Abstract

Death Penalty in the Perspective of the Quran and Human Rights: A Comparative AnalysisThe law of qishash has drawn considerable attention from Human Rights activists due to the perception that the death penalty is incompatible with modern life, seen as highly inhumane and cruel. Conversely, qishash, as a divine law, is deemed obligatory, with non-compliance resulting in individuals being labeled as disbelievers, oppressors, and transgressors. This study explores how the Quran and Human Rights perceive the death penalty and investigates points of convergence and divergence between them. Using a qualitative, descriptive analysis approach, the research draws information from diverse sources, including documents, journals, scholarly works, and relevant books. Findings reveal disparities between anthropocentric and theocentric perspectives in interpreting the death penalty. From a Human Rights standpoint, the death penalty serves as a means to ensure societal safety and the right to life, aligning with Human Rights' core values emphasizing the sanctity of life. Moreover, the Quran, a significant Abrahamic religious text, promotes the preservation of life, with its ordinances understood as beneficial to humanity, as Allah is considered humanity's ultimate purpose. In essence, despite debates over the death penalty's application, both Human Rights and the Quran, with its divine legal standing, share a common goal of safeguarding and guaranteeing human life. Consequently, they fundamentally converge on this matter.

Abstract

This study aims to investigate one type in the Fintech area, namely the Central Bank Digital Currency, from the perspective of the Islamic economy.  This study uses a literature study approach to determine how Sharia positions the Central Bank Digital Currency as a currency or a medium of exchange and the effects on accounting. It also analyzes its suitability to be used as a medium of exchange. Then, the values obtained from CBDC searches and fiqh studies are synchronized with the functions of money: the medium of exchange, the standard of deferred payment, the store of value, and the unit of account. This research will investigate the concept of money with elements within it and analyze whether CBDC is inappropriate.  It will also explain the Islamic perspective and, precisely, the Sharia view of CBDC as a currency or medium of exchange. Abstrak Tujuan dari penelitian ini adalah untuk menyelidiki salah satu jenis di area Fintech, yaitu Central Bank Digital Currency  Dalam Perspektif Ekonomi Syariah. Penelitian ini menggunakann pendekatan studi literatur untuk mengetahui bagaimana Syariah memposisikan Central Bank Digital Currency sebagai mata uang atau sebagai alat tukar, serta pengaruhnya terhadap akuntansi, dan juga menganalisis kecocokannya untuk dijadikan sebagai alat tukar. Kemudian nilai-nilai yang didapatkan dari penelusuran CBDC dan telaah fiqih disinkronisasikan dengan fungsi uang yaitu medium of exchange, standart of deferred payment, store of value, dan unit of account. Penelitian ini akan menyelidiki konsep uang dengan unsur-unsur di dalamnya, dan menganalisis apakah CBDC memang sesuai atau tidak. Penelitian ini juga akan menjelaskan tentang perspektif Islam, dan tepatnya, pandangan Syariah tentang CBDC sebagai mata uang atau sebagai media pertukaran.

Abstract

This article analyzes sectarianism in the interpretation of Qur’anic verses concerning the relationship between Muslims and non-Muslims by comparing classical and modern exegesis from Sunni and Shia traditions. The study focuses on four thematic groups of verses: religious freedom, interfaith dialogue, political allegiance, and interfaith marriage. Employing Hans-Georg Gadamer’s philosophical hermeneutic framework, it explores how the historical and ideological horizons of the exegetes influence their interpretive outcomes. The findings reveal that classical commentaries, such as those of Ibn Kathir and al-Tha‘barsi, tend to be apologetic and normative, while modern exegeses by Wahbah al-Zuhaili and Muhammad Husain al-Thabathabai exhibit a more humanistic and contextual orientation. Despite their sectarian and methodological differences, both traditions share a common ethical aim—to maintain a balance between faith and humanity. This study underscores the significance of inter-sectarian exegetical dialogue as a means to foster an inclusive and universal understanding of Islam.

Abstract

Program rehabilitasi rumah pasca-bencana merupakan intervensi krusial, namun evaluasinya seringkali terbatas pada output fisik dan mengabaikan dinamika keberlanjutan jangka panjang. Pendekatan teknokratis ini kerap gagal menangkap kesenjangan persepsi antara tujuan manajerial pelaksana program dengan realitas yang dialami penerima manfaat. Penelitian ini bertujuan untuk menganalisis dinamika keberlanjutan program RR di Kabupaten Sumbawa Barat dengan membandingkan secara sistematis kedua perspektif tersebut. Menggunakan metode kualitatif studi kasus, data dikumpulkan melalui wawancara mendalam dengan 5 pelaksana program dan 10 penerima manfaat, didukung oleh observasi partisipatoris. Temuan menunjukkan adanya keselarasan pada keberhasilan fisik bangunan, namun mengungkap tiga kesenjangan fundamental pada: (1) makna kualitas (standar teknis vs. kenyamanan fungsional), (2) keberlanjutan ekonomi (visi pemberdayaan vs. realitas beban perawatan), dan (3) makna partisipasi (formalistik vs. substantif). Kesenjangan ini berakar pada perbedaan fokus: pelaksana berorientasi pada output, sementara penerima manfaat berorientasi pada outcome. Simpulan menegaskan bahwa keberlanjutan yang holistik menuntut pergeseran dari model intervensi teknis menuju kemitraan transformasional yang secara aktif menjembatani kesenjangan persepsi melalui dialog dan partisipasi yang substantif. Penelitian ini memberikan kontribusi teoretis dengan memperluas diskursus evaluasi pasca-bencana dari sekadar metrik teknis menuju perspektif sosio-psikologis, menempatkan persepsi subjektif penerima manfaat sebagai indikator keberhasilan yang setara dengan standar struktural. Sustainability Dynamics of a Housing Rehabilitation Program: A Dual Perspective Analysis from West Sumbawa Abstract Post-disaster housing rehabilitation (RR) programs are crucial interventions, yet their evaluations are often limited to physical outputs, neglecting long-term sustainability dynamics. This technocratic approach frequently fails to capture the perception gaps between the managerial objectives of program implementers and the lived realities of beneficiaries. This study aims to analyze the sustainability dynamics of an RR program in West Sumbawa Regency by systematically comparing these two perspectives. Employing a qualitative case study methodology, data were collected through in-depth interviews with 5 program implementers and 10 beneficiaries, supported by participant observation. Findings indicate a consensus on the physical success of the buildings but reveal three fundamental perception gaps concerning: (1) the meaning of quality (technical standards vs. functional comfort), (2) economic sustainability (empowerment vision vs. the reality of maintenance burdens), and (3) the meaning of participation (formalistic vs. substantive). These gaps are rooted in a core difference in focus: implementers are output-oriented, whereas beneficiaries are outcome-oriented. The study concludes that holistic sustainability requires a shift from a technical intervention model to a transformational partnership that actively bridges these perception gaps through dialogue and substantive participation. This study makes a theoretical contribution by expanding the discourse on post-disaster evaluation from mere technical metrics to a socio-psychological perspective, positioning the subjective perceptions of beneficiaries as success indicators equivalent to structural standards.
