Abstract

Pendidikan karakter telah ada sejak pendidikan itu lahir namun fakta sekarang ini kemerosotan moral menjadi permasalahan bahkan diseluruh belahan dunia. Adapun Pondok Pesantren Syaikh Zainuddin mendidik karakter salah satunya melalui tradisi berdoanya yang khas yang terus menerus diwariskan. Penelitian ini bertujuan untuk mengetahui penerapan pendidikan karakter melalui tradisi berdoa dan nilai-nilai karakter dalam tradisi berdoa.  Metode penelitian ini jenis kualitatif metode studi kasus, perolehan data melalui teknik observasi, dokumentasi, dan wawancara. Teknik analisis data menggunakan prinsip Miles dan Huberman yaitu data collection, data display, data condensation, dan conclusion drawing/verification. Hasil dari penelitian ini adalah (1) pendidikan karakter melalui tradisi berdoa di Pondok Pesantren Syaikh Zainuddin Nahdlatul Wathan dengan penggunaan buku doa khusus susunan Maulanassyaikh, pelaksanaan berdoa dikaitkan dengan program, penggunaan teknis dalam berdoa, pelaksanaan doa berjamaah dan doa mandiri, serta memberikan bimbingan dzikir dan doa terhadap peserta didik. (2) terdapat 12 nilai karkater dalam tradisi berdoa di pondok pesantren syaikh zainuddin yaitu: Religius, jujur, disiplin, kerja keras, mandiri, demokratis, rasa ingin tahu, semangat kebangsaan, cinta tanah air, menghargai prestasi, gemar membaca, dan tanggung jawab. Adapun yang paling dominan dari 12 nilai karakter tersebut adalah nilai religius.

Abstract

This research aims to explore and analyze the concepts of Islamic educational philosophy contained in the work "Testament of New Experience Reflection" by TGKH. Muhammad Zainuddin Abdul Madjid. In this study, the author conducts a profound analysis of the content of the work, identifying the values, principles, and concepts of Islamic education that can be found in the text. The research also explores the historical and cultural context in which the work was written and the relevance of the concepts found in the work to contemporary Islamic education. This research employs a philosophical approach and critical analysis to understand and evaluate the thinking of TGKH. Muhammad Zainuddin Abdul Madjid in the context of Islamic education. The results of this research can provide profound insights into the philosophy of Islamic education within the work and the contributions of the thinker to Islamic educational thought. This research is expected to contribute to a deeper understanding of Islamic education, moral values, ethics, educational goals, and methods within the context of Islam, as well as the relevance of the ideas of TGKH. Muhammad Zainuddin Abdul Madjid to contemporary Islamic education. Furthermore, this research serves as a foundation for further studies on Islamic educational thought in Indonesia.

Abstract

Because the world's atmosphere recently has deep moral instability, the desire to reach the century of ethics instead becomes a century of minus ethics. Even though the Islamic ummah has a role model in terms of ethics and morals, namely the figure of the Prophet Muhammad SAW, it becomes a necessity for every Muslim to know him through Shirah An-Nabawiyah, which is beautifully explained in the monumental writing Ar-Rahīqu Al-Makhtūm by the great scholar Syakh Shafy AlRahmān AlMubārakfūrī. The purpose of this study is to examine how Rasulullah SAW developed the thought of moral education contained in the book Ar-Rahīqu Al-Makhtūm by Sheikh Shafy Al-Rahmān Al-Mubārakfūrī. The method used in this study is the library research method with documentation techniques, while the analysis uses content analysis and historical analysis. The results of the study show that there is a moral education that the Prophet SAW developed in the book Ar-Rahīqu Al-Makhtūm by Syekh Shafy Al-Rahmān Al-Mubārakfūrī, namely Rabbāniyah, Insāniyah, and Syumūliyah. The Rabbāniyah or religious dimension is by maintaining human relations with God, namely reviving faith and enlivening makhdhah worship. The Insāniyah dimension includes honesty (shiddiq), responsibility, discipline, hard work, creativity/innovation, independence (i'timad), curiosity (research), and reading/literacy. While Syumuliyah: achievement, democracy, social concern, friendship/loyal friends. Of the three aspects of moral education, the Rabbāniyah dimension is the most dominant of the other dimensions, showing that the human relationship with God is the top priority.

