Abstract

The application of regional regulations in the field of Regional Taxes and Retribution in Ternate City has not yet been submitted to the Court with criminal convictions, but it is realized that the regional regulation enforcement officers have not fulfilled the tax obligations. Even so, violations of the Tax and Retribution Regional Regulations on administrative law sanctions are chosen to be enforced rather than criminal sanctions because administrative legal sanctions are more effective in their enforcement. Therefore, the formation of regional regulations on taxes and levies does not only pay attention to aspects of legal substance, but also aspects of structure and cultural aspects, in the form of the availability of regional law enforcement officers which in turn result in enforcement of regional regulations on taxes and levies so that criminal sanctions can be utilized to increase original income. Abstract

Restorative Justice is a new approach emphasizing dialogue and peace in crime resolution, prioritizing addressing the core issues between individuals. In cases of assault, which involve unlawful acts causing harm or injury, Restorative Justice is typically applied to minor cases. However, Police Regulation Number 8 of 2021 expands Restorative Justice to encompass both minor and severe assault cases, as implemented in North Halmahera Police Resort. This empirical research collects primary and secondary data through field studies and literature reviews, employing qualitative analysis. Findings highlight the urgency of police implementation of Restorative Justice in assault cases to achieve substantial and balanced justice. Implementation has occurred in North Halmahera Police Resort in accordance with Police Regulation Number 8 of 2021, yet faces challenges such as socialization, cultural adaptation, and coordination between victims and perpetrators. Future law enforcement policies based on Restorative Justice must adapt to existing challenges, including wider socialization and cultural adaptation. Understanding the importance of victims' and perpetrators' presence in the Restorative Justice process also requires enhancement.

Abstract

Diversion as an alternative to out-of-court settlement faced both theoretical and practical challenges. In the context of traffic offenses committed by minors, the practice of diversion encountered legal uncertainties about whether it could effectively address the core issues. The dilemma arose from the need to enforce the law while also protecting the rights of children as mandated by the Juvenile Justice System Law. This paper reviewed the practice of diversion in resolving traffic offenses by minors in North Maluku, aiming to assess its effectiveness and explore its role as a tool of social engineering. The research employed a doctrinal legal research model with a juridical-normative approach. Findings indicated that diversion practices in North Maluku, particularly for traffic offenses committed by minors, were ineffective due to several factors: regulatory deficiencies, lack of competence among enforcement personnel, and the prevailing legal paradigm within the community. From the perspective of law as a tool of social engineering, diversion alone was insufficient without subsequent measures to address traffic crimes committed by minors, necessitating the reconstruction of the legal culture and enhancement of public awareness to foster traffic order and safety.

Abstract

Penetapan anak sebagai tersangka dalam tindak pidana perzinahan menimbulkan persoalan yuridis yang kompleks, terutama ketika anak tersebut secara bersamaan telah ditetapkan sebagai korban dalam perkara persetubuhan. Kasus ini mencerminkan adanya potensi tumpang tindih antara hukum pidana umum dan perlindungan hukum terhadap anak. Penelitian ini bertujuan untuk mengkaji kepastian hukum dalam proses penetapan tersebut serta kesesuaiannya dengan prinsip perlindungan anak. Metode yang digunakan adalah yuridis normatif dengan pendekatan kualitatif terhadap peraturan perundang-undangan dan analisis putusan hukum terkait. Hasil penelitian menunjukkan bahwa penetapan anak sebagai tersangka tidak sejalan dengan prinsip perlindungan anak dan asas kepastian hukum. Penggunaan Pasal 284 KUHP dalam kasus ini dipandang tidak tepat apabila telah ada penetapan anak sebagai korban. Pendekatan hukum yang berorientasi pada Undang-Undang Perlindungan Anak lebih mencerminkan keadilan restoratif dan empati terhadap kondisi korban. Penemuan ini menegaskan perlunya peningkatan sensitivitas aparat penegak hukum terhadap status dan posisi anak dalam sistem peradilan pidana. Selain itu, dibutuhkan pedoman teknis yang lebih eksplisit agar aparat tidak terjebak pada penafsiran hukum yang merugikan korban.

Abstract

The title of this research is “Law Enforcement Against Violation of Overstaying Perpetrated by Foreigners: A Study in Class I Immigration Office of Ternate.” The object of this study is the law enforcement carried out against violations of residence permits by foreign. The objective is to analyze the law enforcement carried out against violations of residence permits by foreigners (overstay) in the working area of the Class I Ternate Immigration Office? This paper employed the juridical-empirical approach. This was qualitative field research because the primary data was collected directly from respondents through interviews and documentation. Results show that law enforcement against violations of residence permits by foreigners in the working area of the Class I Immigration Checkpoint of the Ternate Immigration Office has basically been implemented in accordance with the provisions stipulated in Law Number 6 of 2011 concerning Immigration, especially Article 75 and Article 78. The enforcement is more dominantly administrative in nature through the implementation of immigration administrative actions, such as deportation and deterrence, which are considered as a form of fast and efficient non-litigative action. From 2021 to mid-2025, 58 administrative actions were recorded, with the highest number of deportations occurring in 2023.

Abstract

This research examines the Quality of Evidence for the Crime of Theft in Decision Number 81/PID.B/2020/PN Tob.This research uses doctrinal legal research methods with statutory and conceptual approaches. The results showed that Decision Number 81/PID.B/2020/PN Tob which acquitted the defendant Hendri Novita alias Hendrik from the charge of theft showed that the quality of evidence submitted by the Public Prosecutor (JPU) did not meet the standard of proof as stipulated in Article 183 in this case, the testimony of witnesses could not prove that the defendant directly took or placed ore stones belonging to PT NHM into the car he was driving. although the element of the subject of law (the element of "who") has been fulfilled because the defendant was legally presented and his identity was recognized, the element of material action was not proven. Therefore, the entire juridical construction of the indictment collapsed because one of the elements of the offense was not proven legally and convincingly. Therefore, based on legal considerations that are rational, objective, and in accordance with the principles of evidence in the Criminal Procedure Code, the judge acquitted the defendant.
