Abstract

The enactment of Law Number 1 of 2023 concerning the New Indonesian Criminal Code (KUHP 2023) marks a significant shift in Indonesia’s legal landscape, particularly concerning the recognition and integration of Adat Criminal Law within the national legal framework. This study explores the future prospects of Indonesia’s criminal law reform, focusing on the coexistence of statutory and customary law, judicial application of adat norms, human rights considerations, local governance roles, public perception, and policy directions. Using a normative juridical approach, the research examines the legal, sociological, and political justifications for adat law recognition, its challenges in enforcement, and the implications for Indonesia’s legal pluralism. Key findings highlight the complexities of judicial discretion in applying adat law, the need for harmonization with constitutional protections, and public attitudes toward adat-based justice mechanisms. Additionally, this study proposes policy recommendations for ensuring legal certainty, judicial training, and technological advancements in adat law documentation. By addressing these challenges, Indonesia can establish a balanced legal system that respects customary traditions while aligning with national and international legal standards.

Abstract

Based on this theory, the Laba Pura area is the Kanista Mandala Pura, or the temple grounds outside the temple itself. The focus of this research is to conduct a thorough investigation of the land dispute in Bukit Jati Temple, Bangli Regency. Therefore, it is expected that Pengempon Pura is able to manage Pura Profits creatively in order to help maintain a harmonious balance in temple operations. Normative legal research is the research methodology used in this thesis. People easily divert Pura Profit land because they consider it as ordinary land, just like other agricultural properties. Efforts to preserve customary land must be watched by the government and temple owners, therefore Laba Pura land or also known as Pelaba Pura land needs legal protection. Legal certainty usually views the trustworthiness of the transfer of land rights in Laba Pura as equivalent to the transfer of land ownership rights.

Abstract

This article explores the historical role of old tax documents, particularly the Letter C Book, as crucial references in land registration processes in Indonesia. The background highlights the legal challenges in proving land ownership in areas where formal certificates are absent, emphasizing the significance of Letter C as a traditional land record maintained by village authorities. Using a normative legal research method, the study analyzes regulations and historical practices governing the use and recording of Letter C documents, focusing on their reliability and legal standing amid evolving land registration laws. The research finds that while old tax documents provide strong indications of land rights, the absence of formal certification necessitates urgent registration to secure legal ownership. Furthermore, the study identifies risks of forgery due to inconsistent record-keeping and recommends procedural reforms for validating Letter C entries. Ultimately, the article concludes that integrating old tax documents into formal land registration is essential for legal certainty and land tenure security.
