Abstract

AbstractThis study aims to explore changes in community responses from initial support for development to changes in views along with the development of the Lombok International Airport project in Tanak Awu, Central Lombok. They used the descriptive-analytic method with qualitative research type and social conflict theory popularised by Karl Marx as an analytical scalpel. They conducted in-depth interviews with the community and village officials in Tanak Awu, Central Lombok. This research shows that the people of Tanak Awu initially supported the construction of BIL because it was expected to improve the economy and provide jobs. In addition, the government promised to provide compensation that would not harm the community. However, over time, there was a change in the community's response to the development of BIL. Some factors that led to this change included the non-fulfilment of promises made by the government, recognition of rights, and dissatisfaction with the compensation given. Ultimately, Tanak Awu residents felt pressured by state and customary law in the BIL development process, and despite activities to seek resolution through the judiciary, many community claims were defeated. Although initially supportive, some Tanak Awu community members now feel they have become mere spectators in the BIL development process.AbstrakPenelitian ini bertujuan untuk menggali perubahan respon masyarakat dari awal dukungan terhadap pembangunan hingga perubahan pandangan seiring dengan perkembangan proyek Bandara Internasional Lombok di Tanak Awu Lombok Tengah. Menggunakan metode deksriptif-analitik dengan jenis penelitian kualitatif dan teori konflik sosial yang dipopulerkan oleh Karl Marx sebagai pisau bedah analisis serta melakukan wawancara mendalam terhadap masyarakat dan aparatur desa di Tanak Awu, Lombok Tengah. Penelitian ini menunjukkan bahwa awalnya, masyarakat Tanak Awu mendukung pembangunan BIL karena diharapkan dapat meningkatkan perekonomian dan memberikan lapangan pekerjaan. Selain itu, terdapat janji dari pemerintah untuk memberikan ganti rugi yang tidak merugikan masyarakat. Namun, seiring berjalannya waktu, ada perubahan respon masyarakat terhadap pembangu­nan BIL. Beberapa faktor yang menyebabkan perubahan ini antara lain adalah tidak terpenuhinya janji yang diucapkan oleh pemerintah, pengakuan hak, dan ketidakpuasan terhadap besaran ganti rugi yang diberikan. Pada akhirnya, penduduk Tanak Awu merasa tertekan oleh hukum negara dan hukum adat dalam proses pembangunan BIL, dan meskipun ada aktivitas untuk mencari penyelesaian melalui badan peradilan, banyak gugatan masyarakat yang dikalahkan. Meskipun awalnya mendukung, beberapa anggota masyarakat Tanak Awu sekarang merasa bahwa mereka hanya menjadi penonton dalam proses pembangunan BIL.

Abstract

This article discusses inter-marga marriages in the Ende and Lio Tribe Communities. The people of the Ende and Lio tribes enforce inter-marga marriages in marriage. The focus of this research is why the people of the Ende and Lio tribes apply same-marga marriages in marriages. In this study, researchers utilized a concept of legal sociology initiated by Soerjono Soekanto to analyze the reasons for the emergence of legal practice in society. This study concludes that the emergence of the practice of same-clan marriage among the Ende and Lio people in Tanjung Village is closely related to their inheritance and lineage. If their children or grandchildren marry another clan, they are worried that the inheritance will be distributed to other clans or fall into other clans. This was not wanted by the ancient ancestors. the second is worried about lineage, if from a clan they marry with another clan then their lineage will disappear. This was not wanted by their previous ancestors, so that tradition is still being implemented today. [Artikel ini membahas mengenai perkawinan sesama Marga pada Masyarakat Suku Ende dan Lio. Masyarakat Suku Ende dan Lio memberlakukan perkawinan sesama Marga dalam perkawinan. Pusat perhatian pada penelitian ini ialah mengapa masyarakat Suku Ende dan Lio memberlakukan perkawinan sesama Marga dalam perkawinan. Pada penelitian ini, peneliti memanfaatkan suatu konsep sosiologi hukum yang dicetuskan oleh Soerjono Soekanto untuk menganalisis alasan dari lahirnya praktik hukum pada masyarakat. Penelitian ini menyimpulkan bahwa munculnya praktik perkawinan sesama marga pada masyarakat suku Ende dan Lio di Kelurahan Tanjung berhubungan erat dengan harta warisan dan nasab mereka. Jika dari anak-anak atau cucu mereka menikah dengan marga lain maka dikhawatirkan harta warisan tersebut akan dibagikan ke marga lain atau jatuh ke marga lain. Hal tersebut tidak diinginkan oleh nenek moyang terdahulu. yang kedua dikhawatirkan akan nasab, jika dari marga mereka nikah dengan marga lain maka akan hilang nasab mereka hal tersebut tidak diinginkan oleh nenek moyang mereka terdahulu, sehingga sampai sekarang tradisi tersebut masih diterapkan.]

Abstract

This article investigates violations of women’s rights stemming from the practice of kawin magrib, a form of forced marriage, within the Sasak Muslim community in Lombok, Indonesia. Despite its inherently gender-discriminatory nature, the kawin magrib tradition remains a fundamental aspect of Sasak Muslims’ identity and societal structure. Employing a socio-legal approach and conducting in-depth interviews with nine key informants, this study delves into the persistent reasons behind this tradition and its repercussions on women’s rights. The authors found that the primary objective of kawin magrib is to uphold the moral standards of the younger generation within religious norms. However, the profound adverse effects on women cannot be disregarded. This article highlights the severe psychological trauma endured by women due to this customary law and the potential for men to exploit this tradition deceptively, marrying women without genuine consent. Based on these findings, the article underscores the urgent necessity of reforming this practice, with a strong focus on safeguarding women’s rights and promoting gender equality.

Abstract

This study was conducted with the aim of determining criminal liability for the crime of vigilantism (eigenrichting) in criminal law in Indonesia. This study uses a qualitative approach with an orientation towards a deep understanding of the phenomenology of the crime of vigilantism and the form of criminal liability for the perpetrators. Data analysis in this study was conducted using a qualitative legal analysis approach. The results of this study indicate that criminal liability for the crime of vigilantism (eigenrichting) is still enforceable under Indonesian criminal law. Everyone who commits the crime will undergo sanctions and cannot be represented by another person. Criminal liability for the crime of vigilantism (eigenrichting) is indeed not regulated in a limitative manner in the laws and regulations, however in the law there are elements of a crime as stated in the Criminal Code (KUHP), namely in Section 351 concerning Abuse, Section 170 concerning Abuse and Section 406 concerning Destruction. Therefore the perpetrators of the crime of vigilantism can be subject to several Sections above.
