Abstract

Kejahatan berkembang seiring dengan perkembangan peradaban manusia, dan dapat dikatakan bahwa kejahatan lahir bersama dengan lahirnya peradaban manusia. Perkembangan kejahatan juga diiringi dengan perkembangan pelaku tindak pidana. Oleh karena itu, perlu adanya pertanggungjawaban pidana yang tepat. Tuntutan perubahan serta adanya revolusi industri 4.0, membuat begitu banyak orang berlomba untuk dapat mengikuti arus zaman, terutama dalam hal pengembangan sistem informasi dan teknologi hal tersebut menunjukkan bahwa teknologi internet sudah menjadi keharusan yang digunakan untuk bersosialisasi dan melakukan bisnis di semua tingkat kalangan. Selain pertumbuhan pengguna internet ada juga tren kejahatan internet (cybercrime) seperti cyber stalking, Indonesia dianggap sebagai negara yang paling berisiko terhadap serangan keamanan teknologi informasi, karena hukum pidana Indonesia tidak mengenal khusus tindak pidana stalking. Sebagaimana kita ketahui saat ini banyak penggunaan media sosial yang tidak terarah, penggunaan oleh pihak-pihak yang tidak bertanggung jawab, berbagai kejahatan dapat terjadi di dunia maya yang saat ini juga dikenal istilah cybercrime. Metode yang digunakan dalam penulisan yaitu Doctrinal Research, mengenai kejahatan siber jika cyber stalking merupakan salah satu bentuk kejahatan cyber crime, pengaturan mengenai cyber stalking di Indonesia masih sangat awam dan minim penegakan, hal ini dikarenakan sulitnya ditemukan pelaku secara langsung karena mayoritas dari pelaku menggunakan akun anonim pada media sosial serta tidak jelasnya mengenai batasan persetujuan akan penggunaan akun media sosial berkaitan dengan peng-inputan/memasukkan data pribadi secara valid oleh pemilik akun.

Abstract

Legal policies causing environmental damage raise questions about legal standing to file lawsuits with the State Administrative Court and its authority over business license disputes. This study examines the challenges and opportunities in implementing the authority of the state administrative court as a form of law enforcement on business licenses that impact environmental damage. This study uses the qualitative method NVivo12 Plus 12 by analyzing legal rules, journals, and online print media such as detik.com and kompas.com. The research focuses on the approach of laws and regulations related to the environment and case studies based on Supreme Court decisions. The Administrative Court plays a role in receiving claims against government actions that harm citizens. One of them is the authority to adjudicate disputes over government actions related to environmental disputes. Community participation is essential to create a healthy environment and is used not only as a means to an end but also as an end. The right to a healthy climate encompasses the right to receive environmental information, participate in decision-making, and review challenging public decisions within the scope of access to justice.

Abstract

Praktik kebidanan dalam pelayanan kesehatan, perlu dijaga dan ditingkatkan kualitasnya sesuai standar pelayanan yang berlaku. Adanya tuduhan tindakan malpraktik setelah melakukan persalinan yang melibatkan asisten yang tidak memiliki Surat Tanda Registrasi Bidan (STRB), sehingga menyebabkan pasien meninggal dunia, dan pihak keluarga tidak menuntut Keywords: Legal Protection, Health Services, Malpractice, Midwife, Patient.secara hukum. Penelitian ini bertujuan mencoba menganalisis tentang bagaimana menyoroti isu dugaan malpraktik di bidang kesehatan, di mana bidan dituduh karena ketidakhati-hatian dan waspada dalam menangani pasien, sementara beberapa tenaga kesehatan melakukan malpraktik untuk memberikan pelayanan yang baik kepada pasien. Penelitian ini menggunakan metode kualitatif dengan mengkaji data primer dan sekunder berupa wawancara, studi kepustakaan dan analisis data. Hasil penelitian menunjukkan bahwa bidan berperan membantu menurunkan angka kematian ibu dan bayi, berdasarkan standar profesi, standar kompetensi, dan kode etik yang berlaku sehingga terhindar dari perbuatan melawan hukum. Hasil penelitian ini menunjukkan bahwa adanya Peraturan Menteri Kesehatan Nomor 28 Tahun 2017 tentang Izin dan Penyelenggaraan Praktik Bidan, tenaga kebidanan dalam menjalankan tugasnya, harus memiliki Surat Tanda Registrasi Bidan (STRB) dan Surat Izin Praktik Bidan (SIPB).

