Abstract

The development of extreme religious perspectives, attitudes of subjective truth claims that impose their religious interpretations are the main basis for the need for a moderate religious perspective. This article aims to analyse the situation of harmony, the experience of discrimination based on religion and to examine the religious moderation attitudes in the community. This research was conducted in a multicultural urban area in the Province of DI Yogyakarta, Baleharjo and Sinduadi Villages. This study found that respondents who experienced discrimination due to their religion were very low. However, 10.2% of respondents reported that there had been friction in their community. This study also found that level of people's attitudes regarding religious moderation measured by national commitment, tolerance, non-violence and accommodativeness to local culture can be categorized as high or good. However, there are several aspects of religious moderation that need to be strengthened such as attitudes about the importance of solving problems through legal approach if a person has problems with followers of other religions, acceptance of the establishment of houses of worship of other religions, leaders from other religions and the desire to conduct demonstrations and expel groups that are considered deviant. This study also found that the higher the education of the respondents, the higher the average score of religious moderation. Respondents who are active in religious organizations have also a higher attitude of religious moderation. Education, both through formal education and religious activities, can be an effective strategy to strengthen religious moderation attitudes in society.

Abstract

الملخص:فإن الشريعة الغراء قد أولت موضوع الأسرة عناية فائقة وظهر ذلك في الأحكام المنظمة لإنشائها وتكوينها واستمراريتها، قد اعتنت جميع الدول بقانون الأحوال الشخصية المنظم لهذه العلاقة. وشرع الطلاق باعتباره أبغض الحلال إلا في حالة الضرورة وعند العجز على المصالحة بين الزوجين لتباين الأخلاق وتنافر الطباع, كما أن الطلاق أيضا يمكن أن يكون وسيلة لتأديب الزوجة وهو آخر وسيلة يلجأ إليها الزوج بعد استكمال كل الوسائل الممكنة لحل النزاع بين الزوجين. لقد تحدث الباب الرابع من قانون الأحوال الشخصية الأردني عن انحلال عقد الزواج, وذكر الفصل الأول منه موضوع الطلاق. فهذا البحث يتحدث عن الطلاق من المادة (80) إلى المادة (90) في هذا القانون وهو قانون الأحوال الشخصية الأردني رقم 36 لسنة 2010. فيتطرق هذا البحث على دراسة تحليلية في عملية تطبيقبة معاصرة عن الطلاق في ضوء الفقه الإسلامي وقانون الأحوال الشخصية الأردني. Abstrak: Keluarga dalam syariat Islam merupakan salah satu objek kajian yang penting. Hal itu terbukti dalam berbagai macam hukum yang mengatur tentang keluarga mulai dari pembentukan, pertumbuhan hingga kelanggengannya. Semua negara pun memiliki perhatian yang sama dalam hal ini. Adapun mengenai masalah Talak, meskipun ia merupakan perkara yang sebaiknya dihindari, namun dalam keadaan tertentu ia dapat dijadikan sebagai solusi alternatif. Misalnya ketika kedua pasangan (suami-istri) tidak lagi bisa saling memberi manfaat, atau mungkin juga sebagai bentuk pelajaran kepada sang istri agar berubah menjadi lebih baik. Talak di sini merupakan solusi terakhir yang dapat dijatuhkan oleh sang suami kepada istrinya. Ini berarti bahwa Talak adalah keputusan final setelah mereka benar-benar mencoba berbagai macam cara untuk menyelesaikan konflik rumah tangga, namun masih tetap tidak berhasil juga. Talak sendiri dalam Undang-Undang Ahwal Al-Syakhsiyyah Yordania dibahas secara khusus dalam Bagian Pertama pada Bab Empat mengenai Putusnya Akad Perkawinan mulai dari pasal 80 hingga pasal 90. Undang-Undang yang dimaksud di sini adalah Undang-Undang Ahwal Syakhsiyyah Yordania Nomor 36 tahun 2010. Dengan demikian, kajian ini bertujuan untuk meneliti berbagai hal mengenai Talak dalam perspektif Hukum Islam dan penerapannya dalam Undang-Undang Ahwal Al-Syakhsiyyah Yordania.

Abstract

The core of the paradigmatic disability of the world of Islamic thought, for Al-Mestiry, is the separation of the history of civilization from science. The challenge of modernity (tahaddiyât al-hadâtsah) of Muslims today is not only about the authentication (at-ta'shîl) of thought but at the same time about the revitalization of knowledge. The reading pattern of the structural dichotomy will never be able to accommodate knowledge in its entirety. For Al-Mestiry, the revolution of thought is an absolute requirement for generating civilization. Therefore, it is necessary to read integrally-dialectically through intra-epistema (at-tadâkhul al-ma'rifî) in the framework of total vision (ar-ru'yah al-kulliyyah) who heed the dialogical process of two points of view in it: ar-ru 'yah at-turâsiyyah and ar-ru'yah al-hadâtsiyyah. Thus, the momentum awareness (wa’yu al-mu'asharah) of change and renewal will teach humans about the openness of interpretation of the culture of religious thought (at-turâts).

