Abstract

Problems often arise, namely related to the scope of legal protection to the Creator for his creation. This is something that most members of the public do not understand, especially song and/or music users. Many song users do not realize that what they are doing is a violation of Copyright, both for their economic rights or the moral rights of the Creators. On March 30, 2021, President Joko Widodo finally stipulates Government Regulation (PP) Number 56 of 2021 concerning Management of Song and/or Music Copyright Royalties, which is the mandate of Article 35 paragraph (3) of Law Number 28 of 2014 concerning Copyright. Apart from the problem of delays, the issuance of this PP on the Management of Song and Music Royalties has brought a breath of fresh air to songwriters in Indonesia. This is because the legal basis for collecting and distributing royalties is now stronger. Keywords: Copyright, Music, Royalties, Songs. Abstract Permasalahan sering muncul yaitu terkait ruang lingkup perlindungan hukum kepada Pencipta atas ciptaannya. Hal inilah yang belum bisa dimengerti oleh kebanyakan anggota masyarakat, terutama para pengguna lagu dan/atau musik. Banyak pengguna lagu yang tidak menyadari, bahwa apa yang dilakukannya merupakan sebuah pelanggaran terhadap Hak Cipta, baik atas hak ekonominya ataupun hak moral dari para Pencipta. Pada 30 Maret 2021, akhirnya Presiden Joko Widodo menetapkan Peraturan Pemerintah (PP) Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik yang merupakan amanat Pasal 35 ayat (3) dari UU Nomor 28 Tahun 2014 tentang Hak Cipta. Di luar masalah keterlambatan, terbitnya PP Pengelolaan Royalti Lagu dan Musik ini membawa angin segar bagi para pencipta lagu di Indonesia. Sebab, kini dasar hukum pemungutan dan pembagian royalti jadi lebih kuat. Kata Kunci : Hak Cipta, Lagu, Musik, Royalti.

Abstract

The COVID-19 pandemic, which began in Wuhan, China, in late 2019, has had global repercussions, including in Indonesia, particularly in the immigration sector. The policy of Large-Scale Social Restrictions (PSBB), deemed ineffective, prompted the Indonesian Government to introduce the Enforcement of Restrictions on Community Activities (PPKM) as an alternative in combating the spread of the virus. This article explores the legal politics of immigration during the emergency PPKM period of the COVID-19 pandemic in Indonesia using a normative juridical approach and literature research. Although PPKM is not explicitly regulated, it poses legal-political challenges and requires adaptation in the immigration legal system. The article also discusses the development of immigration law substance from Law No. 9/1992 to Law No. 6/2011, as well as the political-legal implications regarding the restriction of foreigners in Indonesia during PPKM. The need for legal consistency and policy adjustment in responding to pandemic challenges, as well as legal-political options that the government can take to strengthen the legal basis of PPKM and respond to changes in the immigration system, is also highlighted. Some recommended steps include changes to the Law, issuing Government Regulation in Lieu of Law (Perpu), and enhancing the role of Regional Governments in regulating PPKM in accordance with their authority.

Abstract

Penelitian ini mengkaji pengaruh media sosial terhadap keterlibatan politik Generasi Z dalam Pemilihan Gubernur Sumatera Utara 2024. Dengan pendekatan mix method (kuantitatif dan kualitatif) dan FGD dengan 10 peserta dari 5 universitas di Medan, ditemukan bahwa minat politik Gen Z cukup tinggi meskipun keterlibatan aktif masih perlu ditingkatkan. Media sosial berperan utama dalam membentuk pandangan politik mereka secara positif dan negatif, sehingga diperlukan ruang klarifikasi informasi dari KPU serta peningkatan literasi politik melalui kolaborasi antara KPU, lembaga pendidikan, dan media sosial.

Abstract

Artikel ini menganalisis Danantara sebagai model baru pengelolaan investasi negara dalam perspektif hukum korporasi, dengan menyoroti aspek normatif, celah pengawasan, dan potensi moral hazard yang muncul dari desain hukumnya dalam UU BUMN terbaru. Melalui pendekatan yuridis normatif dan preskriptif-analitis, kajian ini menemukan bahwa meskipun Danantara sebagai superholding investasi mencerminkan prinsip hukum korporasi modern, terdapat kekosongan pengaturan yang berisiko melemahkan prinsip Good Corporate Governance (GCG). Sehingga, harmonisasi regulasi, penguatan pengawasan independen, dan kejelasan pertanggungjawaban organ perusahaan adalah agenda mendesak agar fleksibilitas hukum Danantara tidak berkembang menjadi kebebasan tanpa akuntabilitas.
