Abstract

Kemajuan merupakan suatu kewajiban untuk semua ranah kehidupan tanpa terkecuali. Hukum yang tak bisa dilepaskan dari adanya penjaminan HAM merupakan prinsip utama dalam kehidupan berbangsa. Dewasa kini Indonesia mendapatkan tugas untuk bisa memajukan semua sektor yang ada di dalamnya tanpa terkecuali HAM dan hukum. Catatan kemunduran hukum dan HAM di Indonesia menjadikan satu persoalan yang harus segera dibenahi. Pelanggaran HAM yang semakin tahun terus ada, panggung demokrasi yang semakin sempit dengan banyaknya penjeratan dengan UU ITE, serta masih adanya praktik hukuman mati yang terus dikecam aktivis HAM, Jelas sederet catatan tersebut menjadi tugas besar bagi negara. Adanya COVID-19 yang yang menjadi momentum untuk Indonesia bisa mengkaji ulang praktik hak untuk bunuh diri atau Euthanasia dengan pertimbangan beban anggaran dan penderitaan yang banyak pada pasien COVID-19 atau penyakit kronis lainnya. Peninjauan Kembali pada konsep ini memberikan peluang untuk mendekatkan pada supremasi HAM dan progresivitas hukum, terlepas dari adanya dogmatik agama, tinjauan ini bertujuan sebagai refleksi ilmu pengetahuan. Metode penelitian yang digunakan yaitu yuridis normatif, dengan beberapa pendekatan yaitu: pendekatan perundang-undangan, pendekatan konseptual, pendekatan historis, pendekatan kasus, dan pendekatan perbandingan, dengan menggunakan tiga bahan hukum yaitu: primer, sekunder, dan bahan non hukum. Dalam analisis implementasi dari konsep euthanasia berpeluang besar menciptakan supremasi HAM dan progresifitas hukum dengan beberapa catatan. Kesimpulan, ditemukan korelasi kuat antara implementasi konsep euthanasia pada terciptanya supremasi HAM dan progresivitas hukum. Saran, untuk meninjau ulang konsep euthanasia pada hukum di Indonesia dan memberikan klasifikasi khusus yang tegas terkait penerapannya sehingga tidak adanya bentrokan antar norma, agama dan HAM.

Abstract

The current increase in the earth's temperature and significant climate change have a negative impact on the sustainability of all living things. Indonesia is one of the countries that is committed to suppressing greenhouse gas production through a carbon tax policy regulated in the Law on Harmonization of Tax Regulations as a net zero emission instrument. However, until now, this carbon tax policy has not been realized by the government because it is hindered by several factors, such as unclear plans for implementing carbon tax implementation and determining effective tax rates due to limited resources and inadequate capacity. This study aims to examine the concepts and challenges of implementing a carbon tax as a net zero emission instrument after the enactment of the Tax Harmonization Law in Indonesia. The research method used is normative-juridical, with a statutory approach and a conceptual approach using secondary data obtained through library research. Based on research results, the implementation of a carbon tax in the national tax agency is considered very important and must be carried out immediately to restore environmental damage due to carbon dioxide emissions, which have been agreed to be reduced by 29% in 2030 and achieve net zero emissions in 2060. Therefore, the government needs to immediately finalize derivative regulations regarding the carbon tax mechanism and other accompanying policies so that every carbon produced can be taxed to increase national tax efficiency.

Abstract

This study examines the execution auction in bankruptcy concerning land and buildings jointly owned by a third party and a bankrupt debtor. The importance of this study lies in protecting the property rights of third parties, which may be at risk during the auction process. There is a research gap in understanding the legal rights of third parties in joint ownership situations with a bankrupt debtor. The objective of this study is to identify the legal implications and protection mechanisms available to third parties. The methodology employed is a normative juridical analysis with a case study approach. The key findings reveal that third parties retain the right to file a lawsuit against the auction as an unlawful act (tort), but their claim of ownership is insufficient to nullify the auction conducted by the Office of State Wealth Service and Auction. This research implies a need for clearer regulations to protect third-party rights in similar cases.

