Abstract

The research was motivated by the government's failure to finalize ownership of agricultural land in absentia. Pancasila as a guide to the value of justice should be used as government legal politics in carrying out preventive and repressive actions in synergy with the use of Information technology, which currently continues to grow. The Indonesian population, which is the majority of Muslims, certainly intersects between ideological, religious, and national ideologies. This research does not find new theories but wants to identify and examine how the perspective of Indonesian society in energizing religious ideology and Pancasila values which are believed by the Indonesian people as the basic foundation of national and state life. This research offers solutions for the use of E-KTP and data synergy between authorized institutions as an effort to prevent the absence of land ownership in terms of the perspective of Islamic legal values and Pancasila ideology. This research was conducted using normative research methods with a legal approach and legal doctrine.

Abstract

Regional expansion in the Certificate of Ownership Rights is a concrete manifestation of Regional Autonomy. The process of regional expansion of the Certificate of Ownership Rights on land at the National Land Agency Representative Office of Batu Bara Regency is to make a letter of application for the process of regional expansion of the Certificate of Ownership Rights of land which is to be expanded at the Office of the National Land Agency Representative of Batu Bara Regency, then complete the documents. Requirements for the application for the expansion process of the Certificate of Ownership that want to be expanded at the National Land Agency Representative Office of Batu Bara Regency, after the application and requirements are complete, after that the Office of the National Land Agency Representative of Batu Bara Regency can process the application for regional expansion in the Certificate of Ownership Rights on the land applied for. The problem with the Certificate of Ownership Rights for land at the Batu Bara Regency Representative National Land Agency Office is that the position of the land is not in accordance with the existing application system at the Batu Bara Regency Representative National Land Agency Office, so that the Batu Bara Regency Representative National Land Agency Office experiences difficulties in expanding the Certificate of Ownership of land.Keywords: Expansion; Certificate of Ownership; Land.

Abstract

Abstrak Tanah memiliki kepentingan yang sangat besar untuk kepentingan semua individu, yang mencakup individu pribadi dengan hak milik dan entitas publik. Kedua entitas ini diakui sebagai subjek hukum, dengan tanah sebagai objek hak hukum mereka. Fokus kajian ini membahas mengenai tentang proses penyelesaian sengketa tanah Gedung Olahraga (GOR) Tanjungbalai di Pengadilan Negeri Tanjungbalai. Selain itu, bertujuan untuk menggali faktor-faktor yang menjadi pertimbangan majelis hakim dalam mengambil keputusan atas perkara sengketa tanah di lingkungan pengadilan tersebut. Penelitian ini menggunakan metode penelitian hukum empiris dan melakukan studi kasus di Pengadilan Negeri Tanjungbalai. Penelitian ini mengandalkan bahan-bahan hukum seperti peraturan perundang-undangan, dilengkapi dengan sumber-sumber sekunder seperti buku-buku hukum dan sumber-sumber tersier seperti buku-buku non-hukum. Untuk mencapai resolusi yang menguntungkan bagi kedua belah pihak yang terlibat, perlu untuk terlibat dalam metode penyelesaian sengketa non-litigasi. Hal ini berlaku untuk semua perkara yang diajukan ke Pengadilan Negeri. Tujuan mediasi atau penyelesaian sengketa non-litigasi adalah untuk memungkinkan para pihak mencapai kesepakatan yang saling menguntungkan dengan bantuan pihak ketiga yang netral. Namun, pada akhirnya para pihak sendirilah yang membuat keputusan akhir. Proses settlement dilakukan melalui dua mekanisme yaitu pembayaran biaya kompensasi. Dalam kasus ini, pemohon menuntut ganti rugi sebesar 17M, sedangkan tergugat meminta 6M. Anehnya, Pemko Tanjungbalai tiba-tiba menarik diri dan menolak membayar ganti rugi yang telah disepakati, padahal ada laporan bahwa anggaran sebesar 9,6M sudah tersedia. “Dalam memutus perkara ini, hakim harus mempertimbangkan dan mengutamakan asas keadilan, kepastian hukum, dan kepraktisan. Tujuannya untuk mengeluarkan keputusan yang ideal, dan tidak membebani salah satu pihak dan dapat diterima dengan baik. Kata Kunci : Penyelesaian Sengketa, Pertanahan, Pengadilan NegeriAbstrack Land is of immense importance to the benefit of all individuals, including private individuals with property rights and public entities. Both of these entities are recognized as legal subjects, with land as the object of their legal rights. The focus of this study is on the Tanjungbalai Sports Building (GOR) land dispute resolution process at the Tanjungbalai District Court. In addition, it aims to explore the factors that are considered by the panel of judges in making decisions on land dispute cases within the court environment. This study uses empirical legal research methods and conducts case studies at the Tanjungbalai District Court. This research relies on legal materials such as laws and regulations, supplemented by secondary sources such as law books and tertiary sources such as non-law books. In order to achieve a resolution that is beneficial to both parties involved, it is necessary to engage in non-litigation dispute resolution methods. This applies to all cases submitted to the District Court. The purpose of mediation or non-litigation dispute resolution is to enable the parties to reach a mutually beneficial agreement with the help of a neutral third party. However, in the end it is the parties themselves who make the final decision. The settlement process is carried out through two mechanisms, namely the payment of compensation fees. In this case, the plaintiff demanded compensation of 17M, while the defendant asked for 6M. Surprisingly, the Pemko Tanjungbalai suddenly withdrew and refused to pay the agreed compensation, even though there were reports that a budget of 9.6 billion was already available. "In deciding this case, the judge must consider and prioritize the principles of justice, legal certainty and practicality. The goal is to issue an ideal decision, which does not burden either party and is well received. Keywords : Dispute Resolution, Land, District Court

