contrary, it reinforces the core principles of the Sharia (al-asās al-tasyrīʿ al-khams).
