Abstract

Abstrak Dampak perubahan iklim Di Indonesia salah satunya adalah naiknya permukaan air laut. Seperti contoh, di Kabupaten Indramyu yang meningkatkanya suhu permukaan air laut yang berakibatkan kerusakan lingkungan laut dan pesisir. Perlu adanya pengendalian adaptasi perubahan iklim, pemerintah daerah yang memiliki kewenangan dalam menetapkan kebijakan yang otoritatif dianggap mampu menyelesaikan permasalahan. Namun, dengan perubahan paradigma sistem dari desentralisasi ke sentralisasi merupakan kendala dalam mengharmonisasikan program-program pengendalian perubahan iklim. Oleh karena itu, temuan dalam hasil penelitian ini dikembalikanya kewenangan yang secara otoritatif terhadap pemerintah daerah. Metode penelitian yang digunakan adalah Yuridis-Normatif, yaitu suatu tata cara penelitian ilmiah agar menemukan suatu kabsahan berlandasakan logika dan filosofi keilmuan dari sisi normatifnya. Hasil penelitian membuktikan bahwa untuk efektifitas pengendalian perubahan iklim perlu adanya peranan pemerintah agar menjamin keterpaduan kewenangan program pemeritnah dari pusat sampai tingkat daerah. Serta, harmonisasi program-program untuk pengendalian perubahan iklim dapat melalui cara yaitu, pengefektifitaskan kewenangan pemerintah daerah, berfokus pada UNFCC serta pengurangan gas emisi, karbondioksida.

Abstract

Artikel ini bertujuan untuk menganalisis dan mendeskripsikan implementasi fungsi Badan Permusyawaratan Desa dalam pembentukan produk hukum desa.. Mengingat, dalam realitas peraturan desa seringkali diabaikan dalam hal penyelenggaraan urusan pemerintahan di desa. sehingga dalam penyusunannya peraturan desa tersebut tidak berdasarkan pada prinsip peraturan perundang-undangan yang baik (good legislation), dan bahkan banyak desa yang belum memiliki peraturan desa. ketiadaan dari peraturan desa tersebut merupakan gambaran terhadap pelaksanaan fungsi badan permusyawaratan desa yang belum berjalan sebagaimana mestinya. Identifikasi masalah sebagai berikut: 1. Bagaimana fungsi Badan Permusyawaratan Desa berdasarkan Undang-Undang Nomor 6 Tahun 2014 Tentang Desa, 2. Bagaiamana implementasi badan permusyawaratan desa dalam pembentukan produk hukum desa di desa singaraja kecamatan indramayu kabupaten indramayu. Metode penelitian yang digunakan ini adalah yuridis-normatif penelitian hukum mengkaji data dan bahan hukum primer dan skunder. Seluruh data dan bahan hukum kemudian dianalisa secara kualitatif dengan memberikan telaah terhadap hasil penelitian dengan memberikan telaah terhadap hasil penelitian dengan pikiran sendiri dan dibantu dengan norma-norma hukum, doktrin hukum, dan teori ilmu hukum yang dikuasai. Berdasarkan hasil temuan menjelaskan bahwa pelaksanaan fungsi legislasi BPD di Desa Singaraja Kecamatan Indramayu Kabupaten Indramayu masih belum optimal yang disebabkan oleh kurangnya koordinasi antara BPD Singaraja dengan Pemerintah Desa Singaraja. Dalam pengumpulan aspirasi masyarakat terkait gagasan Raperdes yang akan dibuat, perumusan Peraturan Desa, dan terhadap usulan Raperdes yang kemudian disahkan menjadi Peraturan Desa masih didominasi oleh Pemerintah Desa.

Abstract

Integrated coastal management (ICM) is a guideline and framework for peer assessment services for coastal area protection and management. The ratification of the international conference on the protection of seas and coastal areas underlies the exploitation of seas and coastal areas that exceed the carrying capacity and resilience of environmental management. The conception of ICM in its framework carries integration or integration between sectors such as central and local governments, the private sector, and entrepreneurs. The success of the conception of ICM can be seen in terms of the functions and rules of ICM that affect the development of sustainable coastal areas. However, with the success of ICM, of course, it saves the negative side of the limits and policy patterns based on local government authority, it will be possible to overlap the determination of the role and function of centralized ICM. The research method used is juridical-normative, namely research that prioritizes data analysis based on norms and rules that can then be analyzed through qualitative stages with description-analysis. Based on the results of the study that the limits of the function and role of ICM lie in matters of authority between the central and regional governments, these limits will arise on the content of the interests of managing arrangements, utilizing coastal areas.

Abstract

One of the tasks that have to be done in forensic laboratory is the identification of fire victims with physical forms that are no longer recognizable. However, they still could be identified with the help of certificate from DVI (Disaster Victim Identification) and Post Mortem. One of the problems arise is that the family of the victims have no confidence that the victims identified are their family member. Based on the background of the study above, the researcher intended to conduct a study with the title of ’KEKUATAN SURAT KETERANGAN HASIL DVI DAN POST-MORTHEM SEBAGAI ALAT BUKTI KORBAN KEBAKARAN YANG MENGAKIBATKAN MENINGGAL DUNIA DIKAITKAN DENGAN PASAL 184 AYAT 3 KUHPIDANA’’. According to the tittle above, the identification of the problems are: How is the strength of the proof from the forensic laboratory evidence regarding the fire victims in association with Article 184 Section 3 of the constitution about witnesses? How is the strength of a DVI certificate, Post Mortem, and Anti Mortem in positive rules of Indonesia? This research is a normative juridical legal research. It is a study of laws and regulations in terms of the hierarchy of legislation. Article 133 Section (1) of the Criminal Procedure Code authorizes an investigator to submit a request for information to a judicial medical expert if the investigation involves a victim of injury, poisoning, or death. The expert statement request was made in writing form. It becomes the basis that the power of the DVI, Post Mortem, and Ante Mortem letters is very strong based on Article 133 Section 1 of the Criminal Procedure Code. The letter to be examined is the evidence made by the forensic laboratory. According to Article 187 Letter c of the Constitution Number 8 of 1981 concerning the Criminal Procedure Code states that: "A letter from an expert statement contains an opinion based on his expertise regarding something or a condition that was formally requested from him.” Finally, it can be concluded that the strength of the DVI letter, Post Mortem, and Ante Mortem could no longer be doubted because the government and institution have their own authority. However, it refers to the families of individuals who feel that they are not family members of the victims. They have other alternatives, such as rechecking the DNA testing, RNA, or other compatible identity.

Abstract

In a government organization, the expertise of the law making is most accumulated. It enables the law making process to be easily done by law the enforcers. This fact causes the role of government to be central. It also lead to an access of government organizations to become very powerful over the functions of organizations that exist within and outside the government. Therefore, to avoid concentration of power in the hands of government organizations, the idea arises to hold a separation and division of powers. The emergence of a constitutional idea of ​​a rule of law basically changes the power of the government. It makes their existence is not too dominant to see the Indonesian government system recognizing regional government and regional autonomy which are basically capable of impacting in the system of pillars of the democratic legal order. The shift of legislative and executive power within the framework of regional autonomy has indeed occurred with the dynamics of a structurally structured and infrastructural political life. It has an authority over each of the institution's committees. It acts an important function and even considered as the main function of the parliamentary institution. Important function is the legislative institution that is the institution legislators or institutions that determine the making of the law.
