Abstract

Abstract— Recently, in response to the credit crunch and the increased costs of financing, new solutions for supporting the financial management of supply chains, known as supply chain finance (SCF), have been developed. The purpose of this research is to analyze how the dispute raised from the situations faced by people who involved in fintech peer to peer lending can be solved in fairness. The methodology used in this research are statute approach, conceptual approach, and comparison dispute settlement among Australia and Indonesia through law case study. According to the Indonesian Law as it is stated in BW (Civil Code for Indonesia), companies can settle their loan disputes by filing a lawsuit to the district court. This method is less effective because it is time consuming and costly, while it is not worth with the nominal value of the loan which is not that much. This situation leads to a demand of a faster, simpler and low-cost solution that can be accessed online. This method is called as small claim court method. This method is considerably new and basically is a simplified procedure of the existing dispute settlement. A strong note on this method is its weakness when the disputes happen cross-border. This aspect needs to be improved in many ways considering the current method is only applicable when the parties have the same judicial territory. Hopefully, the information technology strongly supports the task of the judiciary in order to enforce law and legal justice through the application of Electronic Court (e-court) which is in line with the principle of simple, fast and low cost of justice. Vice versa, fintech lending dispute resolution requires procedural law that can compensate for the technology that is developing rapidly. The information technology management referred to information management policies, institutional information management institutional arrangements, and electronic system structuring at the Supreme Court.

Abstract

Simple procedures and quick service on fintech lending gives an ease for fulfilling capital needs. Indeed, it does not require any collateral which may constrain debtors to deal with it. However, although this activity brings convenience, efficiency, quickness, and simplicity in lending services, many possible risks such as debtors’ delayed payment or even default which may burden the creditors are likely to follow as well. Without any collateral as assurance, the risks may become much higher on fintech lending as the creditor becomes a concurrent creditor who only has relatively individual rights whose position is equal to the other creditors, no droit de suite principle, and the claim is individual with general assurance.

Abstract

Al-Fashdu therapy is an Islamic-based alternative treatment that is one of the community's options for dealing with health problems. In addition to reducing disease, this therapy is inexpensive because it does not use chemical drugs. This Community Service aims to introduce treatment using the Al-Fashdu method to residents of RT 06 RW 05, Perum Lembah Harapan, Lidah Wetan Village, Lakarsantri District, Surabaya City. Residents of RT 06 mostly complain of various illnesses and have to consume a lot of chemical drugs, but chemical drugs also cause complaints of pain in other body organs. The method of implementing this community service program uses application, training, and assistance on how to do Al-Fasdhu therapy. The training was attended by more than 75 partners, with an average age of 50 years and over. After being treated with Al-Fashdu therapy, the next activity is to provide Al-Fashdu therapy training to the community with the aim of being able to carry out Al-Fashdu therapy independently. As a result of this community service activity, many residents feel their bodies are healthier and are able to independently apply Al-Fashdu therapy.

Abstract

The aim of this research is to analyze digital marketing strategies through TikTok social media in increasing sales of online shop products at ETHICA.official Surabaya. This research is field research with a qualitative descriptive approach, the data used is primary data and secondary data. With data collection techniques in the form of interviews, observation, questionnaires and documentation. The population used was 6 ETHICA.official Surabaya managers. and the sample to see consumer responses was 47 people with indicators of respondents who had made purchases in the last month. The results of this research are advertising using Tik Tok social media, sales promotions using discounts or price reductions, premiums or gifts, trade shows, coupons or vouchers, and product guarantees. Publicity in the form of the SFS (shotout for shotout) community and also cross-promotion between fellow online shop businesses. With this concept, ETHICA.official Surabaya's sales are able to increase every year. The promotional activities carried out by ETHICA.official Surabaya are also appropriate so that consumers do not need to be afraid of being deceived in transactions with ETHICA.official Surabaya because the basic business of ETHICA.official Surabaya is an online shop because of the availability of the ETHICA.official Surabaya store. Turi Market, 3rd Floor Surabaya, Surabaya City, East Java. Apart from that, the sales implementation of ETHICA.official Surabaya is honest and avoids false promotions, does not hide defects in goods and keeps promises.

