Abstract

Until now there are no regulations governing the maximum limit of land ownership, especially non-agricultural, so that there is increasing inequality in land ownership. This research aims to determine and analyze the causes of inequality in land ownership and the policies implemented in setting maximum limits on non-agricultural land ownership for individuals. The method used is socio-legal research, namely a legal research method that attempts to see the law in a real sense or examine how the law works in society. Research data was taken from field research with official sources within the Central Java BPN Regional Office, Semarang City and Semarang Regency Land Offices as well as literature study research using legal materials, which were then analyzed qualitatively using inductive methods. The results show that inequality in land ownership will continue to occur as long as there is no legal certainty governing non-agricultural land ownership limits, so far it has only been in the form of internal administrative regulations. In order to realize a land policy for social welfare and justice, it is necessary to immediately issue regulations regarding restrictions on non-agricultural land ownership in the form of a law.

Abstract

Indonesia, as a legal state under Article 1(3) of the 1945 Constitution, aspires to achieve sovereignty, justice, and prosperity. Food sovereignty is essential to realizing these constitutional ideals. Law Number 41 of 2009 on the Protection of Sustainable Food Agricultural Land (PLP2B) serves as a key legislative framework to safeguard agricultural land. However, its implementation faces significant challenges, including weak enforcement mechanisms, limited coordination among stakeholders, and insufficient public awareness. These obstacles hinder efforts to prevent land conversion and ensure sustainable food security. This research addresses the urgency of fulfilling the constitutional mandate outlined in the second and fourth paragraphs of the Constitution’s Preamble, emphasizing sustainable development and societal welfare. Through a normative juridical approach, this study analyzes the legal policy for protecting agricultural land from constitutional and criminal law perspectives, offering a novel critique of the existing framework. Findings indicate gaps in regulatory synchronization, the absence of effective criminal sanctions to deter violations, and weak institutional coordination. To address these issues, the study recommends strengthening legal provisions, imposing stricter sanctions for land conversion, and improving inter-agency collaboration to ensure effective land protection. This research contributes to the development of legal science by offering practical recommendations for enhancing sustainable land protection policies. It provides valuable insights for policymakers, legal practitioners, and law enforcement agencies, supporting efforts to achieve food sovereignty and improve community welfare in Indonesia.

Abstract

Pemilihan umum (pemilu) merupakan pilar utama demokrasi yang menjamin kedaulatan rakyat serta menjadi sarana partisipasi publik dalam menentukan arah kepemimpinan dan kebijakan negara. Namun, dalam praktiknya, pemilu kerap menimbulkan sengketa pada berbagai tahapan, mulai dari proses administrasi hingga penetapan hasil akhir. Penelitian ini bertujuan untuk mengkaji sistem penyelesaian sengketa pemilu di Indonesia serta membandingkannya dengan sistem yang diterapkan di Austria, guna menemukan kelemahan, kelebihan, serta potensi reformasi sistemik yang relevan. Melalui pendekatan yuridis normatif dan perbandingan hukum (comparative legal study), penelitian ini menganalisis yurisdiksi kelembagaan seperti Mahkamah Konstitusi (MK), Bawaslu, dan DKPP di Indonesia, serta Verfassungsgerichtshof di Austria sebagai model tunggal penyelesaian sengketa pemilu. Hasil penelitian menunjukkan bahwa sistem multi-pintu di Indonesia menyebabkan kompleksitas, tumpang tindih kewenangan, dan ketidakpastian hukum, sementara Austria menawarkan model penyelesaian yang terpusat, final, dan lebih efisien. Temuan ini menggarisbawahi pentingnya reformasi kelembagaan dan prosedural dalam sistem penyelesaian sengketa pemilu Indonesia untuk memperkuat integritas, legitimasi hasil pemilu, dan stabilitas demokrasi. Penelitian ini diharapkan dapat memberikan kontribusi konseptual dan kebijakan dalam pengembangan tata kelola pemilu yang lebih baik di masa depan.

