Abstract

Abstrak Studi ini mengkaji tentang pandangan fikih ekonomi kontemporer terkait tradisi pagang gadai di Kecamatan Lima Kaum Kabupaten Tanah Datar. Pokok permasalahan dalam penelitian ini ialah tradisi pagang gadai di Kecamatan Lima Kaum Kabupaten Tanah Datar. Teknik pengumpulan data dilakukan dengan cara wawancara dan membaca surat perjanjian pagang gadai. Kemudian teknik analisis data menggunakan Miles And Huberman yang terdiri dari reduksi, penyajian dan penarikan kesimpulan. Hasil penelitian ada dua. Pertama, pihak pertama yang merupakan pemilik objek gadai tidak keberatan, jika lahan yang digadaikannya dikelola oleh pihak kedua. Kedua, personil yang terlibat dalam ijab-qabul adalah rahin dan murtahin, saksi, serta mamak kaum. Dengan demikian menurut pandangan fikih ekonomi kontemporer implementasi akad rahn dalam tradisi pagang gadai di Lima Kaum sudah sesuai dengan rukun dan syarat gadai Kata Kunci: Akad, ar-rahn, pagang gadai Abstract This study examines the views of contemporary economic jurisprudence regarding the pagang pawn tradition in Lima Kaum District, Tanah Datar Regency. The main problem in this research is the pawn pawn tradition in Lima Kaum District, Tanah Datar Regency. Data collection techniques were carried out by means of interviews and reading pawnshop agreement letters. Then the data analysis technique uses Miles and Huberman which consists of reduction, presentation and drawing conclusions. There are two research results. Firstly, the first party who is the owner of the pawned object has no objection if the land being pawned is managed by the second party. Second, the personnel involved in the ijab-qabul are the rahin and murtahin, witnesses, and mamak people. Thus, according to the view of contemporary economic jurisprudence, the implementation of the contractrahn in the tradition of pawning in Lima Kaum, it is in accordance with the rules and conditions of pawning. Abstract

This study aimed to examine the strategic role of customary institution in resolving social conflicts in Indonesia through mediation at Tanjungpinang Malay Customary Institution (TMCI). The mediation process was discussed, detailing the reason for selecting TMCI as a mediator, and the role in social conflict theory and normative law. Data were obtained through interviews, observations, and documentation, and literature studies were analyzed using the Miles and Huberman model. The results showed that mediation was implemented systematically and hierarchically by adhering to Malay customs based on Islamic teachings. Furthermore, the community respected and trusted TMCI as a customary institution capable of resolving social conflicts. It also played a strategic role as a party that participated in resolving customary and cultural conflicts and implementing social changes to ensure integration or cohesion. Mediation by TMCI showed that conflict was part of society with groups engaged in both realistic and non-realistic disputes. These groups then integrated and reached a consensus to maintain social cohesion. Regarding normative law, mediation by TMCI was justifiable in Islamic and positive laws.

Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab pengangguran kaum terdidik, dan solusi untuk mengatasi pengangguran kaum terdidik di Kecamatan Silaut. Pokok permasalahan dalam penelitian ini pemicu penyebab pengangguran kaum terdidik di Kecamatan Silaut. Jenis penelitian ini merupahkan penelitian lapangan dengan pendekatan deskriptif kualitatif. Hasil penelitian menemukan bahwa faktor-faktor penyebab pengangguran pada kaum terdidik di Kecamatan Silaut Kabupaten Pesisir Selatan meliputi, jumlah perusahaan maupun kantor sedikit, terbatasnya informasi lowongan kerja, jiwa wirausaha rendah, peluang usaha rendah, gaji sedikit, tidak mempunyai peralatan kerja, serta jaringan kerja sedikit. Setelah dibahas, investasi syariah dan bantuan konsultan dapat digunakan untuk mengatasi pengangguran kaum terdidik di Kecamatan Silaut. Caranya para pejabat kecamatan bekerjasama dengan pejabat nagari membentuk tim khusus yang bertugas menarik investasi sebagaimana Kementerian Investasi pada pemerintah pusat. Tim khusus investasi diberikan tugas untuk mengajak orang kaya Silaut maupun orang kaya di luar Silaut untuk membangun perusahaan dan kantor. Untuk anggaran memfasilitasi investasi tersebut gunakan saja anggaran pemerintah kecamatan, dan anggaran pemerintah nagari terlebih dahulu. Kemudian cara lain menjadikan Profesor kampus Unand sebagai kampus terdekat menjadi konsultan pangan di perusahaan pangan yang akan berdiri nantinya. Anggaran yang digunakan untuk membayar Profesor tersebut gunakan saja terlebih dahulu anggaran kecamatan, anggaran Bumnag, dan ditambah dengan anggaran nagari.

Abstract

This study aims to analyze the effect of motivation, discipline and leadership on the performance of employees of the Dukcapil Service of Tanah Datar Regency which is mediated by organizational culture variables. This type of research is field research with a quantitative approach. The data collection technique used in this research is a questionnaire. The sample used in this study was 33 respondents with total sampling technique. The data analysis technique used is Path analysis. The results showed that motivation and leadership had no effect on organizational culture but discipline had an effect on organizational culture. Motivation has no effect on employee performance while discipline, leadership and organizational culture affect employee performance. Motivation, discipline and leadership have no effect on employee performance through organizational culture. Organizational culture as an intervening variable is not able to mediate the variables of motivation, discipline and leadership so that these three variables have a direct influence on the performance of employees of the Dukcapil Office of Tanah Datar Regency..
