Abstract

Penelitian ini bertujuan menganalisis konsep nazhir wakaf menurut undang-undang nomor 41 tahun 2004 dan implementasinya di lembaga wakaf ormas Islam NU dan Muhammadiyah Kota Bandung, serta mencari model nazhir wakaf profesional di Indonesia. Metode penelitian yang penulis gunakan adalah kualitatif. Hasil penelitian menunjukan bahwa konsep nazhir wakaf telah diatur dalam Undang-undang No. 41 Tahun 2004 tentang wakaf dengan sangat rinci, mulai dari pengertian, jenis nazhir, hak dan kewajiban nazhir, mekanisme pemberhentian dan pergantian nazhir serta pembinaan nazhir. Dalam upaya mengimplementasikan konsep nazhir wakaf profesional yang mengacu pada Undang-undang perwakafan di Indonesia, NU sebagai organisasi masyarakat Islam terbesar membentuk lembaga yang menangani khusus tentang perwakafan dan pertanahan yaitu Lembaga Wakaf dan Pertanahan (LWP NU). Adapun Aset-aset wakaf yang dimiliki oleh NU kota Bandung tersebar dalam bentuk yaitu: (1) Pondok pesantren, (2) Lembaga pendidikan, (3), Masjid, (4) Panti asuhan. Sedangkan Muhammadiyah dalam mengimplementasikan konsep nazhir wakaf profesional membentuk Majelis Wakaf dan Kehartabendaan (MWK). Adapun Aset-aset wakaf yang dimiliki oleh Muhammadiyah kota Bandung tersebar dalam bentuk sekolah, mulai dari tingkat taman kanak-kanak (TK) hingga perguruan tinggi, serta rumah sakit yang tersebar di seluruh Indonesia. Sebagian kecil lainnya adalah pondok pesantren, masjid dan panti asuhan. Adapun model nazhir wakaf profesional yaitu meliputi persyaratan moral, amanah, menguasai ilmu manjemen administrasi dan keuangan serta memiliki skill leadership dan enterpreneurship. Kata kunci : Wakaf Muhammadiyah dan NU.

Abstract

Blackmarket trade is an illegal activity that bypasses official customs systems and harms the state economically, legally, and socially. This study aims to examine blackmarket crimes based on Law No. 17 of 2006 concerning Customs and from the perspective of Islamic criminal law. The method used is library research with a normative juridical approach, analyzing relevant regulations, concepts, and legal principles. Findings indicate that blackmarket actors face penalties including imprisonment and fines under Articles 102-104 of the Customs Law. From the Islamic criminal law perspective, blackmarket trade is categorized as jarimah ta’zir because it harms society and contradicts principles of justice and economic honesty. Thus, this practice violates both positive law and Islamic law, requiring firm law enforcement and moral education to prevent it.

Abstract

The criminal act of abortion constitutes a form of crime that threatens human life and frequently occurs in society, especially as a result of promiscuity among unmarried teenagers. Abortion has become a legal issue regulated in Article 346 of the Criminal Code. However, there are limited exceptions in Law Number 36 of 2009 on Health which permits abortion in medical emergencies and pregnancies resulting from rape. The purpose of this study is to explain abortion as an impact of promiscuity, economic factors, and socio-cultural factors. In addition, to gain an understanding of the positive legal regulations in Indonesia regarding sanction of abortion as regulated in Article 346 of the Criminal Code, and to examine the perspective of Islamic law in viewing the practice of abortion and their sanctions. The approach of legal relativism and criminalization is used to understand the complexity of the abortion phenomenon, demonstrating the need for harmonization between criminal law and reproductive health so that law enforcement is humane and in accordance with applicable social norms. The method used in this study is a normative juridical approach using a literature study technique. The research findings reveal that the practice of abortion among adolescents occurs due to weak social control, promiscuity, as well as economic factors, open access to pornographic content, and minimal supervision of people who encourage pregnancy outside of marriage. From a positive legal perspective, abortion regulations in Indonesia are still inconsistent. The Criminal Code criminalizes abortion without medical reasons, especially in Article 346, while in Law Number 36 of 2009 provides exceptions in cases of medical emergencies or rape. From the perspective of Islamic criminal law, this study found that abortion is viewed as a forbidden act, especially if it is performed after the fourth month of pregnancy, when it is believed that the spirit has been blown.

