Abstract

Abstract

The Covid-19 Pandemic affects many sectors. Therefore, the Indonesian Government passed the Presidential Regulation Number 12 of 2020 to manage the Pandemic. Unfortunately, this regulation has evoked various interpretations on the disaster contingency as a foundation to apply force majeure condition. The Government’s policies of budget refocusing and reallocation to manage the Covid-19 Pandemic have brought significant effects on goods and services procurement contracts. This condition may lead the Government into default, and it is force majeure. Therefore, the Government is discharged from any liabilities. Consequently, it may injure contractors of procurement. This study aims to investigate the actuality of such procurement contracts following the Presidential Regulation. This study is a normative law research. Based on the Presidential Regulation, the force majeure condition is likely to be applied on procurement contracts. However, the condition does not immediately nullify or terminate the contracts. They remain legally valid and binding. In case of a condition permanently prevents debtor to fulfill obligations, contract can be terminated. In case of a condition temporarily prevents the contract’s implementation, the best solution to encourage conducive business climate is renegotiation that is legalized by contract addendum.

The issue will be discussed normatively juridically through the statute approach, conceptual approach, and comparative approach with Malaysia, Australia, and Netherland as the comparative country. From this research, it can be concluded that the capability of doctors as mediators of medical disputes lies in the gravity levels of doctors who are commensurate with the context of the dispute. Malaysia, Australia, and the Netherlands have required that mediators need to have an understanding of the substance and have technical knowledge of the problem at hand. A doctor’s impartiality as a mediator in medical disputes will have a tendency of partisanship and conflicts of interest. Keywords: Capability, Impartiality, Doctor, Mediator, Medical Dispute

Abstract

The exenoration clause is an exclusion / liability exclusion clause in a housing sale and purchase agreement. The purpose of writing this scientific article is to find out the accountability of business actors for offers submitted to prospective consumers and restrictions on the inclusion of standard clauses containing exenoration clauses in the offer of buying and selling houses as a legal protection effort for consumers. The results of the study indicate that the treaty law in Indonesia essentially assumes that brochures have binding legal force. This binding strength is based on the fact that the brochure is a binding form of supply as specified in the Consumer Protection Act which is based on the principle of good faith at the pre-contractual stage. Judging from the freedom of contract the standard agreement with an exoneration clause does not meet the subjective and objective requirements as specified in Article 1320 BW, thus the exoneration clause stated by the business actor in the brochure as a bidding instrument does not have binding power. Provisions for transferring accountability, actions in the form of business actors are not responsible for changes in specifications contained in brochures violating Article 18 paragraph (1) letters a, c, and d of Consumer Protection Act. And has an effect on null and void (nietig / null and void).

Abstract

Simple procedures and quick service on fintech lending gives an ease for fulfilling capital needs. Indeed, it does not require any collateral which may constrain debtors to deal with it. However, although this activity brings convenience, efficiency, quickness, and simplicity in lending services, many possible risks such as debtors’ delayed payment or even default which may burden the creditors are likely to follow as well. Without any collateral as assurance, the risks may become much higher on fintech lending as the creditor becomes a concurrent creditor who only has relatively individual rights whose position is equal to the other creditors, no droit de suite principle, and the claim is individual with general assurance.