Abstract

Studi ini mengkaji masalah terkait penyediaan rumah ibadah perumahan di Indonesia. Urgensi penelitian ini lahir dari adanya jurang hukum (legal gaps) antara adanya keharusan rumah ibadah direncanakan dan dibangun di perumahan dengan kenyataan hukum bahwa banyak perumahan yang tidak menyediakan rumah ibadah tersebut. Metode yang digunakan dalam penulisan ini adalah yuridis normatif dengan data sekunder. Hasil penelitian menunjukkan bahwa hukum positif yang berkenaan dengan tulisan ini utamanya yakni UU No. 1 Tahun 2011 yang telah diubah beberapa ketentuannya dalam Pasal 50 UU No. 6 Tahun 2023. Analisis yuridis terhadap hukum positif tersebut pada intinya menegaskan rumah ibadah di perumahan merupakan bagian dari prasarana, sarana, dan utilitias umum perumahan, khususnya sarana. Penyediaan rumah ibadah perumahan di Indonesia idealnya tersedia sebagai salah satu sarana yang harus dilengkapi di perumahan. Dilengkapinya prasarana, sarana, dan utilitias umum perumahan pada dasarnya dapat dikatakan sebagai upaya pemenuhan rumah yang layak huni. Kemudian, sanksi yang dimuat dalam regulasi dapat berupa sanksi administratif maupun sanksi pidana. Namun, dikarenakan hukum pidana pada asasnya adalah ultimum remedium, maka harus dijadikan obat terakhir. Selaras dengan regulasi yang mengatur bahwa penyelesaian sengketa di bidang perumahan terlebih dahulu diupayakan berdasarkan musyawarah untuk mufakat. Kata Kunci :     Analisis Yuridis, Sanksi, Penyediaan Rumah Ibadah, PSU, Perumahan. This study examines issues related to the provision of houses of worship in housing in Indonesia. The urgency of this study is born from the legal gaps between the necessity of houses of worship planned and built in housing with the legal reality that many housing does not provide houses of worship. The method used in this writing is normative juridical with secondary data. The results show that the positive law relating to this paper is mainly Law No. 1 Year 2011 which has been amended in several provisions in Article 50 of Law No. 6 Year 2023. The juridical analysis of the positive law essentially emphasizes that houses of worship in housing are part of the infrastructure, facilities, and public utilities (PSU) of housing, especially facilities. The provision of houses of worship in housing in Indonesia is ideally available as one of the facilities that must be equipped in housing. The completion of housing PSUs can basically be said to be an effort to fulfill livable homes. Then, the sanctions contained in the regulations can be in the form of administrative sanctions or criminal sanctions. However, because criminal law is basically an ultimum remedium, it must be used as a last resort. In line with regulations that stipulate that dispute resolution in the housing sector must first be attempted based on deliberation to reach consensus. Abstract

Public legal awareness is an important foundation in creating a fair and effective legal system. The low level of legal understanding is the main trigger for public non-compliance with the law. Therefore, legal literacy is a strategic key in shaping legal awareness. The novelty of this article discusses the urgency of legal literacy and compliance in realizing a law-aware society and highlights the role of JDIH UNNES as an important tool in disseminating legal information. The method used in this study is normative juridical. The results of this study show that legal literacy not only includes the ability to understand the content of the law, but also encourages proactive legal attitudes and behavior. JDIH UNNES has proven to play a strategic role in providing legal information that is easily accessible, accurate, and relevant so as to support information disclosure and public participation in law enforcement and encourage the development of a legal culture in Indonesia. Thus, strengthening legal literacy through means such as JDIH has practical implications in shaping a society that understands, obeys, and is aware of the law in a sustainable manner.

Abstract

The role of state attorneys in administrative justice has long been a topic of debate, particularly in the context of Indonesia’s State Administrative Court (PTUN). Currently, state attorneys serve as both legal representatives for the government and as the public prosecutor in administrative disputes. This dual function has raised concerns about potential conflicts of interest and inefficiencies in the judicial process. This research explores the concept of separating the roles of state attorneys in the PTUN as a potential bridge for legal reform, with the aim of improving impartiality, transparency, and efficiency in state administrative disputes. Using a normative juridical approach, the study examines the advantages and challenges of creating a clear distinction between the roles of government legal counsel and public prosecutors in administrative cases. The findings suggest that such a separation could reduce conflicts of interest, enhance fairness in the adjudication process, and promote a more balanced approach to administrative justice. However, the implementation of this reform faces practical challenges, such as institutional resistance and the need for legislative changes. The novelty of this research lies in its exploration of a structural reform within the Indonesian administrative justice system, offering a fresh perspective on improving the independence and credibility of state administrative courts. The urgency of this reform is emphasized by the growing need for a more transparent and efficient judicial system that can meet the demands of modern governance. This study contributes to the ongoing discourse on legal reform in Indonesia and provides recommendations for policymakers aiming to strengthen the administrative justice system.
