Abstract

Sistem peradilan pidana harus mencerminkan nilai keadilan dalam menghukum mereka yang melakukan kekerasan seksual. Dalam hal ini, tersangka melakukan tindak kekerasan sebagai pendidik yaitu. memaksa anak untuk berhubungan seks dengannya. Putusan hakim menemukan bahwa terdakwa terbukti melakukan kekerasan seksual berdasarkan pasal 81 pasal 1, 3 dan 5. Pasal 76D UU No 17 Tahun 2016 tentang Perubahan UU Perlindungan Anak No 23 Tahun 2002 sudah. Pasal 65 (1) KUHP. Rumusan masalah adalah: Bagaimana hubungan pemidanaan pelaku kekerasan seksual dalam sistem pidana dengan Putusan No. 989/Pid.Sus/2021/PN.Bdg? Penelitian ini merupakan penelitian normatif dimana fokus penelitiannya adalah pada data sekunder, sehingga terlihat pertimbangan hakim dalam putusannya. Hasil kajian menunjukkan bahwa pemidanaan terhadap pelaku kekerasan seksual yang utamanya berupa hukuman mati dan hukuman lain seperti denda, restitusi, dan lain-lain, tidak melanggar hak asasi manusia menurut UUD Negara Republik Indonesia Tahun 1945. Pasal 28J(2) dan Pasal 28I(1), sehingga hak tersebut tidak mutlak (hak yang dapat dibatalkan). Hukuman terhadap pelaku harus ditegakkan, meski belum memberikan efek jera dan menyeluruh.Untuk mencegah terjadinya tindak pidana, sedangkan biaya kebiri kimia dan ganti rugi dibebankan kepada terdakwa yang melanggar Pasal 67 KUHP. Sinkronisasi antar subsistem peradilan pidana, khususnya pengadilan, yang didukung oleh kelembagaan yang memadai, diperlukan agar pemidanaan mencerminkan nilai keadilan, sesuai dengan ajaran hukum dan moral, untuk kepentingan pelaku, korban, dan masyarakat.

Abstract

Legal protection for children who are victims of sexual crimes is an essential aspect of the criminal justice system. This research examines the concept of legal protection for child victims of sexual crimes in Indonesia, focusing on both positive and progressive legal aspects. The study aims to understand the implementation of legal protection concepts for child victims of sexual crimes within the framework of positive law, as well as to explore the impact and effectiveness of progressive law in the same context. The research methodology adopts a descriptive normative approach, utilizing both primary and secondary legal sources. Normative analysis involves identifying relevant laws and regulations, such as Law No. 13 of 2006 on Witness and Victim Protection, Law No. 11 of 2012 on Juvenile Justice System, and Law No. 12 of 2022 on Sexual Violence Crimes. Data analysis employs qualitative methods, combining literature review and field research. The findings of this research affirm that despite existing laws governing legal protection for child victims of sexual crimes, implementation remains suboptimal, with various challenges yet to be addressed. Further steps are necessary to raise awareness, strengthen law enforcement, and ensure that the rights of child victims are upheld in accordance with principles of justice and human rights.

Abstract

Cigarette consumption among teenagers has become a trend in itself, causing them to forget about health. This problem in the regulations for controlling addictive substances in tobacco products as contained in Government Regulation (PP) Number 28 of 2024 concerning Implementing Regulations of Law Number 17 of 2023 concerning Health is in the public spotlight. In particular, regulations regarding retail cigarette sales, restrictions on cigarette advertising, and health warnings on cigarette packaging have been regulated in accordance with the norms of Article 434 paragraph (1). In this PKM activity, carrying out cigarette consumption literacy among teenagers in Langsa City aims to increase teenagers' knowledge about the dangers of consuming cigarettes and regulations regarding the prohibition of consuming cigarettes for teenagers in Langsa City, as well as encouraging teenagers to protect their health from the dangers of consuming cigarettes. In this way, teenagers in Langsa City are expected to be aware of the importance of maintaining health and regulating cigarette consumption for teenagers in Langsa City.

Abstract

Abstract The rampant phenomenon in Indonesia of sexual harassment, particularly breast groping, has become a serious problem in Langsa City and threatens the safety and comfort of the community. This not only causes victims to feel fear and trauma, but also makes them feel that their dignity and integrity have been violated. This study aims to examine the efforts of the Langsa Police in preventing and handling this crime. The method used is empirical jurisprudence to collect data through interviews and analysis of official documents. The results show that the police have taken various preventive measures, such as routine patrols and legal counseling through the Community Police (Bhabinkamtibmas) in Gampong-Gampong. However, major challenges remain, particularly regarding the public's reluctance to report incidents. Data shows that there are more cases of sexual abuse that go unreported, indicating that current laws are insufficient to protect victims and that efforts to date have not been enough to convince victims to come forward. The importance of this study lies in the need for advice to the police on how to deal with crimes of sexual abuse. This research is expected to provide useful insights to strengthen future prevention and legal handling efforts, considering issues such as social stigma and lack of legal knowledge among the public. Abstract

The potential for carbon trading through a blue economy approach in the coastal areas of East Aceh Regency using descriptive qualitative methods through literature studies. The results of the study identified significant blue carbon potential from mangrove ecosystems, which function as effective carbon sinks. However, critical findings revealed that 49.85% of the mangrove area is in a state of severe degradation, not only threatening its ecological function but also potentially releasing stored carbon reserves. The development of a comprehensive and contextual literacy strategy is an important prerequisite for realizing the potential of carbon trading. Integrating the blue economy approach with mangrove conservation programs through a carbon trading mechanism can create synergy between environmental preservation and improving the welfare of coastal communities in East Aceh.
