Abstract

Dalam UUD NRI 1945, Istilah "pemberhentian presiden” diartikan sebagai proses pemberhentian terhadap presiden karena melakukan pelanggaran hukum maupun karena tidak lagi memenuhi syarat sebagai presiden. Dalam pengalaman ketatanegaraan Indonesia diketahui bahwa proses dan mekanisme pemberhentian presiden yang terjadi menimbulkan banyak perdebatan konstitusi yang sangat serius. Hal itu dikarenakan mekanisme pemberhentian presiden yang dipakai di Indonesia masih mengandung banyak kelemahan. Kelemahan itu terutama bersumber dari konstitusi yang belum mengatur secara jelas mekanisme pemberhentian presiden.Berdasarkan analisa data yang dilakukan diperoleh kesimpulan yaitu, PertamaUndang-Undang Dasar 1945 sebelum perubahan tidak mengatur secara tegas mengenai pemberhentiann presiden dalam masa jabatannya baik mengenai alasan maupun mekanismenya, kemudian Dalam UUD 1945 setelah perubahan alasan dan tata cara pemberhentian presiden diatur dalam pasal 7 A dan 7B UUD NRI 1945. Kedua, Putusan Mahkamah Konstitusi tentang adanya pelanggaran yang dilakukan oleh Presiden dan/atau Wakil Presiden dapat dikatakan bersifat final sama dengan putusan Mahkamah Konstitusi untuk melaksanakan kewenangan lainnya.

Abstract

Tulisan ini membahas mengenai kebebasan pers di Indonesia khususnya pasca reformasi. Tujuannya adalah untuk menggambarkan konsep pers yang sesuai dengan nilai-nilai Pancasila yang tidak mudah dipengaruhi dan diintervensi. Teori Bekerjanya Hukum William Chambliss dan Roberts Seidman digunakan sebagai pisau analisis dalam menjelaskan gagasan implementasi nilai-nilai Pancasila di dalam kebebasan pers di Indonesia. Pada akhirnya, tulisan ini ingin menunjukkan bahwa untuk mewujudkan kebebasan pers yang bebas dan bertanggung jawab sesuai dengan nilai-nilai Pancasila, pers perlu kembali mendasarkan pemikirannya pada awal pembentukan undang-undang yang menjamin kebebasan pers di Indonesia. Hal ini sebagaimana dimuat dalam Tap MPRS XXXII/MPRS/1966 tentang Pembinaan Pers, yang memuat nilai-nilai Pancasila, yaitu prinsip-prinsip penegakan kebebasan pers yang bertanggung jawab, tidak hanya kepada sesama manusia tetapi juga kepada Tuhan Yang Maha Esa dan kepada negara.

Abstract

The protection and management of the environment as the primary life support system for humans in a harmonious, balanced manner through the preservation of biodiversity habitats within biodiversity conservation frameworks are manifestations of safeguarding the fundamental rights of every citizen, which must be continuously protected and ensured for its sustainability. This research aims to understand, analyze, and evaluate the implementation of biodiversity habitat preservation efforts through biodiversity conservation management areas through the enactment of regional legislation, including in the Province of Bangka Belitung Islands, Indonesia. This study utilizes a normative juridical legal research method with statute, case, conceptual, and analytical approaches. Data collection techniques involve literature review, observational methods, and in-depth interviews. This research findings indicate that the regulation regarding biodiversity conservation management has not yet been fully effective, as it primarily focuses on protection and lacks consideration for sustainable utilization. Challenges in biodiversity habitat preservation implementation include synchronization and harmonization issues in regulation, particularly regarding the division of authority between the central and regional governments in natural resource conservation and the limited involvement of communities, including local communities in conservation areas, to access and oversee the sustainable use of biodiversity resources based on local wisdom. Strengthening implementation measures, such as more robust and effective law enforcement, clear delineation of authority among institutional frameworks, and further development of substantive materials through scientific approaches in the field of biodiversity, is essential. Additionally, expanding the involvement of local communities in management and utilization activities in accordance with principles and procedures is necessary.

