Abstract

The implementation of mutations is a policy regulated by the government to improve public services and government administration functions. Transfers between agencies in Asahan Regency are carried out by rotating employees and fulfilling needs according to competency, educational background and performance assessment. It is hoped that civil servant transfers will have a better impact on regional administration. The research method used in this thesis analysis is an empirical legal research method with the primary material being interview studies and observations through direct observation and receiving information from respondents. The results of research conducted by the author in analyzing the implementation of Civil Servant transfers between agencies in Asahan Regency, show that the role of civil servant transfers between agencies in the Asahan Regency Government aims to optimize the performance of agencies in Asahan Regency, including technical staff, teachers and health workers. That the existence of an inter-agency transfer system can meet the needs and shortcomings of civil servants in Asahan Regency in accordance with the performance, educational background and competencies possessed by Civil Servants. The obstacles faced in the Civil Servant mutation process are in accordance with the author's direct observation that Civil Servants who wish to apply for a mutation do not understand the procedures and requirements for submitting a mutation, apart from that, civil servants who are in the 2018 formation cannot apply. transfer because they have to follow the provisions in Government Regulation Number 11 of 2017 concerning Management of Civil Servants. Abstract

Abstrak Tanah memiliki kepentingan yang sangat besar untuk kepentingan semua individu, yang mencakup individu pribadi dengan hak milik dan entitas publik. Kedua entitas ini diakui sebagai subjek hukum, dengan tanah sebagai objek hak hukum mereka. Fokus kajian ini membahas mengenai tentang proses penyelesaian sengketa tanah Gedung Olahraga (GOR) Tanjungbalai di Pengadilan Negeri Tanjungbalai. Selain itu, bertujuan untuk menggali faktor-faktor yang menjadi pertimbangan majelis hakim dalam mengambil keputusan atas perkara sengketa tanah di lingkungan pengadilan tersebut. Penelitian ini menggunakan metode penelitian hukum empiris dan melakukan studi kasus di Pengadilan Negeri Tanjungbalai. Penelitian ini mengandalkan bahan-bahan hukum seperti peraturan perundang-undangan, dilengkapi dengan sumber-sumber sekunder seperti buku-buku hukum dan sumber-sumber tersier seperti buku-buku non-hukum. Untuk mencapai resolusi yang menguntungkan bagi kedua belah pihak yang terlibat, perlu untuk terlibat dalam metode penyelesaian sengketa non-litigasi. Hal ini berlaku untuk semua perkara yang diajukan ke Pengadilan Negeri. Tujuan mediasi atau penyelesaian sengketa non-litigasi adalah untuk memungkinkan para pihak mencapai kesepakatan yang saling menguntungkan dengan bantuan pihak ketiga yang netral. Namun, pada akhirnya para pihak sendirilah yang membuat keputusan akhir. Proses settlement dilakukan melalui dua mekanisme yaitu pembayaran biaya kompensasi. Dalam kasus ini, pemohon menuntut ganti rugi sebesar 17M, sedangkan tergugat meminta 6M. Anehnya, Pemko Tanjungbalai tiba-tiba menarik diri dan menolak membayar ganti rugi yang telah disepakati, padahal ada laporan bahwa anggaran sebesar 9,6M sudah tersedia. “Dalam memutus perkara ini, hakim harus mempertimbangkan dan mengutamakan asas keadilan, kepastian hukum, dan kepraktisan. Tujuannya untuk mengeluarkan keputusan yang ideal, dan tidak membebani salah satu pihak dan dapat diterima dengan baik. Kata Kunci : Penyelesaian Sengketa, Pertanahan, Pengadilan NegeriAbstrack Land is of immense importance to the benefit of all individuals, including private individuals with property rights and public entities. Both of these entities are recognized as legal subjects, with land as the object of their legal rights. The focus of this study is on the Tanjungbalai Sports Building (GOR) land dispute resolution process at the Tanjungbalai District Court. In addition, it aims to explore the factors that are considered by the panel of judges in making decisions on land dispute cases within the court environment. This study uses empirical legal research methods and conducts case studies at the Tanjungbalai District Court. This research relies on legal materials such as laws and regulations, supplemented by secondary sources such as law books and tertiary sources such as non-law books. In order to achieve a resolution that is beneficial to both parties involved, it is necessary to engage in non-litigation dispute resolution methods. This applies to all cases submitted to the District Court. The purpose of mediation or non-litigation dispute resolution is to enable the parties to reach a mutually beneficial agreement with the help of a neutral third party. However, in the end it is the parties themselves who make the final decision. The settlement process is carried out through two mechanisms, namely the payment of compensation fees. In this case, the plaintiff demanded compensation of 17M, while the defendant asked for 6M. Surprisingly, the Pemko Tanjungbalai suddenly withdrew and refused to pay the agreed compensation, even though there were reports that a budget of 9.6 billion was already available. "In deciding this case, the judge must consider and prioritize the principles of justice, legal certainty and practicality. Abstract

