Abstract

Early marriage in Indonesia remains a significant issue even though there has been a regulation that regulates the age limit for marriage through Law No. 16 of 2019. This study aims to examine the impact of early marriage on the rights of children, especially women, and evaluate the effectiveness of existing legal protections. The research method used is a qualitative approach with literature study and normative analysis of laws and regulations governing early marriage, especially Law No. 16 of 2019. The results of the study show that despite the age limit of marriage, the dispensation policy given by the religious court allows for early marriage. This has an impact on children's limited access to education, health, and economic opportunities. This study recommends the need to evaluate and strengthen dispensation policies and increase public awareness about the dangers of early marriage. Stricter policy changes and stricter oversight are needed to strengthen the protection of children's rights.

Abstract

Technological developments have brought about various forms of adaptation in the daily lives of Muslims, one of which is the implementation of virtual marriage. In special circumstances, such as during a pandemic or due to significant geographical distances, online marriage ceremonies have emerged as a practical and appropriate solution. This study aims to analyse the compatibility of virtual marriage ceremonies with Sharia principles, while also examining the social response to such practices. This study addresses two main issues: whether the conditions and pillars of marriage in Islam can be fulfilled in a virtual marriage ceremony, and the Sharia perspective on its validity. This study uses a qualitative-critical approach based on social hermeneutics to examine the meaning of virtual marriage ceremonies in modern society. Data was collected from classical fiqh sources, contemporary fatwas, as well as news and documentation of virtual marriage practices. A virtual marriage contract is deemed valid as long as the pillars and conditions, such as the bride and groom, guardian, witnesses, and the exchange of consent, are fulfilled. As long as communication is clear and smooth, and the principles of marriage are upheld, the contract remains legally valid under Islamic law even without direct face-to-face interaction. Scholars differ in their opinions: the Shafi’i, Maliki, and Hanbali schools reject virtual contracts because the physical presence of the parties (ittihad al-majelis) is not fulfilled, while the Hanafi school permits them if they occur in real-time. Technical problems can invalidate a contract according to most schools of thought. Although it is valid if the main conditions are met and communication is clear, caution is still required

Abstract

This research aims to analyze the form of consumer legal protection in e-commerce transactions in Indonesia and identify new challenges that arise in its implementation in the midst of the rapid development of the digital market. The method used is a normative juridical approach with an analysis of laws and regulations, legal doctrines, and relevant literature studies from scientific journals in the last ten years. The results of the study show that consumer legal protection is still fragmentary and has not been fully adaptive to the dynamics of digital transactions, especially in terms of business actors' responsibilities, personal data protection, and online dispute resolution mechanisms. Weaknesses in the national legal system are also exacerbated by the low digital literacy of consumers and the ineffective supervision and enforcement of the law by the competent authorities. This study concludes that regulatory reform is needed through harmonization with international legal instruments, strengthening community-based consumer legal education, and applying the principles of fairness and transparency in digital regulations. These findings are expected to be a reference in formulating consumer protection policies that are more adaptive, sustainable, and inclusive in the digital economy era.

Abstract

 ABSTRACT This study aims to analyze violent behavior against children from the perspective of Islamic family law by examining the causative factors, psychological impacts, and efforts to overcome them through positive legal instruments and Islamic values. The research method used is a qualitative approach with literature study techniques, where the author examines various written sources, such as books, scientific articles, and legal regulations related to child protection. The data obtained were analyzed descriptive-analytically with a normative juridical approach to uncover the relationship between the factors that cause violence against children, the psychological impact it causes, and the relevant coping mechanisms. The results of the study show that violence against children is caused by complex individual, family and social factors, and negatively impacts children's physical, emotional, and psychological development. In terms of positive law, regulations in Indonesia have provided quite comprehensive protection, although their implementation still faces cultural barriers and weak law enforcement. Meanwhile, in Islamic family law, children are seen as the mandate of Allah SWT that must be cared for and treated with affection, so that violence in parenting cannot be justified. The recommendations of this study emphasize the importance of synergy between positive legal instruments and Islamic values in building a complete child protection system, by involving families, communities, and the state collaboratively. Keywords: Violence against children, Islamic family law, child protection, causative factors, countermeasures

Abstract

Settlement of inheritance disputes in Indonesia is a complex issue because it involves aspects of Islamic law, national law, and diverse customs. The rules of fiqhiyyah in Islamic law actually provide clear guidelines in the distribution of inheritance based on the Qur'an and Hadith, but in practice they often experience challenges due to differences in interpretation and local cultural influences. This study uses a normative approach by analyzing laws and regulations, Compilation of Islamic Law (KHI), and religious court decisions to examine the implementation of fiqhiyyah rules in resolving inheritance disputes. The results of the study show that although KHI has accommodated the principles of Islamic inheritance law, its implementation in the field is not always consistent with the provisions of fiqh due to the influence of customary and low public understanding of inheritance rights. In addition, differences between generations in the view of the fairness of inheritance distribution also affect the dynamics of disputes. Therefore, strategic steps are needed such as legal education, strengthening the role of religious courts, and implementing mediation involving parties who understand Islamic law and positive law. Efforts to harmonize the applicable legal system are important to realize a fair, proportionate settlement of inheritance disputes in accordance with the values of justice in society.
