Abstract

Artikel ini mengupas ide-ide tentang relasi suami-istri dalam rumah tangga yang dipaparkan oleh para khatib nikah di Surabaya. Penelitian dilakukan dengan model kualitatif bertumpu pada data primer berupa pernyataan verbal para khatib dalam moment akad nikah. Jumlah khatib sebagai partisipan penelitian ini ditentukan berdasarkan penetapan lokasi khutbah nikah, yaitu di dua masjid utama di Surabaya, Masjid Al-Akbar dan Masjid Al-Falah yang keseluruhannya berjumlah 12 orang. Pengambilan data dilakukan melalui dokumentasi khutbah, observasi, dan wawancara. Data yang terhimpun dianalisis menggunakan teknik fenomenologis. Temuan riset adalah bahwa para khatib nikah di Surabaya masih banyak yang mengeksplikasi pesan relasi suami-istri dalam kategori; a) bias gender sebanyak 42%; b) ambigu gender, sebanyak 25%, yaitu menyatakan relasi timbal-balik, namun memosisikan istri sebagai tangan kanan suami; c) netral gender yang mencapai sejumlah 8%; d) keadilan dan kesetaraan gender, yaitu 25% dengan kreteria memosisikan suami-istri secara equal. Perbedaan wawasan gender para khatib tersebut disebabkan oleh perbedaan latar belakang sosio-kultural. Khatib yang sudah berwawasan equal berlatar belakang sebagai dosen dan pejabat kementerian agama. Sedangkan yang masih bias berlatar belakang sebagai penceramah dan belum pernah mengikuti pendalaman tentang konsep gender.

Abstract

This research is based on the unregistered marriages phenomenon in Ketegan, Sepanjang, Sidorajo. Marriage is considered as an instant solution to juvenile delinquency, which has the potential to be promiscuous. There are two issues to be confirmed through this research: first, the attitude or response of the people in Ketegan to the practice of unregistered marriage that has taken place in their environment; Second, critical analysis of the phenomenon of unregistered Marriage on Islamic law’s perspective. This is field research, with a critical analysis method of data obtained. The data was collected through interviews with subjects, their parents, and several community leaders who had direct contact with them. This research found two conclusions: first, the people of Ketegan Village don’t seem to care about this kind of marriage. This is influenced by the variety of Ketegan people's mindsets and various tribes, majority of Madurese. However, peoples' view on unregistered marriages are mostly strained by problems threatening family honor. Second, The Islamic law analysis concludes unregistered marriage as illegal for not complying with the provisions of Law no. 1 of 1974 about marriage. This marriage potentially causes the rights and mate to be unfulfilled. In short, unregistered marriage has the potential to create injustice, contrary to the most fundamental principle of Islamic law, justice (al-'adālah). [Penelitian ini dilatarbelakangi oleh maraknya fenomena pernikahan sirri di kelurahan Ketegan, Sepanjang, Sidorajo. Pernikahan sirri dinilai sebagai solusi instan dari kenakalan remaja yang berpotensi kepada pergaulan bebas. Ada dua persoalan yang ingin dikonfirmasi melalui penelitian ini, yaitu tentang sikap atau respons masyarakat Ketegan terhadap praktik perkawinan sirri yang telah berlangsung di lingkungan mereka, dan analisis kritis terhadap fenomena pernikahan sirri dalam perspektif hukum Islam. Penelitian ini merupakan penelitian lapangan dengan metode analisis kritis terhadap data-data yang diperoleh. Pengumpulan datanya dilakukan melalui wawancara terhadap pelaku, orang tua dan beberapa tokoh masyarakat yang bersinggungan secara langsung dengan mereka. Kajian ini mendapati dua kesimpulan, pertama, masyarakat Kelurahan Ketegan tampaknya tidak begitu mempermasalahkan pernikahan sirri. Ini dipengaruhi oleh pola pikir masyarakat Kelurahan Ketegan yang cukup bervariasi dan merupakan masyarakat majemuk yang terdiri dari pelbagai daerah dan mayoritas suku Madura. Meskipun demikian, mereka umumnya berpandangan bahwa pelaku nikah sirri pasti dilatarbelakangi persoalan yang mengancam kehormatan keluarga. Kedua, analisis hukum Islam terhadap hukum pernikahan sirri menyimpulkan bahwa pernikahan sirri merupakan pernikahan illegal karena tidak mematuhi ketentuan Undang-undang no. 1 tahun 1974 tentang Perkawinan. Pernikahan macam ini berpotensi besar menimbulkan tidak terpenuhinya hak dan kewajiban pasangan suami istri. Singkatnya, pernikahan sirri berpotensi memunculkan kezaliman, yang secara jelas bertolak belakang dengan prinsip hukum Islam yang paling mendasar, yaitu prinsip adil (al ‘adālah).]

Abstract

This article examines sufistic moral teachings as a basis for building an Islamic counseling model to overcome the negative impacts of the digital era such as addiction to online gambling, pornography, etc. This study is using qualitative model. The main data is about the doctrine and practice of sufism and Islamic moral principles; about the negative impact of social media which damages personality. Data is taken from books, journal articles, and scientific works using documentation technique. The collected data was analyzed using analytical-synthetic thinking technique. The result is; first, the digital era which makes life easier, turns out to have negative psychological-spiritual impact. For example, being apathetic, anti-social etc. Second, sufis are credited with providing a path to purity of heart, thereby making the soul healthy and happy. Their spiritual practices are appropriate to be an alternative in bulding Islamic counseling stategies. Primarily, to deal with mental health problems as a negative impact of social media. Among others are; 1) fa’ali counseling in the form of practicing righteous deeds which is based on Wahb bin Munabbih's spiritual practices. The aim is to eliminate laziness; 2) counseling for ‘grave pilgrimage’ which was built from Abdullah al-Imari's spiritual experience. The practice is; someone intends to visit a cemetery to meditate; make oneself aware (contemplate/tafakkur-tadhakkur), take lessons from the grave phenomenon; dhikr and pray to get the strength to fill life in the world with good deeds; 3) khauf and raja’ energy-based ascetic counseling based on Hasan al-Basriy's spiritual experience.

Abstract

This article explains the zakat management pattern of the ʻāmil zakat of the Al-Wustho Mosque in Lampung. They developed an innovative, productive zakat model to empower the mosque community's economy. This empirical research relies on zakat management data excavated using in-depth interviews, documentation, and direct observation. The collected data was analyzed using analytical-synthetic thinking techniques, and as a result, it was found that the ʻāmil zakat of Al-Wustho mosque, Lampung, distributed zakat through the planning process; determination of mustaḥiq criteria and determination of mustaḥiq obligations after receiving productive zakat; implementation, determination of mustaḥiq that meets the requirements, transactional delivery of productive zakat between muzakkī and/or ʻāmil zakat and mustaḥiq based on mutually agreed provisions; After that, monitoring and evaluation were carried out, which resulted in a mustaḥiq performance report. With such a procedure, ʻāmil zakat in Lampung succeeded in improving the community's economy so that what was originally mustaḥiq then became muzakkī. The profits and benefits from the productive zakat capital from the muzakkī are partly donated to the mosque for the development and prosperity of the mosque's business, including the construction and expansion of the mosque, the cost of Friday prayers, free vegetable markets, and similar initiatives.