Sengketa hubungan industrial dapat memberikan dampak serius terhadap produktivitas perusahaan dan kesejahteraan pekerja. Tujuan dari penelitian ini adalah untuk mengkaji masalah yang muncul dalam penyelesaian konflik ketenagakerjaan dan menilai efektivitas mediasi sebagai metode pengganti di Disnaker Asahan. Penelitian ini menggunakan pendekatan penelitian hukum kualitatif dan empiris. Wawancara dengan mediator di Disnaker Asahan dalam memperoleh datanya, analisis dokumen peraturan, dan studi kasus penyelesaian sengketa yang telah dilakukan dengan mediator. Hasil penelitian menunjukkan bahwa mediasi di Dinas Tenaga Kerja Asahan telah berhasil menjadi solusi efektif dalam menyelesaikan sengketa hubungan industrial. Mediasi memberikan penyelesaian yang cepat, hemat biaya, dan meminimalkan dampak negatif terhadap hubungan antara para pihak. Meskipun demikian, beberapa hambatan seperti ketidaksepahaman pihak untuk sepenuhnya berkomitmen masih menjadi hambatan yang perlu diatasi. Penelitian ini menyimpulkan bahwa mediasi di Dinas Tenaga Kerja Asahan memiliki peran penting dalam menangani sengketa hubungan industrial. Keberhasilan mediasi tidak hanya terletak pada efektivitas penyelesaian, tetapi juga pada kemampuan mediator dalam membangun kepercayaan dan dialog terbuka antara pihak yang bersengketa. Implikasi penelitian ini dapat memberikan kontribusi positif terhadap pengembangan kebijakan dan praktik penyelesaian sengketa di tingkat nasional, khususnya dalam kajian alternatif penyelesaian sengketa hubungan industrial.

Abstract

Hak cuti dapat diartikan sebagai hak atas ketidakhadiran sementara atau tertentu dengan disertai keterangan dari pihak yang bersangkutan. Pasca berlakunya Undang-Undang Cipta Kerja, terdapat perubahan mengenai pengaturan hak cuti bagi pekerja. Perubahan tersebut dinilai kontroversial karena beberapa ketentuan dalam Undang-Undang Cipta Kerja memberikan ruang lebih bagi perusahaan untuk mengatur hak cuti karena banyak aturan yang diatur sebelumnya telah dihapuskan.Penelitian ini menggunakan metode deskriptif dimana penelitian deskriptif merupakan penelitian yang menggambarkan karakteristik dari suatu populasi atau sebuah fenomena yang menjadi objek penelitian. Pendekatan yang digunakan adalah pendekatan perundang-undangan (statue approach) dengan menelaah undang-undang yang berkaitan dengan objek penelitian.Perubahan terhadap hak-hak cuti bagi tenaga kerja pasca berlakunya Undang-Undang Cipta Kerja adalah dengan dihapusnya ketentuan dalam Pasal 79 ayat (2) huruf d Undang-Undang Ketenagakerjaan. Melalui Pasal 81 Angka 68 Undang-Undang 6 Tahun 2023, negara menjamin bahwa siapa pun yang melanggar ketentuan yang terdapat pada Pasal 81 angka 25 Undang-Undang 6/2023 akan dikenai sanksi pidana berupa pidana kurungan minimal 1 bulan dan maksimal 12 bulan, dan/atau denda minimal Rp10.000.000,00 (sepuluh juta rupiah) dan maksimal Rp100.000.000,00 (seratus juta rupiah). Untuk memastikan bahwa hak cuti dan waktu istirahat pekerja benar-benar terjaga.

