Abstract

This community service activity was held on Sunday, November 26, 2023, at SOS Children’s Village Meulaboh by the Faculty Team of the Law Department, Universitas Teuku Umar. The purpose was to provide adolescents with an understanding of the importance of moral education in the digital era. The material covered basic moral concepts, the positive and negative impacts of technology on adolescent behavior, and the urgency of digital ethics in daily life. The results showed that most participants had not fully understood the impact of technology on morality, especially regarding cyberbullying, addiction, and the decline of direct social interaction. In fact, moral behavior is essential not only in digital spaces but also as a foundation for healthy relationships in society. On the other hand, technology also provides positive opportunities for accessing information, self-expression, and expanding social connections. Therefore, contextual moral education is key to shaping digitally literate, ethical, and socially responsible youth. This activity is expected to be a starting point for raising awareness and encouraging adolescents to apply moral values in their daily lives, both online and offline. Thus, the younger generation can grow into individuals who are morally grounded and digitally competent.

Abstract

Mediasi di pengadilan negeri merupakan salah satu alternatif penyelesaian sengketa yang bertujuan untuk mengurangi beban pengadilan, mempercepat proses penyelesaian perkara serta menghasilkan solusi yang lebih memuaskan bagi kedua belah pihak seperti yang diatur dalam PERMA Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Namun, tingkat keberhasilan mediasi yang dilakukan di Pengadilan Negeri Suka Makmue masih rendah. Penelitian ini bertujuan untuk mengetahui efektifitas penyelesaian sengketa melalui mediasi terhadap perkara perdata di Pengadilan Negeri Suka Makmue dan untuk mengetahui faktor penyebab kegagalan mediasi dalam penyelesaian sengketa terhadap perkara perdata di Pengadilan Negeri Suka Makmue. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris yang bersifat deskriptif dengan pendekatan kualitatif, dengan menggunakan data primer melalui wawancara dengan Sekretaris Pengadilan Negeri Suka Makmue, hakim mediator dan para pihak yang terlibat dalam mediasi di Pengadilan Negeri Suka Makmue. Data sekunder didapatkan melalui penelitian kepustakaan. Hasil penelitian menunjukkan bahwa penyelesaian sengketa terhadap perkara perdata melalui mediasi di Pengadilan Negeri Suka Makmue belum efektif, ditunjukkan dengan tingkat keberhasilan mediasi belum maksimal, hanya 5 perkara yang berhasil didamaikan melalui proses mediasi dari 28 perkara perdata yang ditangani Pengadilan Negeri Suka Makmue atau hanya mencapai 17,85% dalam 3 tahun terakhir. Faktor penyebab kegagalan mediasi dalam penyelesaian sengketa terhadap perkara perdata di Pengadilan Negeri Suka Makmue disebabkan oleh ego para pihak, kurangnya pemahaman mediasi dari para pihak, kurangnya jumlah mediator baik yang berasal dari hakim maupun non hakim, dan peran pengacara yang mempengaruhi keberhasilan mediasi. Diharapkan kepada Pengadilan Negeri Suka Makmue melakukan evaluasi berkala terhadap proses mediasi, menyediakan pelatihan untuk meningkatkan keterampilan mediator, melakukan sosialisasi kepada masyarakat terkait mediasi baik secara internal maupun eksternal.

Abstract

Article 4 of Law of the Republic of Indonesia Number 33 of 2014 concerning Halal Product Guarantee states that "Products that enter, circulate, and are traded in the territory of Indonesia must obtain a halal certificate". However, in reality in the field there are still many products circulating in the territory of Indonesia that do not have halal certificates and do not apply these rules, especially in Drinking Water Depots in Meurebo District, West Aceh. The purpose of this study is, to determine the responsibility of Drinking Water Refill Depot business actors for the obligation of halal certificates in Meureubo District, West Aceh Regency. To find out the obstacles faced by Drinking Water Refill Depot business actors in carrying out halal certificate obligations. This research uses empirical juridical research methods, which is one type of legal research that analyzes and examines the operation of law in society. The results showed that drinking water refill depot business actors have not been responsible for the halalness of the products produced, because they do not yet have a halal certificate, the business actors believe that the water produced is halal because it has been laboratory tested by the West Aceh Health Office. Obstacles for drinking water refill depot business actors in carrying out halal certificate obligations are the lack of legal awareness of the community, and the lack of public knowledge. Consumers do not get protection in consuming refill drinking water, because business actors do not carry out obligations for halal certificates.

Abstract

In Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction, in this case, it does not pay attention to the rights of indigenous peoples who have obtained customary rights or rights to control forests for generations. In Nagari Koto Malintang, they have local wisdom that they have practiced for years, such as felling 2 trees for basic needs and not for commercial purposes through permission from local traditional leaders and the Wali Nagari Koto Malintang.This research is a normative juridical research using a case approach and a statute approach, in this research the analysis is carried out by criticizing, supporting, or commenting, then making a conclusion on the results of the study with their own thoughts. and literature review assistance.The application of material punishment in decision number 129/Pid. B/LH/2017/PN.LBB, According to the author, it is not appropriate and does not meet the elements charged by the public prosecutor, but in the judge's consideration of the aggravating circumstances, the panel of judges did not reflect a sense of justice towards the defendants and the values of local wisdom who have lived and run in the community for many years. The judge's consideration in this case also contradicts the theory of criminal responsibility in which the defendants can be given excuses for forgiveness and the ultimum theory remediates that punishment is the last step.Law Enforcement Officials should be wiser in eradicating the crime of logging trees on customary lands of customary law communities and must pay attention to the values that live in local communities such as local wisdom that they have practiced for years.