Abstract

Kehadiran telemedicine membawa manfaat untuk memberikan pelayanan kesehatan secara luas bagi masyarakat dengan memanfaatkan teknologi informasi. Perwujudan telemedicine merupakan upaya pemerintah dalam mensejahterakan masyarakat di bidang kesehatan pada era society 5.0. Awalnya perkembangan telemedicine masih menggunakan teknologi telepon standar. Memasuki era milenium, teknologi kesehatan di Indonesia terlihat semakin berkembang dengan munculnya rekam medis dan peresepan elektronik yang dapat dilakukan melalui suatu aplikasi tanpa harus bertemu secara tatap muka (face to face) antara pasien dan tenaga medis. Penelitian dilakukan dengan metode yuridis normatif, yakni dengan meneliti data sekunder. Hasil penelitian menggambarkan bahwa kepastian hukum pelaksanaan layanan telemedicine telah terjamin legalitasnya sebagaimana termuat dalam Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 tentang Penyelenggaraan Pelayanan Telemedicine Antar Fasilitas Pelayanan Kesehatan, hal tersebut membuktikan bahwa pemerintah sadar kesehatan menjadi tujuan penting dalam mewujudkan kesejahteraan masyarakat, sehingga diharuskan bagi negara untuk meningkatkan derajat kesehatan melalui pengembangan pelayanan fasilitas kesehatan. Pengembangan tersebut dapat terlihat dari inovasi telemedicine yang pada implementasinya bertujuan untuk memperluas aksesibilitas pelayanan kesehatan masyarakat. Layanan telemedicine antara Australia dengan Indonesia terdapat perbedaan yang kontras dari pendistribusian pelayanan hingga peraturan hukum. Berbeda dengan Indonesia, pelayanan Telemedicine di Australia bergantung pada panduan telehealth bukan peraturan pemerintah atau lembaga kedokteran.

Abstract

This study examines several problems that arise in the establishment of BPI Danantara, such as the urgency of establishing BPI Danantara, the objectives of Danantara's legal policy, and the the strengths and weaknesses of establishing BPI Danantara. The writing method used in this writing is normative legal analysis. The study finds that the establishment of BPI Danantara is urgently needed to accelerate economic growth, eradicate extreme poverty, and fund downstream programs, yet its success hinges on upholding good governance, transparency, professional management, and the development of clear implementing regulations for investment management. The novelty lies in the proposed establishment of BPI Danantara as a strategic entity to address critical national economic goals, specifically through direct capital injection into downstream programs, a function previously reliant on foreign investment.

Abstract

This research aims to examine the implementation of government policies and the role of legal politics in preventing and combating the crime of money embezzlement. The research method employed is juridical-normative through literature study using statutory and conceptual approaches, with deductive data analysis. The discussion results indicate that law serves a dual function: preventing through norms and sanctions, and prosecuting perpetrators, with the evidentiary focus on malicious intent and the impact of the actions. Combating money embezzlement requires a combination of penal (repressive law enforcement) and non-penal (preventive measures) approaches. Non-penal efforts encompass environmental improvements, legal education, raising public awareness, and securing potential crime targets. Government criminal policy, as part of broader social policy, is manifested through legal socialization by authorities, case analysis, and coordination among institutions and with community leaders. Although penal measures have shown results, their effectiveness still faces challenges such as slow investigations and sophisticated perpetrator methods, making the integration of non-penal strategies crucial. In conclusion, addressing money embezzlement demands firm and comprehensive law enforcement, synergistically integrating penal and non-penal approaches to achieve optimal prevention and control effectiveness.

Abstract

Reformasi perekonomian Indonesia ditandai oleh pembentukan Danantara sebagai badan pengelola kekayaan negara berbasis sovereign wealth fund. Keberadaan Danantara menunjukkan pergeseran arah politik hukum perekonomian dari paradigma negara kesejahteraan menuju negara pasar yang menekankan efisiensi dan optimalisasi aset. Penelitian ini bertujuan untuk menganalisis arah politik hukum perekonomian Indonesia dan mengkaji peran advokat dalam mengawal reformasi ekonomi melalui pendekatan filsafat hukum dan teori peran advokat. Menggunakan metode yuridis-filosofis dan pendekatan perbandingan, penelitian ini membandingkan Danantara dengan tiga model SWF global: Temasek Holdings (Singapura), Mubadala (UEA), dan Norwegian Government Pension Fund Global (Norwegia). Hasil penelitian menunjukkan bahwa Indonesia masih menghadapi dilema antara kepentingan publik dan dominasi kekuasaan ekonomi elit. Di sisi lain, advokat memiliki peran strategis sebagai pengawal supremasi hukum, partisipasi publik, dan keadilan ekonomi. Penelitian ini menegaskan urgensi reformulasi desain hukum dan pelembagaan partisipatif dalam pengelolaan kekayaan negara untuk memastikan bahwa arah reformasi ekonomi tidak menyimpang dari semangat konstitusi dan keadilan sosial.