Abstract

The KPU is a national election organizer that has a constant and independent character. Letter b Article 13 of Law No. 7 of 2017 concerning Elections reports that the KPU has the authority to establish KPU regulations at all stages of the election. This is done to ensure that all stages of selection occur. Place within a deadline. In elections where a dual candidate for president and vice president is proposed by a political party or a combination of several political parties participating in the election, there are various provisions that the political party can comply with in the proposal before the election begins. One of the parties or a combination of political parties participating in the election is said to be the age limit for nominating presidential and vice presidential candidates. In this legal research, normative legal research methods are used and the problem approach used is the statutory approach. This legal research uses primary legal materials, namely: Legislation. Secondary legal materials, namely: law books. Tertiary legal materials, namely: non-legal books.The reason for the Petitioner and Under the Law to submit Application No. 90/PUU-XXI/2023 concerning the Age Limit for Presidential and Vice Presidential Candidates is that there is discrimination that the applicant said is related to the age limit. For the applicant, this is due to the myth that is growing among the community that elderly people are always thought to be capable/able to be included as Regent. The legal evaluation of the Constitutional Court judges in their decision No. 90/PUU-XXI/2023 concerning the age limit for presidential and vice-presidential candidates is that the Court's consideration of the Petitioner's issue regarding Article 169 letter (q) of Law No. 7 of 2017 is "...or good experience as regional president at the provincial or district/city level”

Abstract

This study aims to understand the effects of marriage cancellation law due to the forgery of identity in the case of polygamy according to the Civil Code and constraints as well as solutions to the cancellation of the marriage. This study uses a normative juridical method with a case study approach and analytical descriptive specifications. This study relies on secondary data derived from primary, secondary, and tertiary legal materials. Data collection methods use literature studies and documentary studies which are then analyzed by qualitative analysis and normative analysis methods. The results of the study are (1) the cancellation of marriage according to the Criminal Code results in legal consequences for the husband to pay compensation and interest for his wife or other parties who are disadvantaged while for children who are born are children outside of marriage. (2) Constraints in the cancellation of marriage due to the existence of identity forgery, namely the objection of one of the parties on the grounds that the existence of children born then the solution is to provide guidance for bride and groom candidates, increase the frequency of socialization and demand compensation. Constraints because the procedure for the request for cancellation to the court tends to be complicated and long, the solution is to make a request for marriage prevention to the official recording officer and the court as well as make peace efforts in the case of marriage cancellation. Constraints of differences in legal provisions to the status of children, the solution is legal renewal through the formulation in the draft of the Special Civil Procedure Code that regulates the cancellation of marriage due to the counterfeiting of the identity of the polygamy case. Penelitian ini bertujuan untuk memahami akibat hukum pembatalan perkawinan karena adanya pemalsuan identitas dalam kasus poligami menurut KUHPerdata dan kendala serta solusi terhadap pembatalan perkawinan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kasus dan spesifikasi deskriptif analitis. Penelitian ini bertumpu pada data sekunder yang berasal dari bahan hukum primer, sekunder dan tersier. Metode pengumpulan data menggunakan studi pustaka dan studi dokumenter yang kemudian dianalisis dengan metode analisis kualitatif dan analisis normatif. Hasil penelitian yaitu pembatalan perkawinan menurut KUHPerdata berakibat hukum bagi suami harus membayar ganti kerugian dan bunga bagi istrinya atau pihak lain yang dirugikan sedangkan bagi anak yang dilahirkannya berstatus sebagai anak luar kawin. Kendala dalam pembatalan perkawianan karena adanya pemalsuan identitas yaitu adanya keberatan dari salah satu pihak dengan alasan adanya anak yang dilahirkan maka solusinya yaitu memberikan bimbingan bagi calon pengantin dan keluarga keduanya, meningkatkan frekuensi sosialisasi serta menuntut ganti kerugian. Kendala karena prosedur permohonan pembatalan ke pengadilan yang cenderung rumit dan lama maka solusinya yaitu membuat permohonan pencegahan perkawinan ke petugas pencatat pekawinan dan pengadilan serta melakukan upaya perdamaian dalam perkara gugatan pembatalan perkawinan. Kendala perbedaan ketentuan hukum terhadap status anak maka solusinya yaitu pembaharuan hukum melalui perumusan dalam Rancangan Undang-Undang Hukum Acara Perdata Khusus yang mengatur pembatalan perkawinan karena pemalsuan identitas kasus poligami.

