Abstract

AbstractThe real contribution of fish farmer in the development of the national economy through the amount of fisheries production is not followed by the level of welfare of the fish farmer. That the welfare of fish farmers to be able to fulfill their needs with the income they obtain is still very limited. This article aims to analyze the legal empowerment model of fish farmer through the triple helix model development approach. This research is a sociolegal research which is a mixed method between legal research methods and social science. The data used are primary data and secondary data. The results showed that normatively, the role provisions of the government and fish breeders have been clearly regulated, but the provisions for tertiary institutions have not been regulated, even though the role played by universities is no less important. Higher education as one of the elements in the triple helix has human resources who are able to provide knowledge and understanding related to production sharing agreements through legal assistance and mentoring workshops. The government is responsible for the welfare of its citizens, not only acting as a regulator, but also as a facilitator, dynamist and catalyst. Keywords : Legal Empowerment, Fish Farmer,Triple Helix

Abstract

Tindak pidana korupsi adalah extra ordinary crime, yakni tindak pidana yang memerlukan keterlibatan banyak pihak,  cara yang tidak biasa dan melibatkan  komitmen dari masyarakat.  Salah satu upaya pencegahan tindak pidana korupsi adalah melalui pemberian contoh-contoh berbagai usaha mencegah dan menentang korupsi  serta strategi dan rencana aksi pemberantasan korupsi dan integritas dan nilai-nilai antikorupsi.  Sehubungan dengan pengawasan pada penggunaan anggaran negara melalui dana desa, maka tujuan penelitian ini adalah menganalisis hambatan dalam penerapan pencegahan korupsi pada penggunaan dana desa.  Metode penelitian yang digunakan adalah penelitian eksploratif  dengan analisis data secara deskriptif kualitatif.  Hasil penelitian menunjukkan bahwa perwujudan pencegahan korupsi pada penggunaan dana desa pada Dinas Pemerintahan Masyarakat dan Desa {PMD)dan Pemerintah Desa Suci, Desa Yosowilangun dan Desa Giri pada Pencegahan korupsi adalah pertama, pemahaman yang rendah mengenai gerakan anti korupsi berupa pemenuhan unsur monitoring dan evaluasi, pemenuhan dokumen saat perencanaan dan pelaksanaan dan administrasi kegiatan.  Kedua, bentuk pencegahan korupsi adalah dengan  munculnya rasa ketakutan untuk melakukan pelanggaran pada peraturan pelaksanaan  penggunaan dana desa tersebut.  Ketiga, pembahasan mengenai Pencegahan korupsi seakan-akan merupakan kajian yang baru dan tabu untuk diadakan pembahasan lebih lanjut.

Abstract

The anti-corruption movement introduces the publik that prevention efforts are better than efforts to eradicate corruption itself. This case has been conducted by an anti-corruption activist representing the community. The purpose of this research is to know the experience and understanding in supporting and realizing the anti-corruption movement as an effort to prevent corruption in East Java society. This type of research is sociological juridical and analyzed qualitatively. The results of the discussion showed that Malang Corruption Watch (MCW) and the Judicial Commission of the Republik of Indonesia liaising East Java had implemented an anti-corruption movement with a focus on publik education and capacity building for youth and students and had exercised their authority and duties in realizing judges who were committed to implementing the Code of Ethics and the Judge's Conduct Guidelines (KEPPH) by monitoring special hearings on corruption cases.

Abstract

AbstractMarriage as part of human rights, especially the right to have a family related to aspects of religion, culture, and state legal policies. Indonesia as a constitutional state provides strict marriage arrangements in the Marriage Law. Even so, there is a phenomenon in society related to the existence of interfaith marriages, especially between adherents of Islam and Catholicism. Today the Surabaya District Court determines the continuity of interfaith marriages through Decree No. 916/Pdt.P/2022/PN.Sby. This research is a normative legal research using statutory, conceptual and case approaches. The results of this study confirm that the application of court decisions, especially the jurisprudence of the Supreme Court in interfaith marriages, must be viewed in a casuistic way and not be the same for everyone (erga omnes). This also emphasizes that marriage is always related to aspects and laws of each religion and beliefs held by each. Thus, in cases of interfaith marriages, it is necessary to pay attention to the provisions of Islamic Law and Canon Law or the Church regarding the implementation of interfaith marriages between Muslims and Catholics.Keywords: Interfaith; Marriage; Human Rights. AbstrakPerkawinan sebagai bagian dari hak asasi manusia khususnya hak berkeluarga yang berkaitan dengan aspek keagamaan, kebudayaan, serta kebijakan hukum negara. Indonesia sebagai negara hukum memberikan pengaturan perkawinan secara tegas dalam UU Perkawinan. Meski begitu, terdapat fenomena di masyarakat terkait adanya perkawinan beda agama khususnya antara penganut Agama Islam dengan Agama Katolik. Dewasa ini Pengadilan Negeri Surabaya menetapkan keberlangsungan perkawinan beda agama melalui Penetapan No. 916/Pdt.P/2022/PN.Sby. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan, pendekatan konseptual, serta pendekatan kasus. Hasil penelitian ini menegaskan bahwa penerapan putusan pengadilan khususnya yurisprudensi Mahkamah Agung dalam perkawinan beda agama harus dilihat secara kasuistis serta tidak bersifat sama untuk semua orang (erga omnes). Hal ini juga mempertegas bahwa perkawinan selalu berkaitan dengan aspek serta hukum masing-masing agama dan kepercayaan yang dianut oleh masing-masing. Dengan demikian, dalam kasus perkawinan beda agama perlu memperhatikan ketentuan Hukum Islam dan Hukum Kanonik atau Gereja terkait pelaksanaan perkawinan beda agama antara Islam dan Katolik. Abstract

