Abstract

The writer uses library research methodology, therefore, using secondary data as the main source of the data. The issues raised in this study are basically derived from the point of view of the National Police Investigator as a law enforcement officer, what is the responsibility of the National Police investigator according to the law in the event of an error in arresting and detaining people or Error In Persona due to the negligence of the National Police investigator in carrying out his duties and obligations. The answer for the above question can be found in Indonesian criminal procedure law as regulated in Act Number.81 of 1981 concerning the Criminal Procedure Code as well as regulations relating to other criminal procedure laws such as Law Number. 2 of 2002 concerning the Republic of Indonesia National Police and the Professional Code of Ethics of the Republic of Indonesia National Police and so on. Based on the provisions mentioned above, for police investigators, the legal responsibility upon  them is in accordance with the Professional Code of Ethics of the Indonesian National Police which expressly sanctions its members who commit violations due to negligence in carrying out their duties so as to cause harm to victims of error in persona

Abstract

Children are the nation's next generation who need protection from various forms of violence. Despite the enactment of laws on the elimination of domestic violence and child protection, the behavior of violence against children still persists. This paper examines the legal issue of the criminological perspective on child abuse in Abeli District, Kendari City. To address this legal issue, an empirical juridical legal research method is used with a legal sociology approach supported by a statutory approach. This approach is considered appropriate as it will outline data on cases of child abuse in Abeli District and analyze this data to obtain legal insights into how criminology views various forms of child abuse. The research results show that from 2017 to 2020 in Abeli District, Kendari City, there were 57 cases of child abuse. Additionally, child abuse is proven to be a form of criminal act where the perpetrators can be held criminally accountable through both general and special criminal penalties.

Abstract

In essence, evidence in criminal cases is an effort to provide evidence through tools that can prove a case and its allegations, one of which is forensic autopsy evidence which is used as evidence. In fact, forensic autopsy evidence is very important in criminal homicide cases because it can confirm a person's death carried out by a forensic autopsy expert and speed up the court process. The aim is to prove the KUHAP evidentiary system through forensic evidence, and determine the value of forensic evidence in murder, and use it as expert testimony, this is also used as a basis for the judge's decision against the defendant. The research carried out is empirical legal research using an empirical approach from secondary data by managing primary, secondary and tertiary legal materials. Based on the research results, first we have to know that every country definitely has laws or regulations that apply in each country. As in murder cases, if witness statements are not always correct, judges really need forensic autopsy evidence as expert testimony, and it is rare to find witnesses who directly witnessed the crime of murder, and this becomes an obstacle for judges. Then in murder cases, many families do not want to have a forensic autopsy done. The meaning of a forensic autopsy is to find the true case and look for the causes that caused the person's death. Then, for clues and truth, a forensic autopsy must be carried out to achieve justice.

Abstract

Victims of crime have not received adequate protection from the state, both in physical and economic aspects, including in fulfilling other needs related to their role as witnesses in the criminal justice process. This research aims to analyze the position of crime victims in the criminal justice system in Indonesia, as well as to examine the forms of legal protection for victims and perpetrators of crime based on the principle of equality before the law. The results of the research show that the position of victims in the criminal justice system is still not receiving proportional attention and tends to be neglected, especially in the Criminal Procedure Code and Criminal Code. Nevertheless, some laws and regulations have begun to accommodate the protection of victims, although not yet optimally. In the perspective of the principle of equality before the law, legal protection for victims and perpetrators of crime should be placed equally as legal subjects who have the right to be protected by the legal system, although its implementation is not yet fully ideal.

Abstract

Masalah yang diangkat dalam penelitian ini adalah, bagaimana perbandingan Kekuasaan Legislasi Antara Indonesia dan Amerika Serikat. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis Perbandingan Kekuasaan Legislasi Antara Indonesia dan Amerika Serikat. Hasil penelitian penulis, dalam struktur ketatanegaraan Indonesia, bahwa pemegang fungsi legislasi adalah Dewan Perwakilan Rakyat yang dilakukan secara bersama-sama dengan Presiden untuk mendapatkan persetujuan bersama. Apabila tidak mendapatkan persetujuan bersama maka RUU tersebut tidak dapat menjadi undang-undang. Sehingga fungsi legislasi di Indonesia bersifat Joint function. Sedangkan DPD sebagai kamar kedua, peranannya hanya bersifat supporting terhadap wewenang DPR dan Presiden. Konstitusi Amerika Serikat menegaskan bahwa kekuasaan untuk membentuk undang-undang berada di tangan sebuah Lembaga legislatif biasa disebut Kongres. Kongres Amerika Serikat yang terdiri dari dua badan (bicameral) yaitu Senat dan Dewan Perwakilan Rakyat (House Of Representative). Fungsi legislasi di Amerika Serikat dipegang oleh dua kamar yang memiliki peranan dan fungsi legislasi yang seimbang dan setara. Semua undang-undang terlebih dahulu harus disetujui oleh kedua kamar tersebut.
