Abstract

Abstract: This study analyzes the effectiveness of legal protections for Sharia sukuk investors in Indonesia, particularly in the Sukuk Tabungan ST012 instrument, based on the newly issued Financial Services Authority (OJK) Regulation No. 22 of 2023. The research is under a normative legal method combined with conceptual analysis using the Maqāṣid Ash-Sharīʿah framework developed by Auda. The findings indicate that the regulation introduces key elements such as strengthened literacy, transparency, and governance. However, the regulation’s effectiveness remains limited in safeguarding investor capital, ensuring rational decision-making, and providing psychological security. The Maqāṣid-based analysis reveals that the dimension of ḥifẓ al-māl (protection of wealth) is not yet fully integrated into policy design. A comparative analysis with Malaysia highlights Indonesia’s structural weaknesses, particularly the non-binding nature of fatwa authorities and the lack of legal certainty in Sharia supervision. This study recommends strengthening Sharia authority systems and integrating Maqāṣid values into the national regulatory framework. The study is limited by its non-empirical approach and narrow focus on a single instrument. Future research could consider quantitative methods and undertake broader cross-country regulatory comparisons. Abstrak: Studi ini menganalisis efektivitas perlindungan hukum bagi investor sukuk syariah di Indonesia, khususnya pada instrumen Sukuk Tabungan ST012, berdasarkan Peraturan Otoritas Jasa Keuangan (OJK) Nomor 22 Tahun 2023 yang baru diterbitkan. Penelitian ini menggunakan metode hukum normatif yang dikombinasikan dengan analisis konseptual menggunakan kerangka Maqāṣid Ash-Sharīʿah yang dikembangkan oleh Auda. Hasil penelitian menunjukkan bahwa peraturan tersebut memperkenalkan unsur-unsur kunci seperti peningkatan literasi, transparansi, dan tata kelola. Namun, efektivitas peraturan tersebut masih terbatas dalam melindungi modal investor, memastikan pengambilan keputusan yang rasional, dan memberikan keamanan psikologis. Analisis berbasis Maqāṣid mengungkapkan bahwa dimensi ḥifẓ al-māl (pelindungan harta) belum sepenuhnya terintegrasi dalam desain kebijakan. Analisis perbandingan dengan Malaysia menyoroti kelemahan struktural Indonesia, terutama sifat tidak mengikat dari otoritas fatwa dan ketidakpastian hukum dalam pengawasan syariah. Studi ini merekomendasikan penguatan sistem otoritas syariah dan integrasi nilai-nilai Maqāṣid ke dalam kerangka regulasi nasional. Studi ini dibatasi oleh pendekatan non-empiris dan fokus yang sempit pada instrumen tunggal. Penelitian masa depan dapat mempertimbangkan metode kuantitatif dan melakukan perbandingan regulasi lintas negara yang lebih luas.

Abstract

This research aims to investigate the impact of the hadith narrating the marriage between Prophet Muhammad and Aishah on early marriage laws in Indonesia. The hadith has been a subject of debate regarding its influence on the prevalence and acceptance of early marriage practices. Through a hermeneutics analysis within the Indonesian context, this study examines the interpretations and implications of the hadith, exploring how it has shaped societal attitudes and influenced the formulation of early marriage laws. The research argues that the marriage between the Prophet and Aishah was a “product of time”, rather than an inherent Islamic principle. It posits that Islamic principles can be contextualized across space and time, while product of time are influenced by specific values and circumstances. The study contends that the underlying Islamic principle behind marriage is to enhance the welfare and well-being of women in various aspects of life. The Prophet aimed to improve the status of women by emphasizing the institution of marriage as a means of protection. In contrast, early marriage undermines women’s opportunities for education and independent living. By comparing these perspectives, the study highlights that marriage practices are influenced by historical contexts, while the true Islamic principle seeks to elevate and empower women in social, economic, and educational spheres. The findings of this research contribute to a nuanced understanding of the relationship between religious teachings, cultural practices, and legal frameworks surrounding early marriage in Indonesia.

