Abstract

Conflict in Mesuji can indeed be categorized as a chronic agrarian conflict. This chronic condition can?t be separated from the complex dynamics of conflict, involving various parties with different interests. Case of indemnification Barat Selatan Makmur Investindo Company with the community in Mesuji is also at the same time a fact that shows that forests do not merely present ecological facts, but a landscape that is socially constructed to fulfill some functions, namely as a region of life, a place to grow the collective identity of a community group, developing the culture of society

Abstract

Narcotics is an international problem faced  by the nations of the world.  Narcotic crime is a crime that is extra ordinary crime and has become transnational organized crime. Therefore its eradication must be carried out with  the  cooperation  of  each  country while effecting the respective national laws in addition  adopt  a  international conventions relating to counter-narcotics. Indonesia's role occupied a strategic place, especially in Southeast Asia and the world at large. Indonesia has shown firmness in the form of legislation that threatens the maximum punishment and they are proven to distribute narcotics have been partially executed. Indonesia is responsible at least in the region makes the drug as a common enemy .

Abstract

In Indonesia, the basic rights of citizens is regulated by the Constitution Law 1945 as the basis of the state constitution. Basic rights of the individual in Indonesia other than stipulated in the 1945 Constitution, as well as further stipulated in the legislation. According to the Law no. 39 of 1999 on human rights article 1, paragraph 1 determines that Human rights are a set of rights attached to nature and human existence as a creature of God is Almighty and His grace which must be respected, upheld and protected by state law , the government and everyone for the respect and protection of human dignity. The basic rights of human beings in the field of economics is the rights of economy activity, labor, right to work, earn a wage and participate in labour unions, intelectual property rights also contract field. Need further study, whether the state protects the rights of individuals in the field of civil economic law in the Indonesian . This papper By using normative methods through the study of literature. The conclusion that the government would need to make rules that are clear and detailed set of individual rights in the economic field which must refer to the basic values which are universal, namely sustainability (sustainability), unity (wholeness), harmony (harmony), equality(balance),equity(fairness)

Abstract

ndonesia as a Muslim-majority country needs an attention to food products which circulate freely. It is not just the attention of the medically healthy composition, but also should be noted that the food consumed is healthy and halal. Inclusion of halal labeling is basically mandatory or voluntary, but if there is a processed food business operators that produce and / or processed food to enter into Indonesian territory to be traded by claiming their products as halal, then the processed food business operators shall put halal labeling and responsible for halal products. It is intended that the right of consumers to correct information, clear and honest about the condition and guarantee of the goods and / or services can be appropriately and adequately protected. In this article, the author uses the method of normative juridical research. The purpose of this paper is to determine the validity of the Consumer Protection Act against halal labelingon food products for Muslim consumers.

Abstract

Renewing military criminal law should be seen as part of the efforts to reform and development of a national justice system, who in truth is a big problem faced by Indonesian to renew or replacing the colonial law. Even though reform efforts have been one long ago, at least some in 1964 to criminal law general (KUHP), but the effort was too late. Renewing military criminal law is not synonymous with renewing KUHPM reform. Renewing military criminal law is more than just a comprehensive change and renew KUHPM. Renewing military criminal law includes renewal in terms of the law (legal structure), matters of the law (legal substance),and legal cultural. Renewing military criminal law must be done by global conducted (approach), to renew the draft still formulate KUHPM with the codification its own codification KUHP on the outside.

Abstract

Perjanjian Kerja adalah Perjanjian atau kesepakatan yang diadakan antara serikat pekerja atau serikat-serikat pekerja yang telah terdaftar pada departemen tenaga kerja dengan pengusaha atau perkumpulan pengusaha yang berbadan hukum, yang pada umumnya atau semata-mata memuat syarat-syarat kerja yang harus diperhatikan dalam perjanjian kerja. Perumusan masalah dalam penelitian ini adalah bagaimana Pelaksanaan Perjanjian Kerja Di Perseroan Terbatas Ditinjau Dari Peraturan Perundang- Undangan Ketenagakerjaan dan apakah Perjanjian Kerja Yang Dibuat Oleh Perseroan Terbatas (PT) Dengan Pekerja Telah Memenuhi Unsur-Unsur Perjanjian Kerja Menurut Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Metode penelitian yang digunakan yakni: studi kepustakaan (library research) dan penelitian lapangan (field research). Hasil penelitian ini, menyimpulkan bahwa saat ini masih terdapat beberapa perusahaan yang masih mencantumkan dalil-dalil perjanjian kerja antara perusahaan dan karyawan yang bertentangan dengan Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, yaitu apabila salah satu perusahaan tidak membayarkan cuti karyawan yang belum diambil atau gugur, maka karyawan berhak mendapatkan uang penggantian hak sesuai dengan ketentuan perundang-undangan

Abstract

Istri yang menjadi korban kekerasan dalam rumah tangga harus mendapatkan perlindungan hukum sesuai dengan amanat Undang-Undang Nomor 23 tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Pasal 10 Undang-Undnag Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga menyatakan bahwa korban kekerasan dalam rumah tangga berhak mendapatkan perlindungan dari pihak keluarga, kepolisian, kejaksaan, pengadilan,advokat, lembaga sosial, atau pihak lainnya baik sementara maupun berdasarkan penetapan perintah perlindungan dari pengadilan,pelayanan kesehatan sesuai dengan kebutuhan medis,penanganan secara khusus berkaitan dengan kerahasiaan korban,pendampingan oleh pekerja sosial dan bantuan hukum pada setiap tingkat proses pemeriksaan sesuai dengan ketentuan peraturan perundang-undangan dan pelayanan bimbingan rohani.Metode penelitian yang dilakukan dalam penelitian  ini adalah dengan menggunakan metode penelitian kualitatif melalui penelitian hukum normatif. Penelitian normatif yang bersifat kualitatif adalah penelitian yang mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan serta norma-norma yang hidup dan berkembang dalam masyarakat, khususnya yang dalam hal ini berkaitan dengan pokok permasalahan yang akan dibahas dalam penelitian  ini.

Abstract

Entering the era of MEA, HR Indonesia absolutely must be improved in order to be on par with SDM countries in the ASEAN region. Socio-cultural aspects necessary for the development of human resources (HR) through education. With hope, when the ASEAN community-level human resources is equivalent (equal), will furtheraccelerate economic integration as the main pillars of the ASEAN Community.Therefore, it is important the holding of the ASEAN countries to increase cooperation in the field of education. This cooperation is to improve the quality of human resources, especially pupils and students in the ASEAN region. This study discusses the regulatory history of education in Indonesia and the implementation of the regulations of national education to develop human resources capable of competing in the MEA.

Abstract

According to Article 1 Act No.15 of 2001 on Marks, the meaning of Marks is a sign in the form of pictures, names, words, letters of numbers, color arrangements, or combinations of those elements which have differentiating power and are used in the world of trade in goods or services. In the world of trades often occur brand violations. Branding violations are essentially committed by parties that have no good ethics to gain a profit, which can harm a legitimate brand owner. The purpose of this study is to know the legal protection against brand disputes. The method used in this research is the normative juridical approach method because this legal research uses data from library materials (secondary data). The results of this study illustrate that legal protection for a person or owner of a brand in the event of a brand dispute.
