Abstract

Pada dasarnya perusahaan yang bergerak di bidang e – commerce ini sama seperti perusahaan yang kegiatan bisnisnya masih menggunakan cara – cara konvensional. Di samping itu perusahaan tersebut juga membutuhkan dana untuk melaksanakan kegiatan operasional perusahaan itu sendiri. Perusahaan yang bergerak di bidang e – commerce meskipun kegiatan biaya yang dikeluarkan untuk kegiatan bisnisnya tidak sebesar dengan perusahaan konvensional, namun perusahaan tersebut tetap saja membutuhkan anggaran untuk menjamin kelangsungan bisnis tersebut. Perusahaan yang bergerak bidang e – commerce tentunya selain mengandalkan kepada modal dasar yang dimiliki, namun perusahaan  pasti juga bergantung kepada sumber anggaran lainnya yaitu melalui kegiatan utang. Perusahaan apabila memanfaatkan pola utang ini, ada kemungkinan perusahaan di bidang e – commerce tersebut akan dapat dipailitkan jika ternyata perusahaan tersebut memenuhi syarat untuk dipailitkan sebagaimana diatur dalam Pasal 2 ayat (1) UU No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Masalah selanjutnya tentunya mengenai mekanisme penentuan harta kekayaan perusahaan di bidang e-commerce tersebut untuk dijadikan boedel/harta pailit. Hal ini mengingat aset perusahaan di bidang e-commerce selain berupa benda yang berwujud seperti gedung kantor, uang, kendaraan perusahaan dan semcamnya. Di sisi lain perusahaan juga mempunyai aset dalam bentuk yang tidak berwujud yaitu aplikasi sistem e-commerce itu sendiri.

Abstract

Berkenaan dengan pelaksanaan sistem pemerintahan. Salah satu tolak ukur baik atau buruknya sistem pemerintahan pada suatu negara dapat dilihat pada sistem pemiihan umum suatu negara tersebut. Menyangkut sistem pemilihan umum ini, Penulis mengambil contoh sistem pemilihan dari negara Indonesia dan Australia. Hal ini didasarkan pada ruang lingkup sistem pemilihan umum yang ada di kedua negara tersebut memiliki ciri khas masing – masing terutama jika dilihat dari aspek historis hingga proses transisi penyelenggaraan pemilu kedua negara tersebut dari tahun ke tahun. Adapun rumusan masalah penelitian tersebut mengenai bagaimana pelaksanaan sistem pemilihan umum di Australia dan Indonesia dan hal positif apa saja yang dapat diambil dari sistem pemilihan umum di Australia yang kemudian dapat diterapkan dalam penyelenggaraan pemilu di Indonesia. Jenis penelitian hukum yang digunakan ialah penelitian yuridis normatif. Kesimpulan dalam penelitian ini ialah sistem pemilu yang diharapkan dapat berjalan dengan fair dan objektif apabila segala ruang lingkup yang berkaitan dengan sistem pemilu tersebut berjalan dan terealisasi dengan baik pula. Khusus di Australia, sistem pemilihan umumnya bisa dikatakan hampir mendekati paling sempurna. Hal ini dikarenakan dari aspek teknis maupun nonteknis penyelenggaraan pemilunya yang berjalan dengan optimal. Di Indonesia pada masa reformasi, sistem pemilu yang dijalankan mulai terlihat dan sesuai dengan harapan bangsa indonesia. Landasan yuridis yang berkaitan dengan sistem pemilu pada masa reformasi ini sebagaimana diatur dalam Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, telah mengalami perbaikan dibandingkan pada orde lama maupun orde baru, meskipun secara normatif, regulasi yang mengatur tentang pemilu di indonesia telah cukup baik jika dilihat dari segi substansinya. namun, dalam pengimplementasiannya masih butuh perbaikan yang lebih baik lagi.

Abstract

It is hoped that the Ombudsman of the Republic of Indonesia will be able to oversee the delivery of public services and law enforcement for the realization of an effective and efficient, honest, clean, open and free from corruption, collusion and nepotism. The purpose of this study was to determine the obstacles that arise in the role and function of the ombudsman of the republic of Indonesia in the effectiveness of law enforcement and examination and completion of reports by the ombudsman in the effectiveness of law enforcement in Indonesia. The research method in this study is a normative juridical approach where the literature used is to use legislation, as well as books. The conclusion in this study is that in carrying out its duties and functions, the Ombudsman also faces several obstacles, including: a limited number of Human Resources; inadequate facilities and infrastructure, limited budget and resistance from several parties. The efforts made by the Ombudsman in overcoming these obstacles are: improving the performance of the Ombudsman Human Resources effectively and efficiently; take an accountable approach to the Ministry of Finance and Bappenas so that the budget increases so that it can improve facilities and infrastructure and improve the quality of supervision carried out by the Ombudsman.

Abstract

The world is currently being faced by a global covid-19 pandemic, including in Indonesia this pandemic is very disturbing to the public. Manpower development must be regulated in such a way that basic rights and protections for workers are fulfilled, especially for women workers so as to create conducive conditions. The purpose of this paper is to find out the policies issued by companies for workers, especially women workers during the Covid-19 pandemic. This writing method is library research, which is a series of research related to library data collection methods, or research where the object of research is excavated through a variety of library information. The results obtained in this paper are that the company policies that terminate employment of women during the Covid-19 pandemic are protected by Law Number 13 of 2003 concerning Manpower, the losses caused by the company have not reached 2 years, the company cannot simply terminate the work relationship, Then there needs to be other efforts provided by companies or the government in overcoming the impact of Covid-19 on laid-off workers so that they can limit working time / overtime and workers can be sent home without breaking the work relationship The suggestion is expected that the government should supervise and act decisively against companies that employ female workers.

Abstract

The crime of corruption is an Extra Ordinary Crime becoming the greatest enemy of the country and must work together to prevent and combat corruption. Fighting corruption is not just through law enforcement but preventive measures are crucial. Efforts to raise awareness of the issue of corruption must involve the role and society at large. To search, obtain and provide information on alleged corruption offences to law enforcement authorities. The issue in this study is how the rule of law regulates the role and society in the prevention and suppression of corruption crimes in Indonesia and the factors that influence the role as well as the society in preventing and suppressing corruption crime in Indonesia. This type of research is included in the study of normative law.The specification of this study is descriptive. The data sources used are voluntary, primary, and tertiary data. The data collection tool is library research. The data analysis technique used is qualitative analysis. Results in this study The role of the public in the efforts to prevent and combat corruption is essential in the fight against corruption crimes, the public must participate because of two things: the public as a victim and the society as a component of the state. Role forms and society is by dominating the role and society in efforts to prevent and combat corruption as regulated in the laws, namely the Law No. 31 Year1999 Jo Law No. 20 of 2001 on the Suppression of Criminal Acts of Corruption and Government Regulations of the Republic of Indonesia No. 43 Year 2018 on the Rules of Implementation of Roles and Society Awards in Prevention and Combating Corruption. The role as well as the community in the prevention and suppression of corruption crimes has not been performed effectively due to several factors, including legal factors, law enforcement factors, means and means factors, community factors and cultural factors. The recommendation given to the Government and the Council of Representatives of the People as the legislator is advised to make regulations specifically for the setting of roles as well as arrangements in the prevention and suppression of corruption crimes, further to socialize continuously to all elements of the society against such regulations, in cooperation with all institutions, universities, community organizations, stake holders etc., so that the public becomes aware and cares and can play a role in the preventing and suppressing corruption crime.
