Abstract

Several laws and regulations in Indonesia govern the wage rights of workers in insolvent companies. However, there is a lack of coordination among these regulations, which affects their effectiveness. This research examines the impact of bankruptcy on worker protection within the framework of social justice principles. Utilizing normative legal research with a conceptual approach, the study reveals that bankruptcy often disadvantages employees, who are frequently placed at the end of the creditor hierarchy during the distribution of bankrupt assets. Despite the existence of various laws designed to protect laborers' rights, there is considerable overlap and inconsistency among them. Therefore, it is essential to clarify the status of employees in bankrupt companies and harmonize relevant regulations to ensure fair compensation for workers. The research also includes comparative examples from different countries. The prioritization of employee claims in insolvency cases varies according to each country's legal framework and social security system. For instance, Germany, the United Kingdom, and France exhibit significant differences in their approaches to pay priorities. These differences highlight the complex interaction between statutory priorities, social security systems, and cultural attitudes towards labor rights, which collectively influence the respective pay priority frameworks of these countries. The findings underscore the need to ensure equitable treatment of employees within global economic systems while balancing competitiveness with labor rights.

Abstract

This study aims to identify the factors contributing to the legal protection of workers' wage rights in bankrupt companies in China, focusing on aspects that have not been grounded in social justice. This research is also to formulate and form a legal protection model for workers' wage rights in bankrupt companies based on social justice in Indonesia and China. This research is empirical. The research data is in the form of primary and secondary data (primary and secondary legal materials). The study results show that the factors that cause legal protection of workers' wage rights in bankrupt companies are not based on social justice and are the legal substance factor, namely the legal norms governing workers' wage rights and other rights. When a company goes bankrupt, there is non-uniformity in the priority hierarchy of creditors in the Bankruptcy Law, General Provisions on Tax Implementation Procedures, and Labor Laws. Another factor is the legal and structural factor, which only involves the trustee and supervisory judges in the settlement of bankrupt assets. The last factor is the legal culture, where participation in the payment of bankruptcy assets is minimal and the current economic system tends to be capitalist. Indonesia must take the Chinese government as an example; China places a premium on modifying labour standards to safeguard the rights and interests of workers in all circumstances and promote economic and social development.

Abstract

This research aims to examine and analyze problems related to the implementation of maqasid sharia principles in effective reporting of state administrators' assets in Indonesia and to look for factors causing the ineffectiveness of legal instruments for reporting state administrators' assets in realizing the general principles of government in Indonesia. This research employed a normative legal method, with its prescriptive and applied nature. The research results show that, first, the implementation of maqasid sharia principles in reporting the assets of state administrators is in line with Hifz al-din (maintaining religion), Hifz an-nafs (maintaining the soul), Hifz al-aql (maintaining reason), Hifz an-nasl (maintaining offspring), and Hifz al-mal (maintaining assets); however, the challenge of implementing the principles of maqasid sharia in regulating the reporting of state administrators' assets requires a strong commitment from legal institutions, government, and society. Second, the factor causing the ineffectiveness of the legal instrument for reporting state administrators' assets still needs to be a more vital law enforcement factor. This can be seen in the LHKPN reporting instrument, which is the responsibility of the Corruption Eradication Commission. To deal with these problems, a legal instrument for reporting state administrators' assets is needed to embody the General Principles of Good Governance in Indonesia based on eight principles that the law must fulfil as a basis for forming reasonable regulations.

Abstract

Pengabdian kepada masyarakat bermitra dengan SMK Perdana Semarang dengan sasaran peserta didik di sekolah tersebut. Adapun permasalahan yang dihadapi oleh Mitra yaitu belum adanya pemahaman mitra mengenai urgensi pencegahan hate speech di lingkungan sekolah; belum adanya pemahaman mitra mengenai regulasi terkait hate speech; serta belum adanya pemahaman mitra mengenai bentuk nyata peran serta generasi muda dalam upaya pencegahan terjadinya hate speech di lingkungan sekolah serta cara beretika yang baik di media sosial. Guna menyelesaikan permasalahan tersebut, maka dilaksanakan kegiatan dengan metode penyuluhan. Penyuluhan dilaksanakan sebagai transfer pengetahuan kepada mitra dan dilanjutkan dengan diskusi untuk memperdalam materi yang diberikan. Adapun hasil kegiatan menunjukkan bahwa Mitra sangat antusias mengikuti kegiatan penyuluhan dan materi yang diberikan dapat dipahami dengan baik. Hal tersebut ditunjukkan dengan respon positif siswa-siswi dalam menjelaskan contoh-contoh konkrit bentuk hate speech di media sosial dan bagaimana upaya mengatasinya. Selain itu, siswa-siswi juga dapat menjelaskan bagaimana beretika yang benar di media sosial untuk selanjutnya dapat dipraktekkan.

