Abstract

Factors causing State Civil Apparatus (ASN) to participate in political parties are political intervention by State officials, ASN feel that their income or salary as ASN has not fulfilled the needs of life and the quality of its own human resources. While the legal sanctions for ASN involved in political parties namely to the ASN will be dismissed with no respect, this is as stated that ASN employees must be free from the influence and intervention of all groups and political parties (Article 9 (2)) of the ASN Law

Abstract

Legal Protection for Abortion Criminals is the suspect has the right to immediately be examined by the investigator and can then be submitted to the public prosecutor, the suspect has the right to have his case immediately brought to trial by the public prosecutor, the defendant has the right to be tried immediately by the court. and factors that cause abortion are economic factors, hereditary diseases, psychological factors, age factors, actors of maternal diseases, other factors.

Abstract

Abstrak Cita-cita dan harapan bangsa Indonesia yang menghendaki hukum adat sebagai alat pemersatu bangsa telah memberi harapan bagi pembangunan hukum adat Indonesia ke depan. Amandemen terhadap pasal-pasal UUD 1945 kini menjadi relevan untuk dijadikan bahan kajian bincangan rancang bangun hukum nasional. UUD 1945 merupakan jantung dan jiwa suatu negara. UUD 1945 memberi tahu kepada kita tentang apa yang dimaksud dengan membentuk negara, cita-cita bernegara, apa yang ingin dilakukan, serta asas-asas kehidupan di dalamnya. Bilamana kita memaknai UUD 1945 secara mendalam dan komprehensif, maka kita bisa melihat bahwa UUD 1945 menggambarkan negara Republik Indonesia sebagai sebuah negara yang peduli akan rakyatnya.Salah satu bentuk implementasi dari politik hukum rekognisi terhadap masyarakat hukum adat yang dimuat dalam konstitusi adalah mengharuskan pemerintah dan pembentuk Undang-Undang tidak boleh mengabaikan dan untuk senantiasa menjadikan hukum adat sebagai sumber inspirasi dan tempat menggali hukum (sources of law) dalam usaha besar pembangunan hukum nasional. Kata Kunci: Hukum Adat, UUD, Ketatanegaraan Abstract The ideals and hopes of the Indonesian people who want customary law as a unifying tool for the nation have given hope for the development of Indonesian customary law in the future. Amendments to the articles of the 1945 Constitution have now become relevant to be used as a subject for discussion of national law design. The 1945 Constitution is the heart and soul of a country. The 1945 Constitution tells us about what is meant by forming a state, the ideals of statehood, what it wants to do, as well as the principles of life in it. If we interpret the 1945 Constitution in-depth and comprehensively, then we can see that the 1945 Constitution describes the Republic of Indonesia as a country that cares about its people. One form of implementation of the legal politics of recognition of indigenous peoples contained in the constitution is to require the government and the framers of the Law not to neglect and to always make customary law a source of inspiration and a place to explore the law (sources of law) in the great effort of national law development. Abstract

Abstrak Politik hukum dijadikan sebagai pedoman dasar dalam proses penentuan nilai-nilai, penetapan, pembentukan dan pengembangan hukum nasional di Indonesia. Mengingat adanya interrelasi antara Hukum Tata Negara dan perubahan-perubahan sosial, maka nyatalah bahwa yang penting dalam Hukum Tata Negara bukanlah sekedar mempelajari Undang-Undang Dasar dan peraturan perundangan saja, tapi tekanan hendaklah lebih diberikan kepada proses terjadinya Undang-Undang. Dalam konteks ini diperlukan kesadaran dan pembaharuan cara berpikir di bidang Hukum Tata Negara.Hukum Tata Negara tidak saja memperhatikan sudut pandang formal, tapi juga sudut fungsional, sehingga akan selalu bersifat dinamis. Sehingga dalam pembentuk peraturan perundang-undangan hendaknya tetap berpegang teguh pada tujuan negara yang ingin dicapai dalam membuat suatu produk hukum. Dimana rasa keadilan, kemanfaatan dan kepastian hukum bagi masyarakat selalu terakomodir dalam setiap hukum yang diciptakan. Kata Kunci: Pembaharuan Hukum, Politik Hukum Abstract Legal politics is used as a basic guideline in the process of determining values, establishing, establishing and developing national law in Indonesia. Given the interrelationship between constitutional law and social changes, it is clear that what is important in constitutional law is not just studying the constitution and laws and regulations, but more emphasis should be placed on the process of enacting laws. In this context, awareness and renewal of ways of thinking in the field of Constitutional Law are needed. Constitutional Law does not only pay attention to the formal point of view, but also the functional point of view, so that it will always be dynamic. So that in forming laws and regulations, they should stick to the goals of the state to be achieved in making a legal product. Where a sense of justice, usefulness and legal certainty for the community is always accommodated in every law that is created.