Abstract

Tindak pidana penghinaan terhadap Kepala Negara adalah tindak pidana yang menyerang kehormatan atau harkat dan martabat dapat berupa menista, fitnah, ataupun persangkaan palsu. Penghinaan terhadap Kepala Negara di media sosial menjadi isu hukum yang kontroversial. Karena banyak orang beranggapan hal tersebut merupakan salah satu bentuk kebebasan berpendapat. Oleh karena itu penelitian mengenai penghinaan terhadap kepala negara di media sosial sangat penting dilakukan. Penelitian ini bertujuan untuk menguraikan unsur-unsur tindak pidana, dan sanksi dari penghinaan terhadap Kepala Negara di media sosial dalam pasal 219 KUHP dan Hukum Pidana Islam, dan mengetahui dampak dan akibat hukum dari tindak pidana penghinaan Kepala Negara di media sosial. Metode yang dalam penelitian ini adalah deskriptif analisis, dan melakukan pendekatan yuridis normatif dengan jenis pendekatan Undang-Undang Hasil penelitian ini menunjukkan bahwa tindak pidana penghinaan kepala negara di media sosial dalam pasal 219 KUHP bukan bertujuan sebagai pembungkam aspirasi rakyat, walaupun ada kalimat yang menyebabkan multitafsir, dan dari segi sanksi dapat menimbulkan over-penalizing. Serta menurut hukum islam itu sendiri tindakan ini bukanlah tindakan yang di perbolehkan sehingga masuk kedalam kategori ta’zir. hal itu dilakukan untuk menghinadari dampak dari tindak pidana tersebut seperti gangguan stabilitas politik.

Abstract

Underage marriage or often called child marriage is a marriage carried out by someone who is still under the age specified in the legislation through a marriage dispensation to the religious court. In fact, there are still many cases of child marriage even though there have been changes in the minimum age regulations for marriage through Law Number 16 of 2019. The purpose of this study is to analyze the basis for consideration of Law Number 16 of 2019 in determining marriage dispensation, understand the basis for legal considerations in preventing child marriage, and review the harmony of norms between marriage dispensation and child protection in preventing child marriage. This study uses a library research method with a normative legal approach, which is carried out through an analysis of the text of relevant laws and regulations. The results of the study show that there is disharmony between the regulations on marriage dispensation and the legal provisions governing child protection. This difference in interpretation causes inconsistency in the application of the law, which is a challenge for judges when they have to decide on marriage dispensation cases. In situations like this, the judge is required to make a wise decision by considering urgent reasons and two possible risks, both of which could have a major impact on the child's future.

Abstract

Kamojang Nature Reserve is one of the vital conservation areas in West Java that faces serious threats due to land-use conversion, geothermal exploration, illegal tourism activities, and weak legal supervision. This study aims to: (1) examine the background of forest destruction crimes in the Kamojang Nature Reserve area; (2) analyze the resulting ecological and social impacts; and (3) assess the legal sanctions imposed on perpetrators based on Law Number 32 of 2024 concerning the Conservation of Biological Natural Resources and Their Ecosystems, as well as from the perspective of Islamic criminal law. The research employs a normative juridical approach with data collected through literature study. The data used is qualitative in nature, derived from secondary sources such as statutory regulations, Islamic criminal law literature, scientific journals, and previous research, as well as tertiary sources including legal dictionaries, encyclopedias, and language dictionaries. This study adopts three theoretical frameworks: the Theory of Penalization, which explains the basis and objectives of criminal sanctions in positive law; the Theory of Jarimah, which classifies criminal acts in Islamic law; and the Theory of Maqasid al-Shari‘ah, which emphasizes the importance of environmental protection as an integral part of public welfare (maslahah). The findings indicate that economic motives, weak law enforcement, and low public awareness are the main causes of forest destruction. The impacts include the loss of wildlife habitats, disruption of water cycles, increased ecological disasters, and a decline in community well-being. Under positive law, perpetrators are subject to imprisonment and fines, while under Islamic criminal law, such acts fall under the category of jarīmah taʿzīr, which entails sanctions that are educational, preventive, and restorative in nature. This study underscores the importance of synergy between state regulations and Islamic legal values in preserving ecosystem sustainability and achieving ecological justice.

