Abstract

This study aims to explore the epistemological foundations underlying the fatwa (religious decree) formulation processed by the Indonesian Council of Ulama (MUI) and analyze the dynamics of Islamic legal epistemology in the Indonesian context. Using a qualitative method with a content analysis and hermeneutical approach, this study examines MUI's fatwas published in the last decade, with contemporary Islamic epistemology theory and the maqashid sharia approach as the analytical framework. The research findings show that MUI applies an eclectic epistemological approach, integrating the bayani, burhani, and irfani methods in the fatwa establishment process. There is a significant effort to contextualize Islamic law with the realities of Indonesian society, reflected in the use of the principles of maslahah (public interest) and 'urf (local customs). MUI's collective ijtihad (independent reasoning) practice enriches the epistemological basis of the fatwas, but also poses challenges in synchronizing various perspectives. The novelty of this research lies in the comprehensive analysis of the dynamics of Islamic legal epistemology in MUI's fatwas in the digital era, which has not been widely explored before. This study reveals the flexibility and adaptability of Islamic legal epistemology in addressing contemporary issues, while also identifying the methodological challenges faced. The research recommends the development of a more systematic and transparent epistemological framework in the fatwa formulation process. Further studies are suggested to explore the impact of MUI's fatwas on Indonesia's socio-political dynamics and analyze the role of digital technology in the transformation of religious authority. Abstract

This study explains the tradition of Uang Panai’ in the Bugis Tolitoli community, located in the Tolitoli Regency. It also explores how the people of Tolitoli perceive the significance of the Uang Panai’ cultural practice. This study aims to learn more about the practice and meaning of Uang Panai’ for the Bugis Tolitoli community. This research uses ethnographic research methods with a qualitative approach by describing the research objectives. Researchers found that Uang Panai’ for the Bugis Tolitoli community must be held as a tribute to the bride and ease the burden on the woman's family, as well as to provide prestige for the family holding the wedding, behind the obligation to fulfil the Uang Panai’ accompanied by the awareness of both parties of the prospective bride to determine the value of Uang Panai’ according to the ability of the male party.

Abstract

Purpose - This research examines the dynamics of Islamic legal thought in contemporary Indonesia concerning the cultural wisdom of the archipelago. This research aims to understand how sociopolitical changes, modernization of the Islamic education system, and awareness of local identity affect the acculturation process of Islamic law with local cultural values.Methods - This research uses historical-anthropological and socio-juridical approaches with qualitative methods. Data collection techniques included literature studies, historical document analysis, and in-depth interviews with 15 contemporary Islamic law thinkers in Indonesia.Findings - The results showed that Islamic fiqh in Indonesia underwent a process of adaptation through dialog with the local culture. Concrete examples of this acculturation include (1) inheritance division practices that accommodate customary law, such as the gono-gini system in Javanese society; (2) marriage rituals that combine elements of sharia with local traditions; and (3) the implementation of zakat, which is adjusted to the traditional economic system, including zakat on agricultural products that vary according to regional customs.Contribution/Limitations - Theoretically, this research enriches the study of Islamic law by highlighting the role of 'urf (custom) as a secondary source of law. This research provides input for formulating fatwas and Islamic law legislation responsive to the Indonesian sociocultural context. The limitation of this study lies in the scope of the area, which is still limited to specific case studies.Originality/Value - This research contributes to understanding how Islamic law can be contextualized in a multicultural society. It also opens up space for further exploration of the role of fatwa institutions and legal policies in responding to social dynamics in Indonesia.

Abstract

This research discusses the transformation of gender-based Islamic education in modern pesantren that integrate gender equality in the curriculum, teaching methods, and fiqh. As a result, pesantren produce outstanding graduates who are aware of gender equality, although they still face cultural and structural obstacles. Gender fiqh-based solutions are proposed to create inclusive education.

Abstract

This paper wants to explore the existence and role of the Indonesian Ulema Council (MUI) in religious discourse and practice in Indonesia. This research is library research using the theory of Critical Discourse Analysis by Norman Fairclough. The approach of this research is the political approach of Islamic law in Indonesia. Results This study found research findings related to the existence and role of MUI in the process of forming Islamic discourse in Indonesia. The MUI was designed by the government of the New Order Era as a medium of communication between the government and the ulama. The position of MUI in this era is more dominant in its role as "khodimul Hukumah" (government servant) and in the reform order its role has shifted to "khodimul ummah" (servant of the ummah). MUI as a big umbrella for Muslims has played a big role in shaping religious discourse in Indonesia through its products, namely fatwas and non-fatwas. Among the non-fatwa are in the form of tawsiyah, Tadzkiroh, amanah, attitude statements and appeals. Even though the fatwa and non-fatwa are morally binding, politically legal products of MUI products are often accommodated by the government into a legally binding public policy (law). Abstract

Abstrak: Paper ini mengkaji kekerasan terhadap komunitas Syiah di Sampang, Madura yang menjadi isu laten dan sangat mungkin akan terjadi di tempat dan waktu yang lain. Paper ini mengeksplorasi produksi media dalam masyarakat yang mengkonstruksi dan mendiskriminasi minoritas agama serta peran otoritas keagamaan di Sampang, Madura. Paper ini didasarkan pada penelitian kualitatif melalui studi kepustakaan dan empiris dengan memanfaatkan teori Johan Galtung dan memadukannya dengan analisis wacana kritis Norman Fairclough. Paper ini menemukan bahwa wacana terhadap Syi’ah sebagai sistem kepercayaan sesat di Sampang Madura diproduksi oleh media. Otoritas agama mengambil cukup peran untuk mendukung dan menyebarkan wacana ini ke berbagai kelompok sosial. Dari kajian yang telah dilakukan juga ditemukan bahwa terdapat kekerasan kultural dan struktural terhadap komunitas Syi’ah di Sampang Madura dalam wujud diskriminasi, intimidasi dan kekerasan.Abstract: The paper examines the violence against the Shi'a community in Sampang, Madura. It is a latent issue and is highly likely to occur in different contexts. The paper also explores media production in the society that constructs and discriminates against religious minorities and the role of religious authorities in Sampang, Madura. The paper is mainly based on qualitative research through literature and empirical studies, utilizing Johan Galtung's triangulation of violence theory and Norman Fairclough's critical discourse analysis. The results indicate that the discourse on Shi'a as a dissenting group in Sampang, Madura, is produced by the media. Religious authorities play an essential role in supporting and spreading the discourse to various social groups. The study also highlights cultural and structural acts of violence to the Shi'a community in Sampang through discrimination, intimidation, and violence.
