Abstract

This study examines intellectual property rights, human rights to Health, and health development in Indonesia after COVID-19. In this study, the type of research used is normative legal research using legal material collection techniques in document studies or literature studies. The approach used in this study is statutory, and the sources of legal materials used are primary, secondary, and tertiary. The results showed that Health is a fundamental need of every individual, family, and society, which the Constitution protects. The founders of the Unitary State of the Republic of Indonesia (NKRI) also understood the importance of Health for the life of the nation and state. Health efforts in Indonesia adopt a modern health and medical system whose user community background is Western socio-cultural. On that basis, there are many obstacles to developing health care and treating and healing diseases when served to the people of Indonesia. Health is a subsystem of National Resilience because it must involve other subsystems through interaction, interrelation, interdependence, and independence to achieve national Health.

Abstract

The study employs a qualitative approach using a literature review method to analyze relevant Qur'anic verses and hadiths concerning wealth distribution. Primary data were sourced from Qur'anic interpretations, Islamic economic literature, and other supporting references such as books and journal articles discussing distribution in Islam. The analysis was conducted descriptively to identify the principles of distribution outlined in Islam and their implications for social justice. Data validity was ensured through source triangulation from credible references to guarantee accuracy and depth of information.The analysis reveals that wealth distribution is a crucial element in Islamic economics to achieve social and economic balance. This research explores the concept of distribution from the perspective of the Qur'an, focusing on principles of social justice, distribution instruments such as zakat, infak, and sedekah, and the prohibition of wealth accumulation. The study highlights how Qur'anic verses direct the management of wealth to prevent its concentration among a select few and ensure equitable distribution across society. Through this study, it is found that economic distribution in Islam contributes to reducing economic disparities, enhancing social solidarity, and promoting overall societal stability.

Abstract

Penelitian ini ingin melihat konsumsi dalam pandangan Islam menurut Alquran Qs. Al Araf Ayat 31. Hasil kajian penelitian didapatkan bahwa menkonsumsi makan makanan yang baik dan minum minuman yang bermanfaat adalah dalam rangka mengatur dan memelihara kesehatan untuk dapat beribadah kepada Allah dengan baik. Karena kesehatan badan banyak hubungannya dengan makanan dan minuman. Makanan dan minuman yang berlebihan berakibat terganggunya kesehatan. Karena itu, Allah melarang berlebihan dalam makan dan minum. Didalam al Qur’an Terdapat empat prinsip utama dalam sistem ekonomi Islam yang diisyaratkan: Hidup hemat tidak berlebihan, Mengeluarkan Zakat, Tidak Riba, Mengkonsumsi yang halal dan bekerja yang halal. Serta terdapat etika konsumsi yaitu Larangan bersikap kikir/bakhil dan menumpuk harta, larangan Bersikap Israf (Royal), dan Tabzir (Sia-sia), Seimbang dalam konsumsi Islam mewajibkan kepada pemilik harta agar menafkahkan sebagian hartannya untuk kepentingan diri, keluarga, dan fi sabilillah, Membelanjakan harta pada bentuk yang dihalalkan dan dengan cara yang baik.

Abstract

This study addresses the challenges faced by customers in the debt transfer (take over) process in Islamic banking, particularly the need for a practical application of the concept of maslahah (welfare) in aligning financial transactions with Sharia principles. Islamic banking, as a trusted institution, provides ethical financing solutions based on justice and welfare, and the debt transfer product serves as a means for customers to move their debts from conventional banks to Islamic banks, ensuring adherence to Sharia values. The objective of this study is to identify the specific mechanisms of the debt transfer contract, evaluate its impact on customer welfare, and examine the practical implementation of the maslahah concept in this product. This research employs a qualitative approach, including interviews with bank representatives and analysis of relevant Sharia banking documents, to gain insights into the process and outcomes of debt transfer contracts. The study finds that the debt transfer contract not only serves as a financial tool but also reflects Islamic banks' commitment to customer welfare by providing an alternative free from interest-based practices. This research contributes to the literature by introducing innovative approaches in debt transfer contracts and reinforcing the role of maslahah in Islamic banking, offering practical solutions for promoting economic welfare and justice. The study also focuses on Bank Syariah Indonesia as a case study, contributing to the broader understanding of the development of Islamic banking in Indonesia. The findings highlight the importance of applying maslahah as a principle of economic welfare and justice within Islamic finance.