Abstract

Adapun permasalahan yang dihadapi oleh Mitra yaitu belum adanya pemahaman mitra mengenai urgensi perlindungan dan pengelolaan lingkungan hidup. Selain itu, Mitra juga belum mengetahui upaya konkrit apa saja yang dapat dilakukan sebagai bentuk peran serta dalam perlindungan dan pengelolaan lingkungan hidup. Guna menyelesaikan permasalahan tersebut, maka dilaksanakan kegiatan dengan metode penyuluhan dan pelatihan. Penyuluhan dilaksanakan sebagai transfer pengetahuan kepada mitra dan pelatihan dilaksanakan sebagai upaya praktek dari pengetahuan yang telah diberikan. Adapun hasil kegiatan menunjukkan pertama, Mitra sangat antusias mengikuti kegiatan penyuluhan dan materi yang diberikan dapat dipahami dengan baik. Kedua, Mitra dapat menerapkan peran serta secara konkrit dalam upaya perlindungan dan pengelolaan lingkungan hidup dalam bentuk “Kampanye Lingkungan Hidup” melalui media sosial. Kampanye Lingkungan Hidup tersebut merupakan hasil pelatihan sebagai salah satu luaran kegiatan.

Abstract

Perjanjian Paris menggambarkan aksi lingkungan telah dikuti oleh 4 tanda yaitu: menetapkan jalan kecil yang jelas untuk emisi masa depan, mengakui resiko dari dampak iklim, menggeser pendanaan ke arah rendah karbon, dan pembangunan berkelanjutan dengan fondasi yang kuat. Awal 2015, suhu udara menembus rekor global dengan peningkatan rata-rata temperatur 0,8°C. Suhu global akan 1,5°C lebih panas di atas level 1850-1900 pada tahun 2040 dan berpotensi mengalami kenaikan sebesar 4°C bila ketiadaan tindakan negara-negara menangani perubahan iklim.. Indonesia bekerjasama dengan Inggris untuk memitigasi dampak perubahan iklim melalui program rendah karbon. Tujuan penelitian ini untuk menganalisis implementasi Paris Agreement kerjasama Indonesia dengan Ingris dalam program rendah karbon. Metode penelitian ini kualitatif dengan pendekatan yuridis empiris. Hasil penelitian ini adalah dalam Perjanjian Paris, kepentingan internal dan eksternal Indonesia yang ingin dicapai diantaranya yaitu; 1) struktur dan sistem internasional yang aktif dalam upaya mitigasi dan adaptasi terhadap fenomena perubahan iklim, 2) partisipatif aktif menjalankan kewajiban dalam menghadapi tantangan dan ancaman krisis iklim dan 3) pembangunan citra positif Indonesia di arena Internasional. Bagi Indonesia Perjanjian Paris telah mendorong akomodasi dalam menciptakan peraturan global yang memuat nilai keadilan dan keseimbangan. Implementasi isi Paris Agreemement Kerjasama Indonesia dan Inggris dalam Program Rendah Karbon yang dilaksanakan di Kota Semarang diupayakan dengan langkah-langkah sebagai berikut : 1) memahahami tantangan mobilitas bagi kelompok rentan melalui pendekatan partisipatif, 2) rancang bersama tindakan percontohan atau urbanisme taktis untuk meningkatkan aksesbilitas dan 3) dokumentasi metode dan pembelajaran kedalam kerangka kerja untuk replikasi dan perluasan program.

Abstract

Women are considered second-class citizens who often receive stereotyped views and attitudes or negative labels, as well as acts of violence, both in the form of control even with the intention of protection, which eliminates physical and mental integrity, resulting in the loss of equality, enjoyment and basic freedoms as human beings. Indonesia, as a developing country, has a bad reputation in terms of human rights violations, one of which is that these violations can be classified as acts of violence against women. The core of legal protection for women in the UDHR respects the humanity of every person because they are born as human beings. The presence of the PKDRT Law, the TPKS Law which regulates the right to restitution and assistance funds, and Perma Number 1 of 2024 concerning Guidelines for Adjudicating Criminal Cases Based on Restorative Justice. provide confidence to the community to dare to report their cases. The driving cadres are the leading partners who are directly involved in community issues. Based on this, the problem in this Community Service (PKM) activity can be formulated as the lack of understanding of the Trimluyo Genuk driving cadres regarding legal protection for women. This PKM activity was carried out using lecture, discussion and question and answer methods. In this PKM activity, Trimulyo's cadres gained information developments and strengthened their understanding of legal protection, as indicated by an increase in the average general understanding of 13 participants of 81.54%.
