Abstract

One of the main pillars of democratic governance is the implementation of general elections (Elections), the Election Organization involves at least 3 (three) important actors who interact with each other, namely Election Contestants, Election organizers and citizens who hold the right to vote (Voters). In its interactive relationship in the stages of the Election process, there can be a hormonal relationship or a conflict relationship. The enactment of Law number 7 of 2017 concerning General Elections as the basis for holding simultaneous Elections in 2019. Giving authority to Bawaslu, Provincial Bawaslu and Regency / City Bawaslu in resolving disputes in the Election process, due to the issuance of KPU, provincial KPU or regency / city KPU decisions. The Bawaslu Decision is final and binding except relating to 3 (three) matters, namely verification of the Election Contesting political parties, determination of the permanent candidate list for DPR, DPD, provincial and regency / city DPRD candidates and Candidate Pairs. The Election Supervisory Body's decision in resolving election disputes is almost the same as other judicial institutions, this is seen from the character of the Election Supervisory Body's final and binding decision, the substance of the decision is almost the same as the judiciary and procedural aspects of the electoral process dispute through the trial mechanism. Seeing the legal construction of judicial authority, Bawaslu is not a judicial body, because it does not belong to the judiciary under the Supreme Court, the Constitutional Court and is not included in the special court. The authority of the PTUN in dispute over the election process can only be done, if administrative efforts to Bawaslu have been made and the decision is final and binding and no other legal efforts can be made. However, the Election Law does not mention sanctions for those who do not follow up on PTUN decisions, this can be seen in the case of Oesman Sapta Odang, the KPU finally chose to follow the Court's Decision more.

Abstract

The authority for the formation of Regional Regulations is regulated in Article 18 paragraph (6) of the 1945 Constitution of the Republic of Indonesia. The phrase content material accommodates the special conditions of regions for one of the material charges in Regional Regulations regulated in Article 14 of Law Number 12 of 2011 concerning Formation of Regulations Legislation. Abstract

Tanah merupakan wadah dalam pelaksanaan pembangunan berkelanjutan, khususnya dipergunakan untuk perkembangan perekonomian seperti pembangunan Rumah Sakit, Perkantoran, Hotel dan lain-lain sebagainya. Namun, permintaan tanah tersebut tidak sebanding dengan ketersediaan tanah yang ada. Untuk mengatasi permasalahan tersebut, maka pemerintah mengatasinya dengan mengubah wilayah pantai menjadi daratan baru sehingga dapat ditempati dan dapat dipergunakan untuk pelaksanaan pembangunan. Upaya demikian disebut dengan “Reklamasi”. Pada penelitian ini menggunakan jenis penelitian hukum normatif yaitu penelitian yang mengkaji melalui studi dokumen seperti berbagai bahan hukum primer berupa peraturan perundang-undangan, teori-teori hukum dan dapat pula pendapat dari para sarjana. Hasil penelitian menunjukan bahwa regulasi dan ketentuan terkait prinsip-prinsip Hak Guna Bangunan di atas Hak Pengelolaan pada tanah reklamasi dilaksanakan oleh Perusahaan swasta, pemerintah kabupaten/kota, BUMN, kerjasama antara perusahaan swasta dengan pemerintah kabupaten/kota dan kerjasama anatar perusahaan swasta dengan BUMN, dalam tenggat waktu selama 30 tahun dan dapat diperpanjang selama 25 tahun dan dapat diperbaharui selama 20 tahun.

Abstract

Hak pengelolaan tanah yakni hak yang memberi masyarakat dan badan hukum kemampuan untuk melakukan sebagian penguasaan atas sebidang tanah yang terletak di bawah yurisdiksi negara. Adapun Hak pengelolaan bisa ditarik kembali dan dicabut apabila negara perlu memakai tanahnya untuk pembangunan untuk kepentingan umum. Subyek yang terkait dengan hak pengelolaan meliputi instansi pemerintah, badan usaha milik negara/daerah (BUMN/BUMD), otoritas, serta badan hukum pemerintah lainnya yang diberi kuasa oleh negara untuk mengelola tanah milik negara. Tata cara Pemberian dan Pembatalan Hak Atas Tanah Negara dan Hak Pengelolaan diatur dalam Peraturan Nomor 9 Tahun 1999 yang dikeluarkan oleh Menteri Agraria/Kepala Badan Pertanahan Nasional. Dengan memakai teknik penelitian jenis hukum normatif yang bersandar pada ketentuan perundang-undangan dan bahan bacaan yang terpercaya, hak pengelolaan diartikan sebagai hak yang dimiliki oleh seseorang untuk menguasai suatu objek Negara, karena kewenangan dalam pelaksanaannya sudah dilimpahkan kepada pemegang hak atas objek tersebut.Kata kunci: Hak Pengelolaan, Pembebasan Tanah, Perlindungan Hukum

