Abstract

Criminalization Of Civil Disputes Is A Common Case In Indonesia. This Case Can Occur Because An Act Or Action May Violate Two Laws At The Same Time, Those Are Civil Law And Criminal Law. The Intersection Between A Civil Dispute And A Criminal Act Does Not Only Make The Borderline Between Civil And Criminal Cases Thin. Settlement Of Disputes Over Acts That Contain Elements Of Fraud Arising From A Contractual Relationship Through Civil Law Mechanisms By Filing A Lawsuit (Onrechtmatige Daad Or Default) Or Criminal Law Mechanisms (Wederrechtelijk), Is Often Confusing. How To Determine An Act With An Element Of Fraud Is Included In The Domain Of Criminal Or Civil Law And How To Resolve Disputes That Arise As A Result Of Fraud In A Timber Sale And Purchase Agreement (Case Study: Supreme Court Decision Number: 449k/Pid/2001), Is The Formulation Of The Problem, Which Will Be Discussed In This Paper Using Normative Legal Research Methods. Abstract

This article discusses the granting of inheritance to adopted children through mandatory wills based on Islamic law and the distribution of inheritance to adopted children based on various madhhabs in Indonesia. Inheritance is a mandatory right for heirs according to applicable regulations, must meet certain conditions, and must be obtained lawfully. Adopted children can also receive inheritance from their adoptive parents through obligatory wills. However, the distribution of inheritance to adopted children differs. This research addresses two questions: how is inheritance provided to adopted children through obligatory wills according to Islamic law, and how the distribution of inheritance to adopted children in various madhhabs in Indonesia. The research method used is normative juridical with legal and conceptual approaches. The findings indicate that inheritance provision to adopted children through obligatory wills in Islamic law requires the consent of other heirs if it exceeds the predetermined portion, and the distribution of inheritance to adopted children in various madhhabs is not the same as legitimate heirs, namely not more than one-third of the adoptive parent's estate.

Abstract

Acquiring land rights can be accomplished through various legal acts, one of which involves buying and selling. This research aims to examine the efficacy of guaranteeing debts and receivables through a binding sale and purchase agreement for both debt providers and recipients, as well as to analyze the legal protection afforded to them through such agreements. The research utilizes a normative legal research approach, employing both statutory research and a conceptual framework, and relies on secondary data sources such as statutory regulations, books, and scientific journals. The results of this research indicate that the strength of proof of guaranteeing debts and receivables through a binding sale and purchase agreement for the debtor and debt recipient is invalid and cannot serve as the basis for transferring land rights, except by a PPAT deed or auction. Furthermore, legal protection for guaranteeing debts and receivables cannot be obtained through a valid sale and purchase agreement for the debt provider and the debt recipient. Appropriately, debt and receivable agreements should be guaranteed using mortgage rights.

Abstract

The authority of Consumer Dispute Settlement Agency (BPSK) in settling consumer dispute is regulated in a limited cause. In the Verdict No. 16 PK/Pdt.Sus-BPSK/2020, Judges verdict that BPSK has no authority in giving verdict for settling dispute between pawn giver and pawn taker in the case of pawn auction. This happen though the verdict of BPSK has been approved by Judges of first degree court and appellate court. The verdict was analyzed in this writing with the qualitative method. BPSK is alternative dispute resolution board between consumer and business industry. Agreement with pawn company and pawn giver was mainly debt agreement, not agreement between consumer and business industry, therefore BPSK has no authority in in settling the dispute. In which, pawn auction dispute must be submitted to the court not BPSK.

Abstract

Transformasi digital dalam praktik kenotariatan di Indonesia, khususnya melalui konsep Cyber Notary, menghadapi tantangan terkait kedudukan alat bukti elektronik dan keabsahan tanda tangan elektronik. Pengakuan terhadap dokumen elektronik sebagai alat bukti hukum yang sah memerlukan regulasi yang jelas untuk memastikan validitasnya. Penelitian ini bertujuan untuk menganalisis kedudukan dan kekuatan pembuktian alat bukti tertulis dalam hukum perdata Indonesia, dengan fokus pada perbandingan antara akta otentik dan akta di bawah tangan, serta mengkaji keabsahan tanda tangan elektronik dalam konteks Cyber Notary. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data dikumpulkan melalui studi kepustakaan terhadap peraturan perundang-undangan, literatur hukum, dan jurnal ilmiah terkait, serta dianalisis secara kualitatif. Penelitian menemukan bahwa dokumen elektronik dan tanda tangan elektronik diakui sebagai alat bukti hukum yang sah, meskipun memerlukan pengakuan tambahan untuk disetarakan dengan akta otentik. Kekuatan formil dokumen elektronik dapat setara dengan akta otentik jika memenuhi syarat regulasi, termasuk sertifikasi tanda tangan elektronik dan sistem keamanan yang memadai. Penelitian ini berimplikasi pada perlunya harmonisasi regulasi antara UU ITE dan UU Jabatan Notaris, penguatan infrastruktur teknologi, serta peningkatan kompetensi notaris untuk mendukung implementasi Cyber Notary yang efektif dan aman di Indonesia.