Abstract

Handling Alleged Human Rights Violations is the process of resolving alleged human rights violations that occur in the community, both complained (reported) and uncomplained (unreported), which is one of the duties and functions of the Ministry of Law and Human Rights as a form of the Government's seriousness in implementing the protection and fulfillment of human rights in Indonesia. The Regional Office of the Ministry of Law and Human Rights of Central Kalimantan as an extension of the Ministry of Law and Human Rights in the region is obliged to carry out activities to handle alleged human rights violations, especially in Central Kalimantan Province, and is expected to be a solution in resolving alleged human rights violations experienced by the people of Central Kalimantan. The purpose of this study is to understand and examine the role of the Regional Office of the Ministry of Law and Human Rights of Central Kalimantan in handling alleged human rights violations, analyzing obstacles to handling and resolving alleged human rights violations carried out by the Regional Office of the Ministry of Law and Human Rights of Central Kalimantan. The research method used in this study is empirical legal research, with a sociological approach, namely analyzing the effectiveness of the enforcement of a legal rule in society. Based on the results of the study, it can be taken that the role of the Regional Office of the Ministry of Law and Human Rights of Central Kalimantan in carrying out activities to handle alleged human rights violations, both those communicated directly and indirectly, especially in Central Kalimantan Province, has been carried out quite well in accordance with the main tasks and functions of the Regional Office of the Ministry of Law and Human Rights, although in its implementation there are still several obstacles or obstacles faced by the The team from the Human Rights Sector, both internal and external obstacles. The Regional Office of the Ministry of Law and Human Rights of Central Kalimantan has made efforts to overcome these obstacles by increasing the capacity of officials and employees in the field of human rights, maximizing the existing budget and further improving coordination with the Echelon I Unit of the Ministry of Law and Human Rights and related agencies.

Abstract

This study aims to analyze the compensation mechanism for service disruptions in the M-Paspor application and the government's responsibility in addressing the legal vacuum (rechtsvacuum) in digital immigration services. The research employs a normative juridical method with a statutory approach, utilizing primary, secondary, and tertiary legal sources. The study focuses on immigration service regulations and case studies of technical issues in the M-Paspor application. Data collection is conducted through document analysis and legal interpretation to assess the adequacy of existing regulations. The findings indicate that no specific legal norms currently regulate compensation for users affected by service disruptions, creating uncertainty and potential financial losses. The government holds legal and administrative responsibility to address this gap through additional regulations and policy alignment with higher legal frameworks. A more comprehensive regulatory framework is necessary to ensure legal certainty and fair protection for the public while improving the quality and reliability of digital immigration services.

Abstract

Constitutional Court Decision No. 68/PUU-XII/2014 is an important milestone in the legal debate regarding the validity of interfaith marriages in Indonesia. Although the decision does not change the normative provisions in Article 2 paragraph (1) of Law No. 1/1974 on Marriage, the implications for the position of children from interfaith marriages are very real. Children born from such relationships often face administrative obstacles, uncertainty of legal status, and potential discrimination in obtaining their basic rights as citizens. This study aims to analyze the juridical implications of the Constitutional Court's decision on the legal protection of children from interfaith marriages, and to encourage the formulation of affirmative policies that guarantee the protection of children's rights as a whole. The research method used is normative juridical with the approach of legislation and analysis of court decisions. The results of the study show that derivative regulations and concrete steps are needed from the state to ensure recognition of the legal status of children, in line with the constitutional principles of child protection and respect for human rights.