Abstract

This research aims to analyze the legal considerations that prevent a person from being convicted when accessing pornographic content and identify the implications that arise from the consumption of such content. The main focus of this research is how legal regulations in various countries, including Indonesia, regulate access to pornography and the extent of the application of criminal law. The research method used is a normative juridical method with a statute approach and conceptual approach. Data is obtained through literature study, including rules and regulations, court decisions, academic literature, and social media. The results show that the non-criminalization of individuals who access pornography is based on the principle of no crime without a clear legal basis and the right to individual privacy. Most regulations place more emphasis on criminalizing the production, distribution, and dissemination of pornographic content than personal consumption. However, some countries apply exceptions in some instances, such as the consumption of child pornography, which is expressly prohibited.

Abstract

The misuse of cyberbullying against Generation Z (Gen-Z) teenagers is increasing in line with the rapid development of digital technology and social media. The viral case in Probolinggo involving Luluk Nuril shows how insults, public shaming, and verbal abuse in the digital space can have serious psychological effects on victims. The urgency of this research lies in the need to assess the extent to which existing legal instruments are able to provide protection for victims of cyberbullying while offering more humane alternatives through a restorative justice approach. This study seeks to answer two main questions: what form of legal protection is available for Gen-Z teenagers who are victims of cyberbullying within the framework of Indonesian regulations, and how relevant is restorative justice as a model for resolving such cases? The method used is normative legal research with a legislative approach and case studies. Primary legal materials include the Child Protection Law, the Electronic Information and Transaction Law, the Criminal Code, and the Juvenile Criminal Justice System Law. Data was collected through literature studies and analysed using normative and comparative legal methods to test the effectiveness of applicable legal protection. The results of the study show that although legal regulations exist, the implementation of protection for victims is still weak due to normative gaps, low digital literacy, and a lack of understanding among law enforcement officials. These findings confirm the need for more specific regulatory reforms regarding cyberbullying, capacity building for officials, and the application of restorative justice to ensure the best interests of victims. The conclusion of this study is that legal protection for adolescent victims of cyberbullying must be directed towards the integration of preventive, repressive, and restorative approaches. Further research is recommended to explore the implementation of restorative justice in juvenile court practices and educational institutions as an effort to create a safer digital space.

Abstract

The level of information technology development has encouraged an increase in digital trade transactions through e-commerce platforms, one of which is Shopee. This phenomenon provides convenience for consumers, but it also raises serious issues in the form of criminal fraud and illegal trade that harm society. The urgency of this research lies in the increasing number of digital fraud cases that test the effectiveness of legal regulations, particularly the Consumer Protection Law and the Electronic Information and Transaction Law. This study aims to answer questions about the forms of criminal acts in digital transactions through Shopee and how legal protection is provided to consumers based on Indonesian positive law. This study uses a normative legal research design with a qualitative approach. Data was collected through a literature study, covering primary legal materials in the form of laws and court decisions, as well as secondary legal materials from academic literature. Two Supreme Court decisions, namely Decision Number 109 K/Pid.Sus/2024 and Number 951 K/Pid.Sus/2020, were used as case studies to assess the application of law in digital consumer protection. The analysis was conducted descriptively and analytically by interpreting legal norms and relating them to the context of practice. The results of the study show that digital transactions are prone to being exploited for criminal acts of subsidised price fraud and the distribution of prohibited goods. Legal protection through the UUPK and UU ITE still faces obstacles, particularly in terms of digital evidence, low consumer legal literacy, and limited online dispute resolution mechanisms. This study contributes to expanding the study of consumer protection law by integrating the perspectives of criminal law, cyber law, and jurisprudence. The conclusion of this study emphasises the need for regulatory updates, increased digital literacy, and strengthened obligations for e-commerce platforms to protect consumers. Further research is recommended to examine the effectiveness of electronic dispute resolution and the role of non-litigation institutions in digital consumer protection.

Abstract

The Bankruptcy and PKPU mechanism is the best debt moratorium at this moment because the creditor may estimate the debtor's ability to pay by looking at his good faith and the peace plan's debt moratorium. The surge in commercial court lawsuits and other economic repercussions led to the bankruptcy and PKPU moratorium, which is not the proper solution. If unsure, the moratorium can be reviewed. The moratorium on bankruptcy and PKPU cases is not an effective solution because bankruptcy institutions and PKPU were born from Law Number 37 of 2004, so the idea of a moratorium must go through a legislative process to be in sync with that law, which is difficult and takes a long time. Technically, this moratorium limits commercial courts' competence, requiring legislative and judicial responsibilities to be synchronized. Implementing it will generate several issues.
