Abstract

Tulisan ini membahas isu tentang wanprestasi dalam perjanjian sewa menyewa lisan dalam kasus Putusan Mahkamah Agung Nomor 1093 K/Pdt/2016 untuk mengetahui bagaimana keabsahan suatu perjanjian sewa menyewa lisan dan apa akibat hukum yang terjadi bilamana terjadi wanprestasi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan penelitian antara lain berupa pendekatan undang-undang (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menemukan bahwa perjanjian sewa menyewa lisan dapat menjadi sah apabila telah memenuhi ketentuan Pasal 1320 KUHPerdata, kemudian apabila terjadi wanprestasi dalam perjanjian sewa menyewa lisan maka dapat menyebabkan suatu perjanjian menjadi batal apabila pihak yang merasa dirugikan mengajukan permohonan pembatalan perjanjian kepada Hakim.

Abstract

The agreement as a source of engagement must be made by fulfilling the legal requirements as specified in the Civil Code (KUHPerdata). Because if the agreement does not meet the legal requirements, the engagement that occurs cannot be enforced. The agreement can be null and void if it contains false information. The case of the cancellation of the agreement in the form of an authentic deed due to false information can be found in the Denpasar High Court Decision Number 34/PDT/2016/PT. DPS. In that decision, the Panel of Judges upheld the decision of the first instance court which stated that the original Appellant of the Plaintiff committed an unlawful act because he gave false information so that the Deed of Lease Extension made before a notary became null and void. This research is normative legal research or what is also known as doctrinal legal research. Normative legal research is legal research in the area of legal science itself in a broad sense. It is said to be broad because the science of law is the way it is, entering all aspects of science with the aim of achieving legal goals. The results of this study found that there was negligence by a notary in making the Lease Extension Deed in that case, besides that the result of false information by one of the parties resulted in the Lease Extension Deed being invalid and null and void and the party providing false information must be held responsible and compensate for the losses suffered by the parties concerned.

Abstract

ABSTRACT Marriage is the beginning of a new life for a person, because since there is an agreement between two individuals to marry, there is a change in the roles and responsibilities towards oneself, their partner, and their environment. Even though the Law of the Republic of Indonesia Number 1 of 1974 concerning Marriage adheres to the principle of monogamy, cases can occur where marriages occur in a polygamous manner, but to carry out a polygamous marriage, the conditions that must be met at least consist of 1 (one) alternative and 3 (three) conditions. cumulative conditions. However, there are cases where in the Denpasar District Court Decision Number 682/Pdt.P/2016/PN a husband is given permission by the Panel of Judges to practice polygamy even though there are no alternative requirements for a polygamous marriage to be fulfilled. Abstract

Para pihak dalam membuat akta sewa menyewa harus mengerti akan syarat-syarat dan asas-asas pembuatan perjanjian karena apabila tidak maka akta sewa menyewa tersebut dapat dianggap tidak sah sehingga tidak memiliki kekuatan mengikat bagi para pihak. Akta sewa menyewa merupakan salah satu bentuk perjanjian yang memberikan kekuatan hak pada salah satu pihak untuk mendapatkan prestasi dan sekaligus hak kepada pihak lainnya untuk mendapatkan prestasi serta juga dengan bersamaan memberikan kewajiban kepada pihak lain untuk melaksanakan prestasi. Suatu perjanjian sewa menyewa yang tidak memenuhi Asas Keseimbangan berakibat perjanjian tersebut tidak akan dapat mengikat para pihak yang meskipun telah sepakat terhadap perjanjian tersebut, sehingga hak dan kewajiban yang muncul akibat perjanjian tersebut tidak dapat dipaksakan pelaksanaannya. Permasalahan yang akan dibahas dalam artikel ini adalah membahas bagaimana keabsahan klausul pembebasan kewajiban akibat Force Majeure dalam Akta Sewa Menyewa dalam Putusan Pengadilan Negeri Palu Nomor: 23/PDT.G.S/2019/PN PAL. Metode Penelitian yang digunakan dalam artikel ini adalah yuridis normatif dengan tipe penelitian preskriptif. Jenis data yang digunakan dalam penelitian ini adalah data sekunder dengan pendekatan kualitatif. Adapun dalam kasus ini terhadap perjanjian sewa menyewa yang ditafsirkan tidak seimbang oleh hakim menyebabkan penggugat seharusnya memiliki hak terhadap biaya-biaya dan uang pembayaran yang sudah dibayarkan namun belum dinikmatinya. Kata Kunci: Perjanjian Sewa Menyewa, Asas Keseimbangan, Pembebasan Kewajiban

Abstract

Abstract The marriage agreement is an agreement agreed upon by the prospective husband and wife before or at the time of marriage to determine the legal consequences of marriage on their treasure, under certain circumstances, it is also possible for a married couple to make changes and even revocation of the Marriage Agreement that has been made as long as it is in accordance with the law. This article encourages the notary to be carefully in making the deed of amendment or revocation of the Marriage Agreement so that the notary can protect the interests of the third parties involved and to avoid all claims and lawsuits that may be filed by third parties if someone is harmed, because if the deed made by a notary is detrimental to third parties, then the deed will be null and void. Keywords: Notary, Marriage Agreement, Cause of Law Abstrak Perjanjian Perkawinan merupakan perjanjian yang disepakati oleh calon suami isteri sebelum atau pada saat perkawinan untuk menentukan akibat hukum perkawinan terhadap harta benda milik mereka, dalam keadaan tertentu maka pasangan suami isteri juga dimungkinkan untuk melakukan perubahan dan bahkan pencabutan Perjanjian Perkawinan yang telah dibuatnya selama telah sesuai dengan ketentuan Undang-Undang. Artikel ini mendorong agar notaris melakukan secara saksama dalam pembuatan akta perubahan atau pencabutan Perjanjian Perkawinan agar notaris dapat melindungi kepentingan pihak ketiga yang terkait serta agar terhindar dari segala tuntutan dan gugatan yang mungkin diajukan oleh pihak ketiga apabila ada yang dirugikan, karena apabila akta yang dibuat oleh notaris merugikan bagi pihak ketiga maka akta tersebut akan batal demi hukum. Abstract

