Abstract

The threat of capital punishment is seen as an appropriate type of crime threatened against narcotics offenders with the qualifications of producers and dealers, because narcotics is a serious crime and the nature of the offenders who have a network to produce and circulate narcotics for business or economic purposes only so that their actions can cause great danger or have a profound effect on human life and national life in the political, economic, social, cultural and national defense sectors. In the end the deterrent effect with a very severe sentence, including the threat of capital punishment, became the target to achieve the goal of enacting Law Number 35 Year 2009 on Narcotics in addition to providing narcotics for health needs and scientific development, also intended to reduce the quantity of perpetrators of abuse and circulation dark narcotics. Although it is realized that with the enactment of this law, the number of drug abuse and distribution by the perpetrators does not deter and can educate producers and distributors of the sentences not proportional to their actions compared to the consequences suffered by victims. In other words, the target of the regulation of death penalty in this law is not only for death row inmates, but also for potential perpetrators who have not yet been sentenced to death. Therefore, the threat of capital punishment aims to suppress the high crime rate, which in the end the community becomes orderly, peaceful and safe. Keywords: narcotics, capital punishment, punishment

Abstract

This study aims to (1) identify and analyze how positivism theory represents the value of justice and legal certainty, and (2) know and analyze how legal theory prevails in Indonesia. This type of research is normative legal research. The data obtained from this research is secondary data obtained through library research, then the data obtained is analyzed juridically qualitatively through a statutory and conceptual approach. The results of this study indicate that (1) In legal positivism, the entire statutory regulation is essentially something that contains the law completely so that the next task of the judge is to apply the provisions of the law mechanically in solving problems in society, in accordance with (2) The conception of the theory of development law is adequate law and does not view law as a set of rules and principles governing human life, but also includes institutional institutions and processes needed to realize the law. become reality. Meanwhile, the Pancasila Legal Theory is a legal theory which is based on the values of Pancasila as the ontological, epistemological and axiological basis based on the principles of Pancasila law.

Abstract

The basic idea of ​​using the threat of capital punishment against perpetrators of "producers and dealers" regulated by Law Number 35 of 2009 concerning Narcotics as a policy to combat narcotics crime is based on several reasons, including: First, narcotics crimes committed by perpetrators of "producers and distributors "Organized and systematic patterns, because they are carried out with a very sophisticated modus operandi and have networks to circulate and trade for purely economic interests, so it is not easy to uncover and prove it. Second, the circulation and abuse of illicit drug trafficking by perpetrators of "producers and distributors" is a threat that sooner or later gives a serious impact because it destroys young generation, destroys the nation and the state that is not less powerful than criminal acts of terrorism and corruption, due to the fact that arising from narcotics abuse has caused victims of HIV / AIDS and hepatitis, even death among the very young generation. So that the Government of the Republic of Indonesia is of the view that the actions of the perpetrators of "producers and distributors" in producing and distributing narcotics are crimes against humanity, because their actions can destroy humanity slowly but surely.

Abstract

Indonesia sebagai negara kesatuan, merupakan negara kepulauan, yang mempunyai kekayaan sumberdaya alam dan jasa lingkungan yang terkandung di dalamnya, dapat dipahami sebagai potensi nasional yang harus ditata dan dikelola secara baik. Selain itu Indonesia juga memiliki pulau-pulau terluar yang sekaligus merupakan garda terdepan dalam keamanan dan ketahanan negara. Meskipun demikian harus disadari bahwa penataan dan pengelolaan pulau-pulau terluar di Indonesia belum dilakukan secara optimal, tak terkecuali di Provinsi Maluku Utara. Hal ini terkonfirmmasi melalui pulau sipadan dan ligitan harus lepas dari yurisdiksi Indonesia, di Maluku Utara, maraknya pencurian ikan di perairan Maluku Utara setidaknya menjelaskan bahwa pengamanan pada pulau-pulau terluar melalui kebijakan ditingkat daerah belum optimal dilakukan oleh pemeritah Provinsi Maluku Utara. Oleh karena itu pulau-pulau terluar sebagai fungsi pertahanan berperan sebagai pintu gerbang dalam menjaga keutuhan Negara Kesatuan Republik Indonesia, melalui pengawasan sehingga pulau-pulau terluar terjaga dan terawasi, sehingga ketahanan nasional terlindungi dari berbagai ancaman.. Selain itu fungsi ekonomi, yang berbasis pada sumber daya yang merupakan ekosistem penting bagi penyediaan pariwisata maupun sumber daya poerikanan dapat ditata dan dikelola dengan agar meningkatkan kesejahteraan masyarakat di pulau-pulau terluar, ini semua dapat terwujud jika ada kebijakan nasional maupun lokal di tingkat Provinsi. Metode pendekatan yang digunakan dalam penelitian dengan melakukan kajian pada prinsip hukumm peraturan perundangan perlindungan pulau-pulau terluar undang-undang terkait lainnya sehingga dapat dijadikan dasar dalam merumuskan kebijakan di tingkat daerah dalam rangkat memberikan perlindungan yang lebih optimal dalam penataan dan pengelolaan pulau-pulau terluar.

