Abstract

PT Asia Forestama Raya is a forest product processing factory for the wood industry's raw materials. Based on Article 74 Paragraph (1) of Law Number 40 of 2007 concerning Limited Liability Companies, it is stipulated that companies that carry out their business activities in the natural resources sector and / or fields related to natural resources are required to implement CSR. In Article 10 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that CSR programs can take the form of community economic empowerment. This research aims to explain the implementation of PT Asia Forestama Raya's CSR on community economic empowerment during the Covid-19 pandemic. The method used in this research is socio-legal research. During the Covid-19 pandemic, the public really expected a real contribution from PT Asia Forestama Raya. PT Asia Forestama Raya's obstacle in implementing community economic empowerment in Limbungan Village is that the financial condition of PT Asia Forestama Raya is currently in an unstable state. Efforts that can be made by the people of Limbungan Village if PT Asia Forestama Raya doesn’t carry out a CSR program are to convey their aspirations to Commission IV of DPRD Pekanbaru City. Based on Article 32 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that if PT Asia Forestama Raya doesn’t carry out CSR towards empowering the community's economy, the company can be subject to administrative sanctions by the Pekanbaru City Government.

Abstract

Tujuan penelitian ini untuk menjelaskan dampak kebijakan RTRW terhadap iklim investasi bidang usaha perkebunan di Provinsi Riau. Penelitian ini menggunakan metode penelitian hukum sosiologis dengan pendekatan empiris. Hasil penelitian ini dapat dijelaskan bahwa fenomena fundamental yang mempengaruhi iklim investasi di Provinsi Riau. Belum selesainya RTRW berdampak besar terhadap investasi karena setiap investasi membutuhkan lahan/lahan. Sampai saat ini, Perda RTRW Provinsi Riau belum terbentuk, karena masih ada status resolusi masalah hutan di Kementerian Kehutanan. Penelitian ini menyimpulkan bahwa Pemerintah Provinsi Riau pada tahun 2001 sudah memulai melakukan revisi terhadap Perda Nomor 10 Tahun 1994 tersebut. Tetapi, sampai dilakukannya penelitian ini Perda RTRW Provinsi Riau belum ditetapkan, karena memang masih ada penyelesaian masalah status kawasan hutan di Kementerian Kehutanan. Tentunya, Pemerintah Daerah Provinsi Riau termasuk daerah kabupaten/kota di Riau tidak berani mengambil risiko hukum menerbitkan izin baru untuk investasi perkebunan. Upaya yang dilakukan di tengah ketidakkepastian kebijakan RTRW terhadap investasi bidang usaha perkebunan di Provinsi Riau dapat dikatakan hanya menunggu pengesahan Perda RTRW Provinsi Riau.

Abstract

Based on Article 74 of Law Number 40 of 2007 concerning Limited Liability Companies, it is regulated that companies that carry out their business activities in the natural resources sector and/or fields related to natural resources are required to carry out corporate social responsibility. The method used in this study is sociological legal research. The implementation of corporate CSR towards the community of Rumbai Timur District based on Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility has not been optimally implemented, especially in the field of preserving customs and culture and empowering local workers. Obstacles in its implementation are the ignorance of the Rumbai Timur District community regarding Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility and also the lack of supervision carried out by the Riau Provincial Social Service of companies in Rumbai Timur District. Based on Article 32 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility, it is regulated that companies that do not carry out CSR can be subject to administrative sanctions in the form of written warnings, restrictions on business activities, freezing of business activities, and revocation of business licenses.Keywords: Company, CSR, Society

Abstract

This research aimed to analyze the legislative arrangements related to the protection of personal data, especially for consumers. This research is important because it discusses the potential misuse of personal data belonging to consumers. The research was conducted normatively and analyzed qualitatively, and the results of this research on personal data protection in Indonesia are described descriptively. This research has resulted in new findings in the form of protection in the latest regulation and also challenges to enforce the regulation. So that these findings can be used as material for further research. The protection of personal data in Indonesia is regulated in several regulations. However, in 2022 Indonesia enacted Law number 27 of 2022 on the protection of personal data. This law contains specific norms regarding the right to protection of personal data from the limitation and definition of matters related to personal data, rights and obligations of subjects related to personal data to the regulation of sanctions. Currently, the protection of personal data, especially for consumers, still faces challenges, ranging from the challenge of low public awareness, standard clauses in consumer agreements to the absence of special institutions whose duties oversee the problems and implementation of data protection.

Abstract

Dari segi cara menentukan harga, bank dibedakan menjadi dua jenis, yaitu bank konvensional dan bank syariah. Bank konvensional maupun bank syariah wajib menerapkan prinsip Good Corporate Governance dalam kegiatan usahanya karena bank konvensional dan bank syariah merupakan lembaga intermediasi yang berfungsi menghimpun dana dari masyarakat dan menyalurkan kembali dana tersebut kepada masyarakat atas dasar kepercayaan. Penelitian ini bertujuan untuk menjelaskan perbandingan prinsip Good Corporate Governance pada bank konvensional dan bank syariah di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif, dengan menggunakan pendekatan peraturan perundang-undangan. Prinsip Good Corporate Governance yaitu prinsip keterbukaan, akuntabilitas, tanggung jawab, independensi, dan kewajaran. Pada dasarnya, penerapan prinsip Good Corporate Governance pada bank konvensional dan bank syariah adalah sama, karena mengacu pada ‘Pedoman Good Corporate Governance Perbankan Indonesia’ yang dikeluarkan oleh Komite Nasional Kebijakan Governance. Perbedaannya adalah prinsip Good Corporate Governance pada bank syariah diatur secara tegas pada Pasal 34 Ayat (1) Undang-Undang Nomor 21 Tahun 2008. Perbedaan lainnya terletak pada prinsip syariah yang digunakan oleh bank syariah karena selain dibina dan diawasi oleh Otoritas Jasa Keuangan, bank syariah juga diawasi oleh Dewan Syariah Nasional Majelis Ulama Indonesia secara umum dan Dewan Pengawas Syariah secara khusus.