Abstract

This study aims to determine the effect of perceived usefulness and ease of use on the intention to use Zahir Accounting software for students of the Faculty of Economics, University of Yos Soedarso. This study used a purposive sampling technique and data analysis techniques using Structural Equation Modeling – Statistical Program for Social Science (SEM-SPSS). This study used data collection techniques using questionnaires distributed to students who use Zahir Accounting software at the Faculty of Economics, University of Yos Soedarso with a sample size of 35 students. The results of this study prove that perceived usefulness and convenience have a positive and significant effect on usability intentions.

Abstract

One of the accesses to funding for MSMEs is by inclusive financing which conducted through the collaboration between conventional commercial banks (BUK) and rural credit banks (BPR) with executing, channeling and joint financing schemes. The MSMEs Credit Banking Cooperation (KPKU) between BUK and BPR aims to be mutually beneficial with the ultimate goal is for more financed MSMEs by banks. For BPRs that have limited funds, the KPKU is the main alternative source of funds apart from savings and time deposits. The executing, channeling and co-financing schemes have different characters, especially to parties that dividing the funds to MSMEs debtors and parties who bear the risk due to non-payment funds that have been distributed to MSMEs. This research is a normative research using statutory and conceptual approach. This research concludes that there are three schemes have different characteristics, especially regarding to the parties that distributed the funds to MSME debtors and parties who guarantee the risk due to MSME debtors defaulting.

Abstract

Sharia banking has been challenged to create sustainable human resource management that meets Islamic principles. The need for inclusive talent management is becoming increasingly important to support operational sustainability and fairness within the organization. Therefore, this research is conducted to examine inclusive talent development as a key aspect of talent management for achieving sustainable human resources in Sharia banking practices. This research uses a qualitative case study method, with the findings presented as propositions. Data was collected through interviews and document analysis. The research shows that inclusive talent development not only helps individuals grow but also plays a key role in keeping talent within the organization. This includes identifying talent, developing technical and general skills, and using retention strategies like clear career paths, promotions, and fair compensation based on position. These findings highlight a strategic approach to sustainable HR management in sharia banking, where talent development fosters a supportive, inspiring work environment that helps retain employees and ensures long-term success for the organization.

Abstract

One of the fundamental principles underlying financing in sharia banks is the principle of profit sharing, specifically in mudharabah and musyarakah contracts. These financing schemes are characterized by the sharing of business profits and losses. However, the term “debt” appears in the clauses of mudharabah and musyarakah financing contracts in sharia banks and in several Religious Court decisions. In fact, financing based on the profit-sharing principle constitutes a partnership between capital and labor, not a debt or credit contract. Therefore, in mudharabah financing, if a loss occurs that is not due to the negligence of the capital manager (mudharib), it is borne by the capital owner (shahibul maal), whereas in musyarakah financing, losses are borne jointly. This study examines the issue of debt in financing based on the profit-sharing principle. The approaches employed include statutory, conceptual, and case law analysis. The term “debt” in this context refers to an outstanding obligation in the form of financing capital and the profit-sharing portion derived from the ongoing business income of the mudharib, which is the rightful share of the shahibul maal. However, the profit-sharing portion from a business that has ceased operations is not considered a debt that the mudharib is obligated to repay to the shahibul maal.

Abstract

Penelitian ini bertujuan untuk menganalisa keberadaan penjamin kredit yang menjadi solusi akhir bagi nasabah UKM yang kesulitan mendapatkan akses pendanaan di layanan perbankan. Kasus ini muncul karena ketidakmampuan menyediakan jaminan, lemahnya kemampuan dalam mengelola usaha, terbatasnya kualitas sumber daya manusia dan kurangnya kualitas administrasi. Penelitian ini merupakan penelitian hukum normative yang bersifat kritis dengan menggunakan sumber-sumber hukum dan pendekatan konseptual untuk mengtahui fenomena-fenomena terkait jaminan kredit berdasarkan hukum yang berlaku yaitu Burgerlijk Wetboek, Undang-Undang Jaminan dan Peraturan Pelaksanannya. Hasil dari penelitian ini menunjukkan bahwa jaminan kredit membuat perbankan berani memberikan kredit Kepada nasabah UKM untuk mendapatkan kredit tanpa agunan. Apabila nasabah UKM mengalami kredit macet, maka lembaga penjaminan akan melakukan pembayaran atas tunggakan yang dialami nasabah UKM. Dapat dikatakan bahwa keberadaan penjaminan kredit oleh lembaga penjaminan telah menurunkan risiko kredit UKM yang berhadapan dengan perbankan, sehingga masalah akses pendanaan perbankan untuk UKM dapat teratasi.