In carrying out the governance of a nation, there are expenses necessary for the expenditures of the state, some of which are obtained through tax revenues collected from individuals classified as taxpayers. However, not all taxpayers fulfill their tax payments on time, and sometimes there are those who fall behind on their taxes, resulting in tax debt. Article 9, paragraph (2) PMK 61/2023 specifically governs the liability of limited liability company directors, wherein the corporate tax debt can be borne personally and/or jointly, including the entire tax debt and tax collection costs. This differs from the responsibility of limited liability company directors as regulated in Law 40/2007, which fundamentally imposes limitations on the accountability of individuals in their positions. As a result, there is ambiguity for corporate managements regarding the limitations of accountability in the tax perspective compared to the corporate law perspective. This research attempts to examine the importance of affirming the legal position of corporate directors as tax debtors. By using normative methods, the author aims to find legal certainty regarding the issues discussed. This research concludes that there is a legal vacuum in regulating the requirements for corporate managements to be exempted from being tax bearers. So that the author recommends that written regulations must be made regarding the understanding of the tax debt insurer for the company's tax debt is limited only to the company's management who is responsible for the company when the tax debt arises. Abstract

Penelitian ini membahas mengenai perjanjian sewa menyewa rumah tanpa jangka waktu sewa yang menjadi batal demi hukum. Akibat kebatalan tersebut tidak serta merta mengakibatkan para pihak harus mengembalikan ke kondisi semula oleh sebab hubungan sewa menyewa yang terjadi masih didasarkan pada suatu perikatan alam. Untuk menemukan jawaban dalam penelitian ini digunakan metode penelitian yuridis normatif. Hasil penelitian menemukan bahwa jangka waktu sewa merupakan unsur essensialia yang menjadi syarat objektif dalam sahnya suatu perjanjian sewa menyewa rumah sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman Jo. Pasal 28 ayat (5) Peraturan Pemerintah Nomor 14 Tahun 2016 tentang Penyelenggaraan Perumahan dan Kawasan Permukiman sebagaimana diubah terakhir dengan Peraturan Pemerintah Nomor 12 Tahun 2021 sehingga tanpa pengaturan jangka waktu sewa perjanjian tersebut menjadi batal demi hukum, namun uang sewa yang sudah diterima oleh pemberi sewa tidak perlu dikembalikan oleh karena hubungan sewa menyewa yang selama ini dilakukan didasarkan pada perikatan alam.

Abstract

This study aims to identify tax facilities in the implementation of grants for government project purposes. Taxation serves as a crucial instrument in supporting economic growth and national development. Its budgetary function plays a vital role in ensuring sufficient state funds for financing government activities. Additionally, its regulerend function contributes to facilitating national economic growth, such as providing tax incentives for foreign grants aimed at government project implementation. Following the enactment of Minister of Finance Regulation Number 80 of 2024, provisions have been established to ease the granting of tax facilities for foreign grants intended for government projects. However, an analysis of the procedures and mechanisms for its application is necessary. The research method used in this study is normative juridical with a qualitative approach. This study found that government projects funded by foreign grants eligible for tax facilities under Minister of Finance Regulation Number 80 of 2024 have a broader scope compared to the definition of public interest projects, thus making the regulation applies lex specialis derogat legi generali. The tax facilities provided include value-added tax (VAT), sales tax on luxury goods, income tax, and as well import duties.

Abstract

This article analyzes the impact of changes to spatial planning arrangements after the promulgation of the Job Creation Act Number 6 Year 2023. This article aims to find out whether the enactment of the Job Creation Act properly accommodates the need for spatial planning arrangements. This article uses a type of juridical-normative legal research with secondary research data in the form of primary legal materials and secondary legal materials. The results of the study found that changes to spatial planning arrangements in the Job Creation Act had the following impacts: the implementation of spatial use can be carried out without a spatial plan for the implementation of strategic national policies, there is a reduction in the authority of the regional government in carrying out spatial planning so that some tasks are carried out by the central government, and there is a reduction in the function of community control, especially regarding the cancellation of environmental permits through the courts. ___ Referensi Buku dengan penulis: Kodoatie, Robert J., & Sjarief, Roestam. Abstract

Abstract: The legal counseling on material guarantees at the Serpong District Office, South Tangerang aims to provide understanding, information and legal knowledge about how people can guarantee their movable and immovable objects at bank and non-bank financing institutions in the form of general and special guarantees (mortgage, pawn, fiduciary, Dependents, Warehouse Receipts and Individual Guarantees or Bortoght). This Community Service (PKM) uses an implementation method in the form of outreach activities and discussions with the village head and sub-district head. This PKM activity provides benefits to the village head and sub-district head which will later be shared with the surrounding community by increasing understanding of guarantee law at the Serpong District Office, South Tangerang. Through discussion activities between the service team and the village head and sub-district head, it was discovered that many did not understand material guarantees. Therefore, it is necessary to provide knowledge and supporting knowledge to provide knowledge to the public about the rules that apply to each material guarantee.Keywords: Guarantee, Materials, Tangerang-South