Abstract

The aim of this research is to analyze the responsibilities/authority of the Central Java Provincial Information Commission and its obstacles in developing Information and Documentation Management Officers (PPID) in resolving public information disputes. The type of research used in this writing is sociological legal research (sociolegal research) with a conceptual approach. Data analysis was carried out qualitatively. The Central Java Provincial Information Commission (KIP Central Java) has broad authority in developing Information and Documentation Management Officials (PPID) in its region which includes establishing information service standards, criteria and procedures for establishing PPID, as well as preparing technical guidelines. KIP also has a role in coaching through training, evaluation and supervision of PPID. In addition, KIP has the authority to handle complaints related to violations of the right to public information and can provide recommendations or sanctions. Monitoring, supervision and administrative actions are also part of KIP's responsibility to ensure PPID's compliance with legal provisions. The development of Information and Documentation Management Officers (PPID) by the Central Java Province Information Commission faces several obstacles, namely, regulations regarding the rights, authority and obligations of the Information Commission through the Council of Commissioners have not been clearly regulated in statutory regulations. In the Adjudication hearing there were also obstacles related to the Respondent's power of attorney, not all of whom were PPID. Then, PPID has difficulty ensuring the classification of the information requested by the Applicant, especially if the information is not listed as exempt information, and a lack of clear understanding of standard operational procedures can hinder the effective processing of information requests. Tujuan penelitian ini yaitu untuk menganalisis tanggung jawab/wewenang Komisi Informasi Provinsi Jawa Tengah dan kendalanya dalam pembinaan Pejabat Pengelola Informasi dan Dokumentasi (PPID) dalam penyelesaian sengketa informasi publik. Jenis penelitian yang digunakan dalam penulisan ini yakni penelitian hukum yuridis sosiologis (sociolegal research) dengan pendekatan konseptual. Analisa data dilakukan secara kualitatif. Komisi Informasi Provinsi Jawa Tengah (KIP Jawa Tengah) memiliki wewenang yang luas dalam pembinaan Pejabat Pengelola Informasi dan Dokumentasi (PPID) di wilayahnya yang mencakup penetapan standar pelayanan informasi, kriteria dan prosedur pembentukan PPID, serta penyusunan pedoman teknis. KIP juga memiliki peran dalam pembinaan melalui pelatihan, evaluasi, dan supervisi terhadap PPID. Selain itu, KIP memiliki kewenangan dalam menangani pengaduan terkait pelanggaran hak atas informasi publik dan dapat memberikan rekomendasi atau sanksi. Pemantauan, pengawasan, dan tindakan administratif juga menjadi bagian dari tanggung jawab KIP untuk memastikan ketaatan PPID terhadap ketentuan hukum. Pembinaan Pejabat Pengelola Informasi dan Dokumentasi (PPID) oleh Komisi Informasi Provinsi Jawa Tengah menghadapi beberapa kendala yakni, regulasi mengenai hak, wewenang, dan kewajiban Komisi Informasi melalui Majelis Komisioner belum diatur dengan jelas dalam peraturan perundang-undangan. Dalam sidang Ajudikasi juga terdapat kendala terkait kuasa Termohon yang tidak seluruhnya merupakan PPID. Lalu, PPID kesulitan memastikan klasifikasi informasi yang diminta oleh Pemohon, terutama jika informasi tersebut tidak terdaftar sebagai informasi yang dikecualikan, dan pemahaman kurang jelas terhadap prosedur operasional standar dapat menghambat pemrosesan permohonan informasi secara efektif.

