Abstract

Artikel ini bertujuan untuk menganalisis dan mendeskripsikan implementasi fungsi Badan Permusyawaratan Desa dalam pembentukan produk hukum desa.. Mengingat, dalam realitas peraturan desa seringkali diabaikan dalam hal penyelenggaraan urusan pemerintahan di desa. sehingga dalam penyusunannya peraturan desa tersebut tidak berdasarkan pada prinsip peraturan perundang-undangan yang baik (good legislation), dan bahkan banyak desa yang belum memiliki peraturan desa. ketiadaan dari peraturan desa tersebut merupakan gambaran terhadap pelaksanaan fungsi badan permusyawaratan desa yang belum berjalan sebagaimana mestinya. Identifikasi masalah sebagai berikut: 1. Bagaimana fungsi Badan Permusyawaratan Desa berdasarkan Undang-Undang Nomor 6 Tahun 2014 Tentang Desa, 2. Bagaiamana implementasi badan permusyawaratan desa dalam pembentukan produk hukum desa di desa singaraja kecamatan indramayu kabupaten indramayu. Metode penelitian yang digunakan ini adalah yuridis-normatif penelitian hukum mengkaji data dan bahan hukum primer dan skunder. Seluruh data dan bahan hukum kemudian dianalisa secara kualitatif dengan memberikan telaah terhadap hasil penelitian dengan memberikan telaah terhadap hasil penelitian dengan pikiran sendiri dan dibantu dengan norma-norma hukum, doktrin hukum, dan teori ilmu hukum yang dikuasai. Berdasarkan hasil temuan menjelaskan bahwa pelaksanaan fungsi legislasi BPD di Desa Singaraja Kecamatan Indramayu Kabupaten Indramayu masih belum optimal yang disebabkan oleh kurangnya koordinasi antara BPD Singaraja dengan Pemerintah Desa Singaraja. Dalam pengumpulan aspirasi masyarakat terkait gagasan Raperdes yang akan dibuat, perumusan Peraturan Desa, dan terhadap usulan Raperdes yang kemudian disahkan menjadi Peraturan Desa masih didominasi oleh Pemerintah Desa.

Abstract

Integrated coastal management (ICM) is a guideline and framework for peer assessment services for coastal area protection and management. The ratification of the international conference on the protection of seas and coastal areas underlies the exploitation of seas and coastal areas that exceed the carrying capacity and resilience of environmental management. The conception of ICM in its framework carries integration or integration between sectors such as central and local governments, the private sector, and entrepreneurs. The success of the conception of ICM can be seen in terms of the functions and rules of ICM that affect the development of sustainable coastal areas. However, with the success of ICM, of course, it saves the negative side of the limits and policy patterns based on local government authority, it will be possible to overlap the determination of the role and function of centralized ICM. The research method used is juridical-normative, namely research that prioritizes data analysis based on norms and rules that can then be analyzed through qualitative stages with description-analysis. Based on the results of the study that the limits of the function and role of ICM lie in matters of authority between the central and regional governments, these limits will arise on the content of the interests of managing arrangements, utilizing coastal areas.

Abstract

The legal philosophy and legal politics of a country in the perspective of academic studies are two (2) highly correlated and influential things. The law is basically not sterile from its social subsystem. Politics often intervenes on the actions and execution of the law so that the question arises about which subsystem between law and politics is more supremetive. This question arises because of the abundance of blunt laws in the interruption arbitrariness of authority, the law is incapable of upholding justice and cannot present itself as a matter that should be the legal task of solving it. The linkage between philosophy and law that only philosophical approach to law is an attempt to provide rational thought about time-bound law, or attempt to formulate a general theory of the legal order to meet some of the needs of legal development or state development. With the philosophy of law philosophers on the formation of a country's legal politics, it will manifest a paradigm of the welfare state. Keyword: Philosophy of law, status and legal policy

Abstract

Many people have not implemented health protocols in carrying out their daily activities is a special phenomenon that deserves serious attention from various parties, including elements of the Police in it. This is possible considering the implementation of the main functions and duties of the Police in the field of Kamtibmas which can reach up to the smallest units in society through the implementation of the Community Policing (Polmas) strategy. Polmas through adjustments to the implementation of the main functions and duties of Bhabinkamtibmas as Community Policing Bearers (Polmas) which are oriented towards achieving increased public awareness and compliance in implementing health protocols. In this concept, the researcher conducted research using normative juridical methods. This juridical approach is because this research analyzes existing legal aspects, and is normative because this research focuses more on the analysis of existing laws and regulations and other regulations, using secondary data, namely scientific references or other scientific writings as study material that can support the completeness of this scientific work Specifically regarding adjustments to the implementation of the main functions and duties of Bhabinkamtibmas as Community Policing Carriers (Polmas) which are oriented towards achieving increased public awareness and compliance in implementing health protocols, the implementation is carried out with the support and involvement of the Police and Community Partnership Forum (FKPM).

Abstract

Banks have a strategic function in the economy in every country. In this strategic function, banks are always faced with regulations in every step of their business. The regulation is not only on how to establish or permit to establish a bank, but each bank balance sheet is regulated in such a way that the bank is in a healthy level that is maintained in order to guide the principles or principles of banking. One of the banking principles that has become a serious concern for law enforcers is the principle of prudence. We can see the factual implementation of the precautionary principle in the application of in-depth credit analysis using the five c principle, which includes elements of character (character), capital (capital), capacity (customer's ability), condition of economy (economic condition), and colleteral (collateral). The principle of prudence is very necessary, especially in the case of banks wishing to channel funds to the public in the form of credit or financing. The precautionary principle is often interpreted as a principle that banks in carrying out their business must pay attention to various risks, both administrative risks and legal risks. The meaning of prudence is very broad to be interpreted, so that any violation of risk is categorized as a violation of the precautionary principle. Violation of the precautionary principle has become a law enforcement tool to ensnare banking managers, especially in providing credit as a crime. There needs to be a banking regulatory product that specifically regulates the limitations of any sanctions that are referred to as administrative violators or criminal acts of prudential principles. Because, if it is not regulated clearly and firmly, it will create legal uncertainty

Abstract

The stipulation of the Omnibus Law on the Job Creation Act as a regulation that regulates various sectors aims to improve the investment climate and willingness to establish a business in Indonesia in order to create wider job opportunities so that it can absorb more of the workforce. But in fact, the enactment of the Job Creation Law has actually caused a lot of turmoil and demonstrations in various regions in Indonesia because there are articles that are considered contradictory and can degrade rights and welfare, ignore environmental sustainability and the sustainability of living together. The purpose of this research is to look at the implementation of the Job Creation Act after it is legal as a law. This study uses a juridical-normative qualitative method with a statutory approach, a conceptual approach and a historical approach. The results of this study show that there are at least 7 sectors or clusters that get enough attention because the contents of the articles in them are said to be quite controversial. These clusters include the Investment and Business Activity Ecosystem Improvement cluster, the Employment Cluster Ease, Protection, and Empowerment of Cooperatives, Enterprises, Micro, Small and Medium Enterprises, the Ease of Doing Business cluster, the Research and Innovation Support cluster, the Land Acquisition cluster, and the Government Administration Implementation cluster.
