Abstract

Construction and improvement of basic land-side facilities at the Bolok Ferry Port can support the smooth flow of mobilization of goods and passengers to optimize port operations. The aim of this research is to determine the existing conditions and analyze the need for basic land side facilities at the Bolok Ferry Port and to find out the location of the planned placement of main land side facilities based on the provisions of the applicable regulations. This research is a quantitative descriptive research, namely to determine the need for several basic facilities on the land side based on KM Number 52 of 2004 concerning the Implementation of Ferry Ports. The research results obtained show that it is necessary to increase the area of ​​the passenger terminal by 396 m2, repair and re-placement of vehicle weighers, increase the length of the way for passengers entering/exiting the ship (gangway) which directly connects to the ship's deck, adding vehicle barriers in the passenger drop-off/pick-up parking area. based on type, and adding vehicle barriers in ready-to-load parking lots based on their class. Efforts that can be made by related parties are to build and increase the area of ​​basic land-side facilities needed at the Bolok Ferry Port.

Abstract

The Minimum Service Standards for Ferry Transport are the minimum requirements that must be met by ferry transport companies in providing services to service users. Minimum Service Standards (SPM) inspection process so that when the ship operates it does not cause problems. However, in its implementation the Minimum Service Standards have not been implemented at the Bolok Ferry Port, especially for the Minimum Service Standards for Loading on 4 ships, namely: (1) KMP. Lakaan; (2) KMP. Skipjack II; (3) KMP. Uma Kalada; and (4) KMP. Inerie II on the Bolok – Rote route. The aim of this research is to determine the level or percentage of compliance with the Minimum Service Standards for Loading vehicles on 4 ships on the Bolok – Rote Route. The method used is an observation method in the form of a survey of the distance between vehicles and the level of conformity to Minister of Transportation Regulation Number 62 of 2019 concerning Minimum Service Standards for Ferry Transport. Based on the results of the analysis, it can be seen that on 4 (four) ships in The Bolok – Rote route does not comply with Ministerial Regulation Number 62 of 2019 concerning Minimum Service Standards (SPM) for Ferry Transport, namely: (1) KMP. The conformity rate was 62%; (2) KMP. Cakalang II conformity level of 62%; (3) KMP. Uma Kalada's conformity rate was 65.5%; and (4) KMP. Inerie II conformity rate is 65.5%. Based on the analysis, ship operators can increase the Minimum Service Standards (SPM) for vehicle loading, especially in the following aspects: (1) Safety aspects require improvements to sprinklers and smoke detectors; (2) Security aspects that require providing CCTV on the card deck and regulating the distance between vehicles; and (3) Convenience/affordability aspects include changes to the cardeck height, improvements to lights and fastening to the vehicle when sailing.

Abstract

Dalam hal pelayanan jasa sebagai suatu proses kegiatan di area Pelabuhan, seksi Keselamatan Berlayar Penjagaan dan Patroli yang memiliki peranan yang cukup vital pada Pelabuhan. Salah satu pelayanan yang terdapat di seksi ini yaitu pelayanan dalam penerbitan Surat Persetujuan Olah Gerak Kapal. Pada saat ini diketahui bahwa masih terdapat kendala dalam hal penerbitan SPOG dengan sistem Inaportnet. Penelitian ini menggunakan metode observasi dan wawancara. Metode observasi adalah cara pengumpulan data dengan melakukan pengamatan langsung secara cermat dan sesuai dengan keadaan yang sedang terjadi. Metode observasi dengan cara mengamati dan melakukan pengambilan dokumen secara langsung mengenai kondisi di KSOP Kelas II Palembang. Berdasarkan dari analisis tersebut didapatkan kesimpulan bahwa penerapan penggunaan Inaportnet di KSOP Kelas II Palembang belum sepenuhnya optimal karena masih terdapat kendala dalam pelayanan yang dilakukan. Kendala tersebut berupa agen yang belum paham penggunaan Inaportnet, kendala internet kendala dalam penetapan pandu yang sering tidak muncul pada sistem Inaportnet tersebut. Terkait hal tersebut penyelenggara kantor melakukan upaya dengan menyediakan dan menambah akses internet, melakukan kegiatan sosialisasi, menyediakan layanan pengaduan dan melakukan koordinasi langsung dengan menciptakan forum diskusi berupa grup WhatsApp dengan instansi terkait permaslahan tersebut.