Abstract

Abstract: The resolution of Islamic economic disputes involving land collateral without mortgage titles reveals a persistent tension between procedural efficiency and the certainty of creditor protection. This study examines patterns in Indonesian Religious Court rulings through a case study of Sumenep No. 1/Pdt.G.S/2020/PA.Smp, combining a normative analysis of statutory and judicial regulations with an empirical reading of the court decision. The findings indicate a strong pro-efficiency orientation: simplified claims are accepted, contract validity is upheld based on Article 1320 of the Civil Code, and access to justice for small-value disputes is expanded. However, this also weakens the creditor’s legal position, as non-mortgage collateral does not provide executorial title or preferential rights. The mapping confirms a regulatory gap concerning non-mortgage collateral in Islamic economic transactions and inconsistent judicial reasoning across cases. The maṣlaḥah mursalah framework evaluates the benefits of procedural acceleration as legitimate only when it does not erode execution certainty, while saddu al-żarī‘ah emphasizes closing potential harm channels, such as opportunistic debtor behavior and increased financing costs. Policy recommendations include harmonizing the Mortgage Law, the Indonesian Religious Courts Law, and simplified claim procedures; drafting national technical guidelines for judges on verifying non-mortgage collateral and formulating enforceable judgments; and strengthening Sharia governance to ensure uniform standards of evidence, oversight, and transparency. This synergy aims to reconcile the principle of simple, fast, and low-cost justice with transaction certainty, thereby protecting both access to justice and creditor rights.   Abstrak: Penyelesaian sengketa ekonomi syariah yang melibatkan jaminan tanah tanpa Hak Tanggungan menampilkan ketegangan antara efisiensi prosedur dan kepastian perlindungan bagi kreditur. Kajian ini menelusuri pola putusan Pengadilan Agama melalui studi kasus Sumenep No. 1/Pdt.G.S/2020/PA.Smp, memadukan telaah normatif atas undang-undang dan regulasi peradilan dengan pembacaan empiris terhadap putusan. Temuan menunjukkan orientasi pro-efisiensi yakni gugatan sederhana diterima, keabsahan perjanjian ditegakkan berdasar Pasal 1320 KUH Perdata, dan akses keadilan bagi nilai sengketa kecil meningkat. Konsekuensinya, posisi kreditur melemah karena agunan non-Hak Tanggungan tidak menghadirkan titel eksekutorial maupun hak preferen. Pemetaan menegaskan kekosongan pengaturan teknis tentang agunan non-HT di ranah ekonomi syariah dan variasi pertimbangan yudisial antarperkara. Kerangka maṣlaḥah mursalah menilai kemanfaatan percepatan proses hanya sahih bila tidak menggerus kepastian eksekusi, sedangkan saddu az-żarī’ah menuntut penutupan celah yang membuka peluang mudarat seperti perilaku oportunistik debitur dan lonjakan biaya pembiayaan. Rekomendasi diarahkan pada harmonisasi UU Hak Tanggungan, UU Peradilan Agama, dan ketentuan gugatan sederhana, penyusunan pedoman teknis nasional bagi hakim terkait verifikasi jaminan non-HT serta amar eksekusi yang operasional, dan penguatan tata kelola syariah agar standar pembuktian, pengawasan, dan transparansi seragam. Sinergi ini diharapkan menyatukan asas sederhana-cepat-biaya ringan dengan kepastian transaksi jaminan, sehingga akses dan hak kreditur sama-sama terlindungi.

Abstract

The Routledge Handbook of Global Islam and Consumer Culture, edited by Birgit Krawietz and François Gauthier, offers a comprehensive examination of the intersection between Islam, market dynamics, and consumer practices in the contemporary global era. The book’s interdisciplinary contributions demonstrate how Islamic values, authority, and socio-economic realities shape consumer culture across diverse contexts. By bringing together perspectives from law, anthropology, sociology, and religious studies, the volume examines critical themes such as halal markets, financial ethics, identity politics, and digital consumption. This review highlights the book’s strength in offering a nuanced account of Islam’s global entanglement with consumerism, while also pointing to the challenges of addressing regional diversities and normative debates within Islamic law. It concludes that the volume serves as an essential reference for scholars of Islamic law, economics, and cultural studies, enabling them to understand how faith and the market intertwine in contemporary Muslim societies. Abstract

This article examines the harmonization of fiduciary enforcement in Indonesia following Constitutional Court Decision No. 18/2019 and DSN-MUI Fatwa No. 68/2008 on Rahn Tasjīlī. The Constitutional Court restricted unilateral repossession through fiduciary certificates, mandating either debtor consent or judicial oversight, while the fatwa embeds ethical safeguards of fairness (ʿadl) and harm prevention (ḍarar). Employing a normative-juridical approach, this study analyzes statutory law, jurisprudence, and fatwa-based norms to identify points of convergence. The findings reveal that both frameworks limit creditor dominance, strengthen debtor protection, and preserve creditor certainty through documentation and due process. Divergences remain in their normative origins, yet outcomes converge toward proportionality and justice. Keywords: fiduciary security; rahn tasjīlī; constitutional court decision; DSN-MUI fatwa; maqāṣid al-sharīʿah   Abstrak Artikel ini mengkaji harmonisasi pelaksanaan eksekusi jaminan fidusia di Indonesia pasca Putusan Mahkamah Konstitusi No. 18/2019 dan Fatwa DSN-MUI No. 68/2008 tentang Rahn Tasjīlī. Mahkamah Konstitusi membatasi penarikan sepihak objek fidusia melalui sertifikat fidusia dengan mensyaratkan adanya persetujuan debitur atau pengawasan yudisial, sementara fatwa tersebut menanamkan perlindungan etis berupa keadilan (ʿadl) dan pencegahan kemudaratan (ḍarar). Dengan menggunakan pendekatan normatif-yuridis, penelitian ini menganalisis peraturan perundang-undangan, yurisprudensi, dan norma berbasis fatwa untuk mengidentifikasi titik-titik konvergensi. Temuan penelitian menunjukkan bahwa kedua kerangka tersebut sama-sama membatasi dominasi kreditur, memperkuat perlindungan debitur, serta menjaga kepastian hukum bagi kreditur. Perbedaan tetap terdapat pada asal-usul normatifnya, namun hasil akhirnya bertemu pada prinsip proporsionalitas dan keadilan. Kata Kunci: jaminan fidusia; rahn tasjīlī; putusan mahkamah konstitusi; fatwa DSN-MUI; maqāṣid al-sharīʿah.
