Abstract

Pengunduran diri mengacu pada langkah sukarela seseorang untuk melepaskan atau menarik diri dari posisi atau tanggung jawab, seperti pekerjaan, jabatan, atau organisasi. Alasan di balik pengunduran diri bisa bermacam-macam, dan keputusannya mungkin dipengaruhi oleh faktor pribadi atau profesional. Beberapa situasi dalam dunia bisnis menunjukkan adanya tekanan atau paksaan dalam proses pengunduran diri yang dilakukan demi kepentingan perusahaan. Perlu diketahui bahwa pada dasarnya keputusan mengundurkan diri merupakan keputusan pribadi, dan setiap orang mempunyai kondisi dan motivasi yang berbeda-beda, tanpa ada pengaruh atau tekanan dari pihak lain. Proses ini harus dilaksanakan dengan bijaksana, termasuk memberikan pemberitahuan yang memadai kepada atasan dan rekan kerja, dan melakukan transisi yang lancar untuk meminimalkan dampak terhadap pekerjaan dan lingkungan kerja. Penelitian ini menggunakan hukum normatif (normative law study) yang dapat disimpulkan sebagai tindakan mempelajari berbagai macam aturan hukum formal seperti undang-undang. Metode penelitian ini melibatkan dua pendekatan utama, yaitu pendekatan perundang-undangan dan pendekatan konseptual. Pendekatan pertama melibatkan analisis menyeluruh terhadap seluruh peraturan perundang-undangan yang berkaitan dengan permasalahan hukum yang diteliti. Hasil penelitian ini memberikan pemahaman mengenai perlindungan hukum dan langkah hukum yang dapat diambil oleh pekerja yang menghadapi tekanan dalam proses pengunduran diri di lingkungan kerjanya. Sehingga dengan adanya perlindungan dan penindakan hukum tersebut maka pekerja akan lebih mudah menerima dan mengambil hak-hak yang seharusnya mereka dapatkan dari perusahaan.

Abstract

This study examines the importance of trade secret protection in Indonesia. Trade secret protection is crucial for maintaining honesty and fairness in business competition. Without it, companies can face theft and espionage, which harm the owners of these valuable intangible assets. An NDA is legally binding, meaning that the parties signing the agreement are obligated to comply with all agreed terms. If one party violates the NDA, for example by leaking confidential information, the injured party has the right to seek compensation through legal channels. Law Number 30 of 2000 stipulates criminal sanctions for violations of Article 17 of Trade Secrets or actions that violate Articles 13 or 14, which can be punished with a maximum of two years' imprisonment or a fine of up to Rp 300 million, or through arbitration and alternative dispute resolution methods such as negotiation, mediation, or conciliation, in accordance with Law Number 30 of 1999.

Abstract

Construction work in its implementation is carried out based on a contract. If there are problems in carrying out construction work, a dispute between the parties, in this case the service user and the service provider, will occur. Indonesia Law No. 2/2017 about Construction Services (hereafter called UU 2/2017) provides a new dispute resolution model option if problems occur in the construction sector, namely through the Dispute Board. The Dispute Board was created by the International Federation of Consulting Engineers / Federation Internationale des Ingenieurs-Conseils or FIDIC which was adopted into UU 2/2017. However, the regulation regarding the Dispute Board in UU 2/2017 needs to be studied further, especially regarding the nature of the final binding decision, because it still raises problems in its implementation. The purpose of this study is to examine the development of dispute resolution in the field of construction and the implementation of the final and binding nature of dispute board decisions. This study employed legal research methods with a conceptual and statute approach. The results of this study found that construction disputes can be resolved through litigation or non-litigation. The presence of the Dispute Board still does not provide legal certainty for the parties because the nature of the decision is final and binding but is not supported by an implementation mechanism.