Abstract

This research is based on the background Absentee land is land owned by individuals or legal entities that do not physically live on or are near the land. The focus of absentee land management implementation is to identify the challenges and impacts associated with land ownership by owners who are not in the area concerned. This study aims to analyze how absentee land management affects the environment and local communities.

Abstract

Land is a valuable asset with high economic, social, and legal significance. Legal certainty over land ownership is crucial to preventing disputes, facilitating transactions, and supporting economic development. However, many people in Indonesia have yet to officially register their land, including those in Sei Kamah Baru Village, Asahan Regency. The main factors contributing to this issue are the lack of public understanding of land registration procedures, the perception of high costs, and the minimal outreach from relevant authorities. This community service activity aims to raise awareness and understanding among the public about the importance of land registration to ensure legal ownership. The methods used in this program include preparation, legal counseling sessions, discussions, and administrative assistance for residents who wish to process their land certificates. The counseling session was held on January 30, 2025, at the Sei Kamah Baru Village Hall, attended by local residents, village officials, and representatives from the National Land Agency. The results of this activity indicate an increase in public awareness regarding the importance of land certification and its registration procedures. Additionally, some residents have taken the initiative to process their land certificates after receiving assistance from the community service team. This counseling session had a positive impact on enhancing legal awareness and encouraging land ownership legalization to prevent future disputes. For the program's sustainability, more intensive counseling sessions and collaboration with the government and the National Land Agency are needed to simplify the land registration process for the community.

Abstract

Abstrak: Konflik sosial di Desa Hessa Air Genting masih sering terjadi dan berpotensi mengganggu keharmonisan masyarakat. Kegiatan pengabdian ini bertujuan untuk meningkatkan efektivitas peran paralegal desa dalam menyelesaikan konflik berbasis prinsip restorative justice. Metode yang digunakan meliputi pelatihan, pendampingan, dan studi kasus terhadap 5 konflik yang pernah terjadi. Kegiatan melibatkan 15 paralegal desa dan dilakukan melalui sesi workshop dan simulasi mediasi. Evaluasi dilakukan dengan pre-test dan post-test serta observasi keterlibatan peserta. Hasil menunjukkan peningkatan keterampilan mediasi sebesar 7058% dan pemahaman tentang restorative justice sebesar 605%. Selain itu, 4 dari 5 konflik yang dianalisis berhasil diselesaikan melalui pendekatan non-litigasi. Kegiatan ini berkontribusi dalam memperkuat kapasitas hukum berbasis komunitas serta meningkatkan kesadaran hukum masyarakat desa.Abstract: Social conflicts in Hessa Air Genting Village frequently occur and threaten community harmony. This community engagement aims to enhance the effectiveness of village paralegals in resolving conflicts through restorative justice principles. The methods used include training, mentoring, and case studies of five past conflicts. The activity involved 15 village paralegals through workshops and mediation simulations. Evaluation was conducted using pre-tests, post-tests, and participant observation. Results showed a 7058% increase in mediation skills and a 650% improvement in understanding restorative justice. Additionally, four out of five conflicts were successfully resolved through non-litigation approaches. This program contributes to strengthening community-based legal capacity and raising legal awareness in the village.