The practice of marriage is always closely related to the arrangements in religious law and state law. This research aims to answer two legal issues, namely the existence of marriage after the Constitutional Court Decision No. 24/PUU-XX/2022 and the implications of the Constitutional Court Decision No. 24/PUU-XX/2022 in the aspects of Islamic law and national law. This research is a normative legal research with case, conceptual, and legislative approaches. The findings of this research confirm that the existence of marriage after the Constitutional Court Decision No. 24/PUU-XX/2022 is not only seen as a human right as a freedom for everyone to enter into marriage. But it must be based on the values of religious law as a representation of the legality of marriage by the state. The orientation of the Constitutional Court Decision is important because KHI and the Marriage Law have the same perspective in viewing marriage as a prerequisite and not as a right. The practical contribution of this research is related to ideal legal policy, namely the need for affirmation and formulation in Indonesian legislation that marriages that do not aim to form families and are oriented towards continuing offspring are invalid in accordance with the aspects of maslahat mursalah and the Indonesian legal system.

Abstract

Violence still occurs in the education sector, as well as in Islamic boarding schools. Violence can occur due to a lack of knowledge among students, guardians, and administrators. In contrast, one of the determinants of efforts to eliminate violence in Islamic boarding schools is the policy within the Islamic boarding school environment. One of the spearheads of violence that appears in the Islamic boarding school environment is the parenting pattern in the relationship between the Islamic boarding school and students. This activity aims to identify knowledge about violence and Islamic boarding school policies in preventing violence, with the specific objective of being the initial step in compiling patterns of Islamic boarding school policies. Data collection, based on Focus Group Discussion (FGD) activities, involved 20 students, administrators, parents of students, and caretakers of an Islamic boarding school. The FGD produced patterns of violence and agreement in forming efforts to harmonize various parties in activities at Islamic boarding schools. This activity resulted in increased knowledge about violence and prevention efforts, as well as a commitment from administrators and caretakers to compile humanist Islamic boarding school care management patterns in accordance with the characteristics of Islamic boarding schools and other relevant government policies.

Abstract

Waqf has significant potential to improve public welfare in Indonesia and continues to evolve in line with societal changes. As an ijtihadi concept, waqf is open to contemporary interpretations, one of which is profession waqf—introduced by the Indonesian Waqf Board (BWI). Profession waqf refers to the endowment of one’s physical or non-physical expertise for the benefit of the public, in accordance with Islamic law. This study aims to explore the concept and subject of profession waqf in Indonesia using normative legal research with statutory and conceptual approaches. Legal materials are analyzed prescriptively to address the core issues. The research concludes that profession waqf involves dedicating an individual’s skills or professional services for public good and must be carried out in line with sharia principles. The actors involved include: (1) the profession wakif, who endows their expertise; (2) the nazhir, who manages and develops the waqf; and (3) the mauquf alaih, the beneficiaries who may be specifically named or generally intended in the waqf pledge. This form of waqf allows professionals to contribute meaningfully to society, not just through material wealth, but through their knowledge and skills.

Abstract

Professional waqf is one type of waqf that has the potential to become a means of improving the welfare of society in Indonesia. The development of digitalization essentially presents opportunities to optimize the implementation of professional waqf in Indonesia. This research aims to analyze the penta helix strategy and legal pluralism in optimizing digital-based professional waqf in Indonesia. This research is normative legal research with the aim of conducting reform-oriented research related to the legal policy of professional waqf in Indonesia. Legal materials were collected, including laws and regulations and other research findings, which were then prescriptively analyzed. The research findings confirm that one of the obstacles to implementing professional waqf in Indonesia is the lack of specific regulations regarding professional waqf, which leads to legal uncertainty in its implementation. Through the legal pluralism approach, the regulation of professional waqf will be more optimal and synergistic with Islamic law and state law. Optimizing professional waqf requires a pentahelix approach involving the community, universities, business actors, government, and the media thru a transparent and participatory digitalization process. Digitalization implemented with a penta helix-based approach and accommodating legal pluralism is expected to increase community participation and contribution to the implementation of professional waqf in Indonesia. The academic contribution of this research lies in the use of the penta helix approach and legal pluralism, where professional waqf not only requires a legal framework in the form of regulations but also needs the penta helix approach and legal pluralism to optimize professional waqf in Indonesia.