Abstract

Mintin Pier located in Pulang Pisau regency of Central Kalimantan province serves the route between Mintin - Anjir Sampit and has 3 ships operating namely the Palapa Agung Ship, Kf Perintis and Maju Bersama. In the operation of river and lake transportation, service standards have a very important value for service users. However, in field conditions there are still some service indicators that are not in accordance with certainty. Based on these conditions, the author conducted a survey of the services and facilities on the ship. The purpose of this study is to determine the conformity of the minimum service standards in the Regulation of the Minister of Transportation Number 61 of 2021 concerning the Implementation of River and Lake Transportation with existing conditions and what services / facilities need to be improved to comply with the established standards. Based on the results of analysts, it is obtained that the ships operating are not in accordance with the Minimum Service Standards in the Regulation of the Minister of Transportation Number 61 of 2021. The authorized ship manager must improve passenger services in accordance with the Regulation of the Minister of Transportation Number 61 of 2021 concerning the implementation of river and lake transportation. Suggestions for improvement for ship managers are as follows: There is a need for additional evacuation route guidance facilities. Adult and child life jackets, fire extinguishers, communication radios, first aid kits in accidents, garbage boxes, smoking prohibition stickers, Navigation lights, There is a need for additional light intensity on the ship. In the need for travel information and travel and security interference information, the Ship must provide a platform connection to the ship and priority access for people with disabilities or the elderly.

Abstract

Paciran Port serves three routes, one of which is from Paciran to Bawean Island with one KMP Gili Iyang. Shipping safety is the reason in this study because several cases of trucks overturning in the vehicle loading space. This study aims to determine the procedures for transporting vehicles on KMP. Gili Iyang. This study uses a qualitative research method with a data collection method using the observation method and then comparing the conditions in the field with existing regulations such as the distance between vehicles, weighbridges, vehicle positions, sterilization of the transportation space, and vehicle tying. This problem uses the legal basis of the Regulation of the Minister of Transportation Number 115 of 2016 concerning Procedures for Transporting Vehicles on Ships. The results of this study are: Paciran Port already has a weighbridge, The ticket after weighing the vehicle only contains the weight of the load, The vehicle loading space is not yet sterile from passengers, The vehicle loading space is sterile from oil spills, The distance between vehicles is still too close and not appropriate, The placement of the vehicle position is still transverse and not appropriate, The mandatory lashing section has not been fully tied. The conclusion of this study is that the procedures for transporting vehicles and placing vehicles on the KMP. Gili Iyang are still not in accordance with the rules stated in the Minister of Transportation No. 115 of 2016. The recommendations given include: the crew of the KMP. Gili Iyang must carry out vehicle transport procedures in accordance with the Minister of Transportation No. 115 of 2016. The need for stricter supervision from the transportation organizer.

Abstract

Bitung ferry port is a port that connects Lembeh Island, Talaud Island, Ternate Island and North Halmahera Island. The dock facilities at Bitung Ferry Port are in poor condition and have not met the standards in accordance with the Decree of the Minister of Transportation Number KM 52 of 2004. To realize the implementation and appropriate operations, an evaluation of the dock facilities at the ferry port is needed. This research uses descriptive quantitative research. The author analyzes fenders and fender spacing analyzes the number of bolder and bolder spacing and analyzes efforts to maintain fenders, bolder and trestle. The results of this study, the type of fender that is in accordance with the impact strength of the ship is type V 600H with the number of fenders 7 and each fender is given a distance of 10.65 meters. In the bolder, the number of bolder that is in accordance with the characteristics of the operating ship is 4 bolder with a distance between bolder is 23.67 meters. The condition of the existing trestle at the Bitung Ferry Port, it is known that the condition of the asphalt section has cracked. The conclusion of this research is that the condition of the fenders, bolder and trestle at the Bitung Ferry Port is not in accordance with the needs. PT ASDP Bitung Branch does not have a routine schedule and appropriate Standard Operating Procedure stages in carrying out regular maintenance. There needs to be a routine schedule for fender, bolder and trestle maintenance.

Abstract

Inkonsisten kebijakan mudik semakain memperdalam dan meruncing pad a tataran masyarakat, sehingga terjadinya polarisasi cara pandang masyarakat terhadap urgensi mudik yang sudah lama tertanam dalam sebagai realitas sosiokultural masyarakat Indonesia namun harus dilakukan meskipun bahaya pandemi Covid-19 mengancam. Penelitian ini bertujuan untuk mengkaji dan menganalisis bagaimana pandangan hukum progresif terhadap kebiajakan larangan mudik. Penelitian ini merupakan jenis penelitian yuridis empiris untuk mengetahui dan menentukan bagaimana hukum itu berlaku sebagai norma atau das sollen. Hasil penelitian dijelaskan bahwa dalam perspektif Hukum Progresif, pemberlakuan Peraturan Menteri Perhubungan Nomor PM 13 Tahun 2021 untuk menghentikan kontroversi larangan mudik lebaran sekaligus menghadirkan kepastian hukum dalam perspektif Hukum Progresif adalah menegaskan cara pandang Pemerintah yang masih mendasarkan diri kepada ajaran ilmu hukum positif (analytical jurisprudence). Permenhub telah dengan sengaja “melokalisir” kebenaran hanya yang nampak secara tekstual dalam pasal-pasal Peraturan Menteri Perhubungan Nomor PM 13 Tahun 2021, yang oleh Hukum Progresif justru hal itu dikritik karena sama sekali tidak bisa menjelaskan kebenaran yang kompleks (keadilan substantive). Dalam perspektif Hukum Proresif, maka hukum selalu dikaitkan pada tujuan-tujuan di luar narasi tekstual hukum itu sendiri. Sehingga hukum harus memihak kepada kepentingan masyarakat (publik) dan demi kepentingan keadilan itu sendiri.

