Abstract

Anak merupakan titipan dan anugerah dari Tuhan Yang Maha Esa, yang memiliki nilai dan martabat sebagai manusia sepenuhnya. Anak adalah harapan masa depan, dengan potensi dan perannya sebagai generasi muda penerus perjuangan bangsa. Mereka memiliki peran penting dan karakteristik khusus yang menjamin keberlanjutan bangsa dan negara di masa mendatang. Tujuan dari penelitian ini adalah untuk menggambarkan bagaimana hak anak luar nikah untuk menjadi ahli waris menurut perspektif hukum di Indonesia, sehingga keluarga atau masyarakat yang mengalami permasalahan terkait dengan anak luar nikah, bisa menuntut suami atau laki-laki yang karena perbuatannya sehingga lahirnya anak diluar kawin untuk mempertanggungjawabkan perbuatannya. Penelitian ini memakai metode normatif yuridis dengan pendekatan terhadap peraturan hukum serta pendekatan konseptual. Data yang digunakan berupa bahan hukum primer, yaitu Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, serta Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Negara Kesatuan Republik Indonesia menjamin kesejahteraan warga negaranya, termasuk perlindungan hak anak sebagai hak asasi manusia, karena anak merupakan amanah dan generasi penerus bangsa. Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 menyatakan bahwa anak luar kawin memiliki hubungan perdata dengan ayah dan keluarganya, selama dapat dibuktikan melalui ilmu pengetahuan atau bukti hukum yang relevan.

Abstract

The purpose of this research is to examine the complexity of pilot law and encourage the authorities to monitor the urgency of pilot law in Indonesia and the country's economic development even during the Covid-19 pandemic. Start-up companies are companies that have just entered or are still under development or research to continue to find markets and develop their products. In the competitive nature of a fast-paced industry, it is important to identify the problems companies face in order to improve business performance by finding root causes and finding effective solutions. One of the problems in start up companies is the regulation that governs the company's activities. The lack of special regulations for business start-ups hampers the sustainability of companies and other impacts of business start-ups. Start ups in Indonesia have indeed shown significant growth. On the other hand, start ups in Indonesia face challenges that often lead to start up failure. One of the reasons for this failure is that start ups are in a vortex of legal complexities that do not match the characteristics of the start up itself, thus requiring a more appropriate and flexible legal structure

Abstract

The transformation of local cultural values in the lives of young people is becoming an increasingly relevant issue in the midst of rapid globalization and accelerated urbanization. This article aims to examine how these two major forces affect the understanding, appreciation, and practice of local cultural values among the younger generation. Globalization brings popular culture, information technology and transnational lifestyles that often conflict with traditional values such as collectivity, respect for customs and emotional attachment to local communities. Meanwhile, urbanization creates a social environment that tends to be anonymous, competitive and pragmatic, thus diminishing the role of traditional social environments as guardians of cultural values. Through an in-depth literature study, this article finds that young people in various parts of Indonesia experience a complex process of cultural identity negotiation. On the one hand, they are exposed to modern values that promise progress and social mobility, but on the other hand, they still have cultural ties inherited by family and community. This transformation process is not linear, but rather shows a pattern of selective adaptation that can open up opportunities for the revitalization of local culture in a new format that is more contextual and relevant. With a reflective and participatory approach, education based on local culture and digital media can be an important tool in bridging traditional values with the dynamics of modern life of the younger generation