Abstract

This study aims to analyze the crime of cohabitation as an absolute complaint offense in practice before and after the enactment of Article 412 of Law No. 1/2023 concerning the Criminal Code. The background is the negative stigma against cohabitation in Indonesian society and the ambiguity of the law before the existence of explicit regulations. The urgency of this study is to provide legal certainty and avoid arbitrary handling of cohabitation cases. The research method used is normative juridical with a descriptive analysis approach, using secondary data from laws and regulations, literature, and dictionaries. The novelty of this study lies in the comprehensive analysis of the handling of cohabitation before and after the enactment of the new Criminal Code Law. The results of the study show that before Law No. 1/2023, the handling of cohabitation varied, ranging from customary sanctions to the application of adultery articles. With the enactment of the new Law as of January 2, 2026, cohabitation is regulated as an absolute complaint offense with limitations on complainants. In conclusion, although cohabitation now has a clear legal basis, its implementation still considers aspects of social balance and family resolution, similar to the concept of restorative justice. Customary law can still be applied in handling cohabitation, but requires government regulations as derivative rules for its implementation. Penelitian ini bertujuan untuk menganalisis tindak pidana kohabitasi sebagai delik aduan absolut dalam praktik sebelum dan setelah berlakunya Pasal 412 UU No. 1/2023 tentang KUHP. Latar belakangnya adalah stigma negatif terhadap kohabitasi di masyarakat Indonesia dan ketidakjelasan hukum sebelum adanya aturan eksplisit. Urgensi penelitian ini adalah untuk memberikan kepastian hukum dan menghindari penanganan sewenang-wenang terhadap kasus kohabitasi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analisis, menggunakan data sekunder dari peraturan perundang-undangan, literatur, dan kamus. Kebaruan penelitian ini terletak pada analisis komprehensif terhadap penanganan kohabitasi sebelum dan setelah berlakunya UU KUHP baru. Hasil penelitian menunjukkan bahwa sebelum UU No. 1/2023, penanganan kohabitasi bervariasi, mulai dari sanksi adat hingga penerapan pasal perzinahan. Dengan berlakunya UU baru per 2 Januari 2026, kohabitasi diatur sebagai delik aduan absolut dengan limitasi pengadu. Kesimpulannya, meskipun kohabitasi kini memiliki dasar hukum yang jelas, penerapannya tetap mempertimbangkan aspek keseimbangan sosial dan penyelesaian kekeluargaan, mirip dengan konsep keadilan restoratif. Abstract

Legal protection aims to guarantee workers' rights, particularly for contract workers, regarding fair wages that should be ensured by law, including the latest regulations governing the mechanisms and procedures for employment relationships with contract workers, namely Law No. 6 of 2023 and Government Regulation No. 35 of 2021. The issue at hand is that many companies continue to neglect the rights of contract workers, with instances of discrimination occurring in various industrial sectors. Based on the research conducted, this study employs an empirical legal method by collecting primary and secondary data to analyze legal protection for contract workers in Batu Bara Regency. The findings indicate that the Batu Bara Regency Manpower Office has made maximum efforts to provide legal protection and uphold the rights of contract workers through non-litigation mechanisms. Data shows an increase in the minimum wage in North Sumatra, from IDR 2,809,915 (2024) to IDR 2,992,559 (2025), and in Batu Bara Regency from IDR 3,451,671 to IDR 3,676,000. Among 17 companies in Batu Bara Regency, there are 2,031 contract workers, with 63 cases of labor rights disputes and employment termination between 2019 and 2023 that have been resolved through mediation or negotiation. The challenges in the field indicate that, in practice, the protection of wage rights for contract workers in Batu Bara Regency has been implemented by the Manpower Office in accordance with national, provincial, and regency-level policies to ensure a decent livelihood for contract workers through supervision, preventive, and repressive measures. However, the neglect of workers' rights by certain companies remains a critical issue in guaranteeing contract workers' legal protection.