Abstract

Persyaratan para founding fathers dalam konstitusi bahwa Negara Kesatuan Republik Indonesia (NKRI) adalah negara hukum dan bukan negara yang berdasarkan kekuasaan, tentunya menyiratkan bahwa baik lembaga maupun orangnya tidak kebal terhadap hukum. ketentuan peraturan perundang-undangan nasional dan internasional yang berlaku, dalam hal melakukan tindak pidana pada umumnya termasuk pelanggaran hak asasi manusia yang berat dalam kategori kejahatan terhadap kemanusiaan. Pelanggaran hak asasi manusia yang berat dalam kategori kejahatan terhadap kemanusiaan termasuk dalam jenis hak yang tidak dapat diganggu gugat, yaitu hak yang pelaksanaannya bersifat mutlak dan tidak dapat dikurangi walaupun dalam keadaan darurat. Negara-negara yang melanggar undang-undang yang tidak dapat diganggu gugat ini akan dikutuk sebagai negara yang telah melakukan pelanggaran HAM berat. Krisis kemanusiaan di abad 21 merupakan masalah yang menjadi tantangan besar di dunia global saat ini. Meluasnya kekerasan dan sikap apatis di suatu negara menjadi topik perbincangan terkini di era demokrasi yang membela nilai-nilai hak asasi manusia. Penelitian ini menggunakan metode penelitian kualitatif melalui sebuah kajian pustaka. Pada dasarnya metode penelitian merupakan cara ilmiah yang digunakan untuk mendapatkan data untuk tujuan dan kegunaan tertentu. Berdasarkan pengertiannya, penelitian kualitatif merupakan sebuah metode penelitian yang pada umumnya berupa informasi. Prinsip R to P dapat diterapkan dalam penyelesaian kasus genosida di Rwanda. Argumennya adalah bahwa pemerintah Rwanda yang berkuasa tidak dapat menjalankan fungsinya melindungi keselamatan dan kehidupan warganya serta memastikan kesejahteraan mereka. Oleh karena itu, adalah tepat bagi masyarakat internasional untuk campur tangan di Rwanda atas nama kemanusiaan dalam bentuk komitmen politik dan moral yang disepakati oleh Negara-negara di bawah naungan Perserikatan Bangsa-Bangsa.

Abstract

Perekonomian global sedang mengalami pelemahan akibat merebaknya wabah Covid-19 yang melanda sebagian besar populasi negara di dunia. Untuk mengekang penyebaran virus, negara-negara yang terkena dampak pandemi Covid-19 kini fokus untuk menahan penyebaran virus dan dampak sosial ekonominya. Penelitian ini bertujuan untuk mengetahui imunitas Pejabat dalam penanganan dampak ekonomi Pandemi Covid-19 berdasarkan Perppu Nomor 1 Tahun 2020 bersifat mutlak atau tidak. Berdasarkan fokus penelitian, maka metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini mengkaji berbagai data sekunder seperti peraturan perundang-undangan atau peraturan perundang-undangan, pendapat ahli, kajian hukum yang relevan, dan literatur lainnya. Pendekatan perundang-undangan menjadi dasar penulisan ini, dengan fokus mengkaji undang-undang dalam kaitannya dengan isu-isu utama yang diangkat (core issues). Kesimpulan dari artikel ini adalah Perppu 1/2020 tidak serta merta memberikan kekebalan mutlak kepada penyelenggara Perppu, namun bersifat terbatas (bersyarat) dan proses hukum tetap berjalan agar tidak melanggar aturan hukum. Pejabat, Perppu Pendahuluan Perekonomian global sedang mengalami pelemahan akibat merebaknya epidemi Covid-19 yang melanda populasi sebagian besar negara di dunia. Jika ingin mengekang penyebaran virus, negara-negara yang terkena dampak pandemi Covid-19 kini fokus untuk menahan penyebaran virus dan dampak sosial ekonominya berbagai upaya dilakukan.