Abstract

Economic exploitation of street children is a serious crime in the city of Bandung. In 2022, cases of exploitation of children were still quite high, but experienced a significant decrease from 2022 to 2024. This is inseparable from the efforts of the Bandung City Social Service which runs a rehabilitation program for victims and provides education to the perpetrators. This research was conducted in three regions, namely Asia Africa, Braga, and Gede Bage. Acts of economic exploitation of children are prohibited in Article 76(i) of Law Number 35 of 2014 concerning Child Protection. Sanctions against the perpetrators are regulated in Article 88 of the same law, with a maximum threat of 10 years in prison and a fine of Rp200,000,000. This study uses a descriptive method of analysis with a normative juridical approach. The type of data used is qualitative with primary data sources in the form of observations and interviews, as well as secondary data in the form of journals, books, articles, office reports, and photo documentation. Factors that cause economic exploitation in children include family economic conditions, social environment, and weak supervision. From the perspective of Islamic Law, the perpetrator can be subject to ta'zir sanctions determined by ulil amri. The impact includes a loss of security, disruption of education, reduced playing time, and the formation of deviant characters

Abstract

This article explores the modern Muslim family concept by synthesizing Ibn Kathir's tafsir bil ma’tsur of Qur’an Surah Ali ‘Imran 37 with Robert Kiyosaki’s MILES theory (Money, Intelligence, Location, Education, Status). The verse portrays Maryam as accepted by God, raised in purity, and nurtured under Prophet Zakariya’s care. Ibn Kathir emphasizes early spiritual education and a religious environment in shaping children’s character. Using qualitative library research, this study draws on Ibn Kathir’s Tafsir al-Qur’an al-‘Azim, contemporary tafsir, and family education theories. Findings show that Ibn Kathir’s values align with MILES: Status in Imran’s family faith, Education and Intelligence in Zakariya’s guardianship, Money in divine sustenance for Maryam, and Location in the sacred mihrab. The synthesis offers a framework for modern Muslim families child education rooted in Qur’anic spirituality, reinforced by socio-economic resilience.

Abstract

This article examines the Islamic jurisprudence (fiqh) approach to interpreting the Qur'an through an in-depth study of the methodology and characteristics of the interpretation contained in Al-Qurtubi's monumental work, Al-Jami` li Ahkam al-Quran. The study focuses on how Al-Qurtubi combines Islamic jurisprudence (fiqh) with Islamic exegesis (tafsir) to explain Qur'anic verses related to sharia laws in a detailed and structured manner. The method used in this interpretation emphasizes understanding the legal context, Islamic jurisprudence principles, and the integration of evidence from the Qur'an, hadith, and the opinions of previous scholars. The results of the study indicate that Al-Qurtubi's interpretation has systematic and comprehensive characteristics in explaining Islamic law, thus becoming a primary reference for scholars and researchers in the fields of interpretation and fiqh. This study also highlights the contribution of Islamic jurisprudence (fiqh) interpretation in enriching the understanding of the Qur'anic text, especially in the context of the application of Islamic law.

Abstract

This study aims to analyze how digital piety among santri in Islamic boarding schools (pesantren) in Bandung Regency shapes the ecology of Islamic authority and influences diverse forms of religious moderation in everyday practice. This study is important because the digitalization of da‘wah has expanded santri’s religious references while simultaneously carrying the potential to generate polarization when not accompanied by adequate literacy and guidance. The research employs a qualitative approach with a case study design. Data were collected through in-depth interviews with santri, observation of religious activities within the pesantren environment, and examination of relevant digital artifacts, such as religious content accessed and shared by participants. The data were analyzed using thematic analysis to identify patterns of religious practice, authority references, and emerging mechanisms of negotiation. The findings indicate that digital piety emerges as a structured religious routine through the consumption of short religious lectures, practices of saving and sharing content emphasizing ethical and moral values, and the curation of content perceived as “safe” and non-confrontational. Within a plural ecology of Islamic authority, kiai and pesantren teachers remain the final sources of religious legitimacy, while digital religious authorities function primarily as initial triggers of knowledge that are negotiated through account selection, interaction restraint, and cross-checking with pesantren authorities. As a result, religious moderation among santri appears more strongly as a lived social practice operating contextually between pesantren spaces and digital environments. The implications of this study highlight the importance of strengthening digital religious literacy, establishing accessible verification mechanisms, and developing pesantren-based content curation to reinforce religious moderation in the era of social media. The originality of this research lies in its articulation of the micro-level mechanism of “authority negotiation” as a bridge between digital piety and religious moderation, thereby offering both conceptual and empirical contributions to the fields of digital religion, Islamic authority, and religious moderation within pesantren contexts.