Abstract

The issue of whether the president is allowed to campaign is not a new one, as stipulated in Article 299 of Law Number 7 of 2017 concerning General Elections, which states that the President and Vice President have the right to conduct campaigns. This raises concerns about the President potentially favoring one pair of candidates to the advantage or disadvantage of other election participants during the campaign period. The purpose of this research is to examine the impact of the President's authority in conducting election campaigns. This study is juridical-normative (legal research), utilizing a descriptive approach based on secondary data. Article 299 of Law Number 7 of 2017 concerning Elections states that the President has the right to conduct campaigns, while ensuring the continuity of state administration tasks, refraining from using state facilities, and avoiding actions that could benefit or harm any pair of candidates. This situation can lead to presidential bias and tendencies toward favoring one pair of candidates, misuse of authority by exploiting state facilities for non-state interests, and the potential for actions that could influence the electoral prospects of each pair of candidates positively or negatively.

Abstract

Kampanye Pemilu merupakan kegiatan wajib peserta pemilu atau pihak lain yang ditunjuk oleh peserta pemilu untuk meyakinkan pemilih dengan menawarkan visi, misi, program dan/atau citra diri peserta Pemilu. Namun dalam kampanye politik tidak jarang anak-anak dilibatkan dalam proses kampanye. Pelibatan anak dalam kegiatan kampanye politik merupakan sebuah fenomena berulang setiap 5 tahun sekali atau setiap putaran kampanye. Penelitian dalam tulisan ini adalah penelitian yuridis normatif. Penelitian secara yuridis (normatif) mencakup penelitian terhadap asas hukum, ,sistimatika hukum, taraf sinkronisasi hukum,sejarah hukum dan perbandingan hukum. Sumber data yang dibutuhkan dalam pelaksanaan penelitian ini menggunakan sumber data primer dan data sekunder. Penggunaan data primer akan diperoleh melalui pihak penegak hukum yang terkait (referensi) dan para pihak terkait dengan kasus yang dijadikan objek dalam penelitian. Data sekunder (library research) yaitu peraturan perundang–undangan dan literatur–literatur lainnya yang berkaitan dengan penelitian ini. Sanksi pidana yang diberikan kepada pelaksana dan/atau tim kampanye yang melanggar ketentuan di Pasal 280 ayat (2) huruf k UU Pemilu terdapat di Pasal 493 UU Pemilu yang berbunyi: “Setiap pelaksana dan/atau tim Kampanye Pemilu yang melanggar larangan sebagaimana yang dimaksud di dalam Pasal 280 ayat (2) dipidana dengan pidana kurungan paling lama 1 (satu) tahun dan denda paling banyak Rp. 12.000.000,00 (dua belas juta rupiah)”. Undang-Undang No. 35 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak (Selanjutnya di sebut UU Perlindungan Anak) juga mengatur perlindungan anak dari penyalahgunaan dalam konteks kegiatan politik. Hal ini diatur dalam Pasal 15 huruf a UU Perlindungan Anak.

Abstract

Abstract Village regulations are formed in the framework of implementing village government, thus village regulations must be a further elaboration of higher statutory regulations and must not conflict with public interests and/or higher statutory regulations, and must pay attention to socio-cultural conditions of local village communities, in an effort to achieve long-term, medium-term and short-term goals of government, development and community services. The problem that the author addresses in this article is the legal consequences of village regulations that contain formal and material defects in the procedures for making them. Abstract

The implementation of customary (adat) sanction-based strategies to minimise immoral acts illustrates the interaction between customary law, moral values, and social dynamics in local communities. This study aims to analyse the effectiveness of such sanctions in curbing immoral behaviour, which includes physical, verbal, and sexual offences outside of marriage, as well as other forms of social deviance. It examines the types of sanctions applied, such as fines, corporal punishment, forced marriage, and ostracism. From the perspective of Islamic law, these sanctions fall under ta'zir, a discretionary punishment used to uphold justice and maintain order. Based on family and social law theory, the study positions customary norms as tools for promoting collective morality and shaping social cohesion. Using a qualitative approach, data were collected through interviews with religious and traditional leaders, community elders, and young people, as well as through field observations. The findings show that customary sanctions foster awareness, promote moral conduct, and support social harmony by reinforcing shared ethical standards and encouraging communal responsibility. These practices are deeply embedded in cultural identity and often enjoy stronger legitimacy than formal legal mechanisms. Although not part of state law, customary sanctions operate as informal systems of justice and serve as culturally appropriate responses to moral decline. The significance of this study lies in its potential to inform policy and practice through culturally grounded strategies that integrate religious ethics, traditional values, and local wisdom. It also contributes to broader discourses on alternative dispute resolution, grassroots moral governance, and the role of local institutions in addressing youth immorality and sustaining social order.