Abstract

In the 1945 constitution it is stated that control over land is regulated by the state, thus all processes related to land, the state has a big role to play. The state has the highest legal authority in this matter. On the other hand, the customary community groups who inherit their lands also have a customary law system that regulates the issue of land ownership. Investors as shareholders in large-scale businesses do not dare to invest with such a land ownership pattern so that a regulation is needed that can guarantee the ownership status of these lands during the exploitation process. The government then formulated several legal regulations related to this matter. The core problem in this journal is how legal certainty is on lands that have been granted permits by the state for investment by companies and how certainty is in returning these lands to indigenous peoples. The purpose of this study is to explain the legal certainty of the land. The method used is a normative legal research method by examining the law and related regulations. The results found are that the state provides a strong guarantee for the return of community lands used for investment and the guarantee is contained in the basic national agrarian laws and regulations

Abstract

The purpose of the study. Revealing the legal protection of football players as workers in the football "industry" and as a worker / laborer for a club, so that the Manpower Law can be applied. Materials and methods. This research uses a juridical-normative approach which is expected to provide more understanding to the players in the world of sports, especially in the field of football in Indonesia. Results. The fact is that soccer players, as workers or laborers, still have not got the rights they should receive, and also most of them still do not understand or do not really understand the contents of the contracts they have signed. Conclusions. A bright spot where PSSI as the parent of national football has made changes by forming the NDRC where its task is to resolve disputes between players and football clubs.

Abstract

Letter C and Petok D books, although after the enactment of the UUPA are no longer evidence of land management, PP article 24 no. Article 24 of the Law (1997) further regulates the recognition of the necessity to record land rights as old written evidence. The problem is how the relationship between case decision 190/Pdt.G/2005/PN.Sby with decision no. 94/PDT/2007/PT.SBY with decision No. 2340 K/PDT/2008 with decision No. 233 PK/Pdt/2011 and how the legal status of buyers of land rights petok d. is not eligible. The study used as treatment is a normative legal study based on principles and concepts. Obtained the following research results: Land rights with letter C and Petok D are allowed according to Article 39 of PP. 24 of 1997, but if the letter C and Petok D book are tampered with by changing the name written in it, then it is a prohibited act, and the judge in his opinion canceled the letter C and Petok D book with evidence. Letter C and Book Petok D A seller who does not have the right to sell it and has it canceled by a court judge, can sue the seller on the grounds that he has committed an unlawful act.

Abstract

Obtaining legal certainty over land is a right of every citizen, and numerous cases of document forgery have plagued the ranks of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN). To resolve land disputes, strategic policies are needed with the aim of providing legal certainty and justice regarding the control, ownership, use, and utilization of land. Resolution is carried out based on the ministry's initiative or complaints from the public to the relevant ministry. Coordination between the ministry and the Regency/Municipal Land Office is essential to collect data, conduct analysis, and provide recommendations for case resolution. Land certificates may be annulled due to administrative reasons and miscalculations of land area. The annulment of certificates can be executed through a court decision or by the Ministry of ATR/BPN. In certificate annulment, the contrarius actus principle is applied, meaning that the administrative body or official that issued the decision also has the authority to revoke it. The annulment of legal products is conducted if there is an administrative and/or legal defect as stipulated in Article 35 of the Ministerial Regulation of ATR/Head of BPN No. 21/2020. In administrative law, the Ministry of ATR/BPN plays a crucial role in determining the authority of officials and ensuring legal certainty.

Abstract

The background of this writing is the problem that arises because of the high level of work accidents and many industrial companies who are negligent because they do not meet the factors to protect workers in the protection of occupational safety and health. Based on this, it is necessary to know the extent of the role of the Mojokerto Regency Manpower Office in the protection of occupational safety and health based on article 13 paragraph 2 letter d of the Mojokerto Regent Regulation Number 63 Year 2016 by the Mojokerto Regency Manpower Office, where to answer the above problems, then using this type of research empirical juridical law. As well as using a qualitative approach and using descriptive analysis techniques. The results showed that the reporting and supervision process was still lacking, where the monitoring process was not according to schedule. To support the performance of labor inspectors so that they can run more effectively, the solution is to increase the number of supervisory employees.
