Abstract

This research examines the practice of fraudulent debt collectors known as “false eagle eyes” who conduct vehicle collection without legal authority, analyzed through the concept of fraud in the new Indonesian Criminal Code. These individuals often use false identities, positions, and unauthorized information to pressure victims into surrendering their vehicles, creating public anxiety and disrupting social order. This study employs a normative legal method by analyzing norms contained in the new Indonesian Criminal Code, regulations issued by the Financial Services Authority, and relevant legal literature. The findings indicate that such practices fulfill the elements of fraud and can be criminally prosecuted for using deception and illegal actions that undermine public security. The new Criminal Code provides a more comprehensive foundation for law enforcement in addressing these illegal collection practices.

Abstract

Kealpaan yang mengakibatkan akibat fatal merupakan salah satu bentuk kesalahan dalam hukum pidana yang memiliki konsekuensi serius karena berhubungan dengan perlindungan terhadap hak hidup seseorang. Pengaturan kealpaan dalam KUHP lama dinilai kurang memadai karena rumusannya yang masih bersifat umum dan belum membedakan derajat kelalaian secara jelas, sehingga menimbulkan ketidakpastian dalam praktik penegakan hukum. Indonesia kemudian melakukan pembaruan melalui KUHP baru yang mempertegas unsur kesalahan, memperjelas batas tanggung jawab pidana, serta memperluas bentuk sanksi yang lebih proporsional dan humanis. Hasil penelitian menunjukkan bahwa KUHP baru membawa perubahan signifikan pada aspek kepastian hukum, perlindungan terhadap korban, serta efektivitas pemidanaan yang lebih responsif terhadap perkembangan sosial dan teknologi. Selain itu, penerapan keadilan restoratif dalam KUHP baru memberikan ruang pemulihan yang lebih adil bagi korban dan keluarga korban. Abstract

One of the main obstacles to achieving stable legal compliance in Indonesia is social inequality. This study aims to explain how social disparities affect the implementation of law and how injustice shapes the public’s legal perceptions and behaviors. The findings show that law enforcement in Indonesia remains selective: strict toward vulnerable groups but lenient toward influential ones. This conclusion is drawn through a literature study employing a descriptive-analytical approach. Based on the theories of Weber and Foucault, the analysis reveals that law functions not only as a set of rules but also as an instrument of power that enables the reproduction of social inequality. Consequently, the legitimacy of the law weakens, and society begins to adopt an instrumental pattern of compliance. This study emphasizes that law enforcement requires structural reforms, including institutional transparency, improved access to legal aid, and policies that better support vulnerable groups so that the law can operate fairly and efficiently.