Abstract

This study investigates the interfaith Nyadran tradition practiced by the Getas-Temanggung community, addressing the scholarly question of how local religious and ritual practices sustain their relevance amid the intensifying forces of modernization. The research aims to elucidate the dynamics of Nyadran as a form of folk religion and its function in navigating interfaith harmony. Data were obtained through participant observation to capture ritual practices, interviews with interfaith participants, and analysis of pertinent documents. Employing an analytical framework grounded in the concepts of popular religion and religious harmony, the findings reveal that the interfaith Nyadran tradition integrates formal religious values with local customs, thereby creating an inclusive space for interfaith engagement. This ritual promotes social solidarity, cultivates tolerance, and supports ecological harmony through practices that demonstrate respect for nature. The practical implications underscore the significance of respecting and preserving local traditions as a strategy for enhancing social cohesion within the context of modernity, alongside advocating for an inclusive religious ideology as a counter-narrative to fundamentalist and exclusivist perspectives. The study recommends that governmental bodies and religious organizations endorse similar practices as models for strengthening social cohesion in multicultural, multiethnic, and multireligious societies.

Abstract

Despite its abundant natural resources, Riau Province confronts significant challenges, notably forest fires attributed to agricultural practices and land conversion for palm oil cultivation. This article seeks to examine the difficulties encountered by local ‘ulamā’ in addressing environmental issues within Riau Province. The study employs a socio-legal framework to elucidate the responses of local ‘ulamā’ to these challenges, particularly through the application of religious teachings, referred to as eco-fatwas, to comprehend and address the environmental problems prevalent within the region. Utilizing a methodological approach that incorporates in-depth interviews, field observations, and document analysis, the study concludes that the eco-fatwas disseminated by local ‘ulamā’ confront complex challenges, including economic competition, political interests, sectoral egos, and power hegemony. Consequently, this research emphasizes the necessity for the concurrent implementation of cross-community and cross-policy da’wah strategies to effectively mitigate environmental degradation in Riau Province.

Abstract

The jurisprudential aspects of citizenship (known as fiqh al-muwāṭanah), emerging from the realm of ijtihād, have sparked considerable debate due to their theoretical nature. The term "citizenship fiqh" is not explicitly mentioned in the Quran or Sunna; consequently, it lacks demonstration within the context of the Prophetic era. This study aims to delve into citizenship fiqh by examining the discourse known as al-maskūt' anhu, shedding light on how Muslim scholars validated novel findings. To achieve this objective, the paper employs Foucault's critical discourse analysis theory to showcase that each era holds the prerogative to embrace distinct political systems and legal frameworks. Adopting a qualitative approach and drawing from various literary sources, this research proposes embracing the al-maskūt 'anhu discourse as the fundamental concept underpinning studies on citizenship within Islamic legal thought. This investigation discerns that citizenship fiqh embodies a blend of political and religious engagement. It can be effectively harnessed as a mechanism of legal governance during the nation-state era, provided it effectively contributes to the populace's well-being and fosterssocial equity. Abstrak: Aspek-aspek fikih kewarganegaraan (fiqh al-muwāṭanah), yang muncul dari ranah ijtihad, memicu banyak perdebatan karena sifat teoretis nya. Terminologi “fikih kewarganegaraan” tidak ditemukan secara eksplisit dalam Al-Quran atau Sunah, dan sebagai konsekuensinya, tidak terdemonstrasi kan dalam konteks era kenabian. Artikel ini bertujuan untuk menggali konsep fikih kewarganegaraan melalui diskursus al-maskūt ‘anhu, dan menyoroti bagai mana para sarjana muslim memvalidasi temuan-temuan baru. Artikel ini meng guna kan teori analisis wacana kritis Foucault untuk menunjukkan bahwa setiap era memiliki hak prerogatif untuk mengadopsi sistem politik dan kerangka hukum yang berbeda. Dengan menggunakan pendekatan kualitatif dan menganalisis berbagai sumber literatur, penelitian ini merekomendasikan diskursus al-maskūt 'anhu sebagai konsep dasar yang mewadahi studi kewarganegaraan dalam pemikiran hukum Islam. Studi ini menemukan bahwa fikih kewarganegaraan, pada dasarnya, mencakup perpaduan diskursif antara aspek politik dan agama. Hal ini dapat dimanfaatkan secara efektif sebagai mekanisme tata kelola hukum pada era negara-bangsa, dengan catatan dapat berkontribusi terhadap kesejahteraan masyarakat dan mendorong kesetaraan sosial.