Abstract

Domestic Violence (a.k.a KDRT) has been identified as a form of crime that falls into the category of "hidden crime". Handling through the conventional criminal justice system often faces serious obstacles, especially because victims often experience deep trauma. In addition, when these cases are presented in court, the justice obtained is often unsatisfactory for both the perpetrator and the victim. As an alternative, the Restorative Justice approach emerged as an attempt to provide a more holistic solution. Restorative justice focuses on returning losses to victims, improving the perpetrator's behavior, and providing opportunities for perpetrators to reintegrate into society without experiencing stereotypes. In the Indonesian context, this research aims to explore more deeply the implementation of restorative justice, including its legal basis, procedures, and carry out analysis using the concept of legal pluralism proposed by Werner Menski. This research is normative juridical in nature, with data collection carried out through documentation studies and interviews. Research findings show that the implementation of restorative justice in Indonesia is supported by a strong legal foundation. However, there are still obstacles in accommodating the three elements of legal pluralism proposed by Menski. In other words, even though restorative justice has been formally recognized, its implementation still needs to be improved to more effectively achieve the desired restorative goals.

Abstract

During the royal era, it was common for marriages to require both partners to come from the nobility. This practice could be based on access to education and aspects of life worth that were more available to the nobility. So, a nobleman's marriage must be with a nobleman to get pure offspring. As in Indonesia, women with noble status are "pressured" according to unwritten rules to marry men from noble circles. This may be caused by the patriarchal system that regulates a person's nasab or lineage. Interestingly, the status of nobility has shifted and is no longer legitimized from aspects of life worthiness in the form of education, wealth, moral security, and position. This research uses the library research method, where researchers use literature materials such as books, articles, journals, magazines, and verses in the holy Koran related to this research. This research concludes that the jurists agree that the priority in kafa'ah is religion because religion is the axis for marriage, which brings the household to an eternal and harmonious ship. Nobility as a measure of kafa'ah has less and less relevance in the modern era; for some groups, this criterion is not the main thing. Even though it has a long history, and certain values attached to it, this criterion is no longer a priority when choosing a partner.

Abstract

10-60% of married women in various parts of the world have experienced domestic violence, including Indonesia, which is a taboo for society and the government. Therefore, this study will explain the role of family law in dealing with KDRT. The research method used is Qualitative with a Library Study approach by collecting data from various sources, such as laws, journals, articles, and books. Data is analyzed by identifying existing patterns and trends, and presenting findings that are relevant to the topic discussed. The results of this study explain that the role of Islamic family law in preventing domestic violence can be in the form of clarity of the rights and obligations of husband and wife, the age limit for marriage and the existence of a marriage agreement to emphasize the rules that apply in a marriage.

Abstract

Background: Islamic law exists in a fluid and contentious realm inside modern Muslim-majority states, where its application embodies both theological beliefs and sociopolitical frameworks, as well as cultural perceptions. Purpose: This study seeks to evaluate the sociological elements affecting the implementation of Islamic law in Indonesia, Brunei Darussalam, and Saudi Arabia, emphasizing the roles of legal pluralism, state ideology, and religious authority in its enforcement Methods: The study employs a qualitative-comparative methodology, utilizing document analysis and secondary data review to examine the historical evolution, legal frameworks, and sociocultural contexts that support Islamic law in the three nations Results: The findings indicate that Brunei and Saudi Arabia implement Islamic law inside monarchical and theocratic structures, but Indonesia reconciles Islamic principles within a pluralistic legal framework shaped by democracy, adat, and secular constitutionalism Implication: This article theoretically enhances Islamic legal scholarship by contextualizing Islamic law within sociological and reception-focused frameworks, demonstrating that its legitimacy arises from intricate interactions among tradition, state, and society. The research provides insights for policymakers to formulate context-specific legal reforms that take into account normative Islamic ideals and varied sociocultural situations. Originality: Sociological perspective and cross-regional analysis, which transforms the discussion of Islamic law from strict doctrinarism to fluid social practice within the worldwide Muslim community

Abstract

The purpose of this research is to study the perception of Islamic society towards the inheritance of girls in the Central Lombok Regency . This type of research is empirical law. The sample in this study tested by means of sampling. The results showed that Sasak girls who are Muslims are heirs and get a share of inheritance in the form of movable or immovable property. Before the community was familiar with Islam with the division of inheritance to girls still related to cultural customs, girls were only entitled to inheritance in the form of movable property in the form of agricultural and livestock products