Abstract

The application of regional regulations in the field of Regional Taxes and Retribution in Ternate City has not yet been submitted to the Court with criminal convictions, but it is realized that the regional regulation enforcement officers have not fulfilled the tax obligations. Even so, violations of the Tax and Retribution Regional Regulations on administrative law sanctions are chosen to be enforced rather than criminal sanctions because administrative legal sanctions are more effective in their enforcement. Therefore, the formation of regional regulations on taxes and levies does not only pay attention to aspects of legal substance, but also aspects of structure and cultural aspects, in the form of the availability of regional law enforcement officers which in turn result in enforcement of regional regulations on taxes and levies so that criminal sanctions can be utilized to increase original income. Abstract

Undang-Undang No. 9 Tahun 1976 tentang Narkotika ini merupakan pengganti dari Undang-Undang tentang Obat Bius warisan pemerintah kolonial Belanda, yaitu Verdoovende Middelen Ordonnantie 1927 (Stbl.1927 No. 278 jo No. 536) tanggal 12 Mei 1927. Ordonansi ini terdiri dari 29 pasal yang pada dasarnya telah cukup banyak mengatur masalah penggunaan dan peredaran narkotika. Ordonansi ini mengatur mengenai bagaimana ekspor dan impor narkotika dapat dilakukan. Selain itu ordonansi ini juga telah memberikan larangan-larangan terhadap penggunaan beberapa jenis narkotika. Dalam hal terjadi pelanggaran, ordonansi ini juga telah dilengkapi dengan aturan pidana. Sebagai upaya untuk melindungi masyarakat dari bahaya penyalahgunaan narkotika mencegah serta memberantas peredaran gelap narkotika, maka dalam undang-undang ini diatur juga mengenai prekursor narkotika, karena prekursor narkotika merupakan zat atau bahan pemula atau bahan kimia yang dapat digunakan dalam pembuatan narkotika. Selain itu diatur pula mengenai sanksi pidana bagi penyalahgunaan prekursor narkotika untuk pembuatan narkotika. Dalam rangka menimbulkan efek jera terhadap pelaku penyalahgunaan dan peredaran gelap narkotika maupun precursor narkotika, dalam undang-undang ini juga mengatur mengenai pemberatan sanksi pidana, baik dalam bentuk pidana minimum khusus, pidana penjara 20 (dua puluh) tahun, pidana penjara seumur hidup, maupun pidana mati. Adapun pemberatan pidana tersebut dilakukan dengan mendasarkan pada golongan, jenis, ukuran, dan jumlah Narkotika.

Abstract

This research aims to analyze the optimization and effectiveness of imposing additional fines as a substitute for imprisonment in relation to the execution of judgments in North Maluku in 2021, specifically focusing on corruption offenses that harm the state finances. The study employs an empirical legal research approach, utilizing empirical data obtained from interviews and direct observations of human behavior. Three approaches are utilized in this research: legal, conceptual, and case-based approaches. The research findings indicate that the imposition of additional fines as a substitute for imprisonment in corruption cases that harm state finances is still not optimal. Out of the seven cases examined, only two cases resulted in the restitution of the state's financial losses. Furthermore, the research highlights the failure to achieve legal effectiveness due to the insufficient restitution of state financial losses resulting from the availability of the alternative option of imprisonment as a substitute for the additional fines.

Abstract

This study aims to analyze the effectiveness of prosecutors at the Kepulauan Morotai District Attorney's Office as investigators and public prosecutors in handling corruption cases, as well as to identify the challenges faced during the process. The research employs a normative juridical-empirical method with a sociological law approach, combining secondary data from legal regulations with primary data from field observations. The findings indicate that the Kepulauan Morotai District Attorney's Office has effectively carried out its duties and authorities, as evidenced by its achievements in handling corruption cases from 2020 to 2022. However, several juridical and non-juridical obstacles hinder the resolution of cases. The study implies that further efforts are needed to address these challenges in order to enhance the performance of the District Attorney's Office in the future.

Abstract

Human Rights are inherent to every individual, yet there are circumstances and time frames where these rights may be restricted or revoked by the state in accordance with applicable rules. One such circumstance is being incarcerated or imprisoned because of unlawful acts committed by individuals. The research aims to identify the impact of overcrowded prison conditions on the fulfillment of rights for detainees and inmates within the Class IIB State Detention Center in Ternate. Additionally, it seeks to analyze the legal implications of overcrowded conditions on the satisfaction of these rights. The findings indicate that overcrowding adversely affects the fulfillment of basic needs for detainees and inmates, including physical and spiritual care, health services, and provision of adequate food. Legal implications concerning the handling of overcrowded conditions in Ternate Detention Center, as mandated by the Ministry of Law and Human Rights of the Republic of Indonesia through Regulation No. 11 of 2017, have not effectively addressed the challenges posed by overcrowded conditions. Limitations in human resources, insufficient living space, inadequate infrastructure, and budget constraints in Ternate Detention Center hinder the optimization of meeting the rights of Persons Deprived of Liberty (WBP).

Abstract

This study aims to analyze the implementation of the Prosecutorial Intelligence's authority in investigating alleged corruption at the Tidore Kepulauan District Attorney's Office and to identify the challenges encountered during the investigation process. The methodology employed is empirical legal research with a qualitative field approach. Data were collected through in-depth interviews and documentation studies. The research findings indicate that the implementation of the Prosecutorial Intelligence's authority at the Tidore Kepulauan District Attorney's Office aligns with the applicable regulations, including Article 30B paragraph (d) of Law No. 11 of 2021 on the Amendment of Law No. 16 of 2004 on the Prosecutor's Office of the Republic of Indonesia and Presidential Regulation No. 38 of 2010 on the Organization and Working Procedures of the Prosecutor's Office of the Republic of Indonesia. Nonetheless, several significant challenges were identified in the investigation process, including budget constraints, insufficient education and training for staff, and inadequate facilities and infrastructure. This study provides recommendations to address these challenges, including increasing budget allocations, conducting regular training for Prosecutorial Intelligence staff, and providing adequate supporting facilities to enhance the effectiveness of corruption investigations.