Abstract

Air sebagai kebutuhan utama maka air harus dipergunakan sebesar-besarnya untuk kemakmuran rakyat sehingga sumber air seperti sungai perlu dijaga baik secara kualitas maupun kuantitas. Pencemaran di daerah aliran sungai (DAS) terjadi dikarenakan pengaruh kualitas air limbah yang melebihi baku mutu air limbah dan debit air limbah yang dihasilkan dan dapat mempengaruhi daya dukung lingkungan di sekitar sungai. Dengan tercemarnya sungai dapat mengurangi hak atas lingkungan hidup yang baik dan sehat pada masyarakat. Artinya pencemaran air sungai berarti melanggar HAM. Penyebab tercemarnya air sungai yaitu dari aktivitas pembuangan limbah dari industri pabrik rumah tangga atau pabrik besar yang membuang begitu saja limbahnya tanpa mengolah terlebih dahulu. Terkhusus terjadinya pencemaran air sungai di Sungai Bengawan Solo akibat aktivitas industri kain batik di daerah Laweyan. Tercemarnya Sungai Bengawan Solo dikarenakan kurang tegasnya aturan hukum yang mengatur tentang pelanggaran baku mutu air limbah sehingga pencemaran air sungai marak terjadi dan tentunya melanggar HAM atas lingkungan yang bersih dan sehat. Saat ini pasal yang mengatur pelanggaran baku mutu air limbah diatur di dalam Pasal 100 ayat (1) dan (2) UU PPLH dan menerapkan asas ultimum remedium. Untuk menekan peristiwa pencemaran air sungai yang merupakan pelanggaran HAM diperlukan aturan yang tegas dengan menerapkan asas primum remedium. Metode penelitian yang digunakan dalam tulisan ini adalah metode yuridis normatif dengan meneliti data sekunder dengan pendekatan perundang-undangan, pendekatan kasus, pendekatan konseptual, dan pendekatan historis. Untuk itu perlu menerapkan asas primum remedium untuk mencegah pencemaran air sungai sehingga HAM atas lingkungan baik dan sehat serta mendapatkan air bersih dapat ditegakkan.

Abstract

This study critically examines the inadequacies of the current Indonesian Bankruptcy Law, highlighting the conflicting nature of its debtors' insolvency declaration mandate, as stated in Article 2, verse (1). The research explores the philosophical basis of incorporating the principle of business continuity into future bankruptcy regulations to ensure fair, rapid, transparent, and efficient debt resolution for both debtors and creditors. Employing a normative legal research methodology, the paper investigates the inherent values of justice, legal certainty, and interests, along with general and bankruptcy principles. The study posits that the essence of bankruptcy law is not merely to protect creditors but also to ensure the survival and continuity of debtor businesses. The findings reveal that existing bankruptcy procedures, including insolvency examinations and financial report analysis, could be refined to better safeguard debtor businesses. This paper argues that an explicit elaboration of the business continuity principle in bankruptcy legislation could promote balanced legal protection in insolvency proceedings. The implications of this research can guide legislative reforms, ensuring a more equitable and efficient debt resolution process in the Indonesian bankruptcy system.Highlights: The current Indonesian Bankruptcy Law struggles with issues of fairness and efficiency in resolving debt problems. The principle of business continuity should be explicitly incorporated into bankruptcy legislation to ensure balanced protection for both debtors and creditors. Legal examination mechanisms, such as insolvency examinations and financial report analysis, could be further refined to safeguard debtor businesses more effectively. Abstract

In recent years, the advancement of information and communication technology has made the circulation of personal data in Indonesia difficult to control, and cases of personal data breaches that harm consumers have often occurred. As a country that has specific regulations protecting personal data, there is a need for an overseeing institution to monitor the circulation of such personal data. However, up to this day, the government has not established this institution, causing uncertainty regarding the implementation of Law 27/2022. In conducting this research, the Author adopted a normative juridical research method, involving various approaches such as statute approach, conceptual approach, and comparative approach, with the aim of gaining a deeper and more comprehensive understanding of the analyzed issue. Based on the conducted analysis, the Author finds that the establishment of a Personal Data Protection Supervisory Institution would bring about numerous positive benefits, therefore this institution needs to be established promptly for Indonesia to achieve adequacy status. However, the form of this institution is still under debate as attaching it to the Ministry of Communication and Informatics may lead to a conflict of interest. In essence, Indonesia already has several independent state institutions, one of which is the Indonesia Competition Commission. Indonesia Competition Commissionis an independent state institution with a quasi-judicial model that cannot be intervened by any party in its handling, decision-making, or investigation of competition cases. Hence, drawing lessons from Indonesia Competition Commission, the Author's view is that the Personal Data Protection Supervisory Institution should ideally be established as an independent state institution due to the similarities it shares with Indonesia Competition Commission.