Abstract

Indonesia’s constitutional framework enshrines the separation of powers among the executive, legislative, and judicial branches, yet only the legislature lacks explicit term‐limit provisions for its members. This normative legal analysis examines the democratic and legal implications arising from this regulatory gap and proposes strategies to safeguard legislative renewal. Utilizing primarily on secondary sources—statutes, academic literature, and comparative analyses—the research employed both statutory and conceptual approaches to assess existing laws, notably Law No. 17 of 2014 on the People’s Consultative Assembly and House of Representatives and Law No. 7 of 2017 on General Elections. The analysis identifies three core deficiencies: first, the lack of term limits undermines legal certainty by leaving tenure duration indeterminate and susceptible to arbitrary interpretation; second, unlimited re‐election fosters power entrenchment, increasing risks of corruption, collusion, and nepotism, and weakening the legislature’s oversight and budgetary functions; third, perpetual incumbency impedes generational renewal, diminishing internal party democracy and restricting political recruitment. Drawing comparative insights from Australia’s staggered Senate terms illustrate how structured tenure can promote dynamism while retaining institutional memory. In response, the study advocates for a clear legislative amendment that caps legislators’ service to two consecutive terms, aligned with principles of accountability, rotation of power, and open political recruitment. Additionally, it recommends that political parties institutionalize transparent internal mechanisms and enforce term‐limit rules to ensure cadre development and democratic governance. By codifying legislative term limits and fostering proactive party roles, Indonesia can strengthen constitutional checks and balances, enhance the legislative quality, and secure sustainable democratic renewal.

Abstract

Studi ini mengkaji masalah terkait penyediaan rumah ibadah perumahan di Indonesia. Urgensi penelitian ini lahir dari adanya jurang hukum (legal gaps) antara adanya keharusan rumah ibadah direncanakan dan dibangun di perumahan dengan kenyataan hukum bahwa banyak perumahan yang tidak menyediakan rumah ibadah tersebut. Metode yang digunakan dalam penulisan ini adalah yuridis normatif dengan data sekunder. Hasil penelitian menunjukkan bahwa hukum positif yang berkenaan dengan tulisan ini utamanya yakni UU No. 1 Tahun 2011 yang telah diubah beberapa ketentuannya dalam Pasal 50 UU No. 6 Tahun 2023. Analisis yuridis terhadap hukum positif tersebut pada intinya menegaskan rumah ibadah di perumahan merupakan bagian dari prasarana, sarana, dan utilitias umum perumahan, khususnya sarana. Penyediaan rumah ibadah perumahan di Indonesia idealnya tersedia sebagai salah satu sarana yang harus dilengkapi di perumahan. Dilengkapinya prasarana, sarana, dan utilitias umum perumahan pada dasarnya dapat dikatakan sebagai upaya pemenuhan rumah yang layak huni. Kemudian, sanksi yang dimuat dalam regulasi dapat berupa sanksi administratif maupun sanksi pidana. Namun, dikarenakan hukum pidana pada asasnya adalah ultimum remedium, maka harus dijadikan obat terakhir. Selaras dengan regulasi yang mengatur bahwa penyelesaian sengketa di bidang perumahan terlebih dahulu diupayakan berdasarkan musyawarah untuk mufakat. Kata Kunci :     Analisis Yuridis, Sanksi, Penyediaan Rumah Ibadah, PSU, Perumahan. This study examines issues related to the provision of houses of worship in housing in Indonesia. The urgency of this study is born from the legal gaps between the necessity of houses of worship planned and built in housing with the legal reality that many housing does not provide houses of worship. The method used in this writing is normative juridical with secondary data. The results show that the positive law relating to this paper is mainly Law No. 1 Year 2011 which has been amended in several provisions in Article 50 of Law No. 6 Year 2023. The juridical analysis of the positive law essentially emphasizes that houses of worship in housing are part of the infrastructure, facilities, and public utilities (PSU) of housing, especially facilities. The provision of houses of worship in housing in Indonesia is ideally available as one of the facilities that must be equipped in housing. The completion of housing PSUs can basically be said to be an effort to fulfill livable homes. Then, the sanctions contained in the regulations can be in the form of administrative sanctions or criminal sanctions. However, because criminal law is basically an ultimum remedium, it must be used as a last resort. In line with regulations that stipulate that dispute resolution in the housing sector must first be attempted based on deliberation to reach consensus.
