Abstract

Salah satu asas yang penting dalam hukum jaminan kebendaan adalah Asas Publisitas. Asas ini bermakna bahwa pembebanan atas benda dengan hak jaminan harus memenuhi kewajiban mengumumkan ke masyarakat. Semua jaminan kebendaan, baik itu Gadai, Hipotek, Fidusia, maupun Hak Tanggungan harus memenuhi asas publisitas. Penelitian ini bertujuan untuk menggali dasar filosofis dan karakteristik asas publisitas dalam jaminan kebendaan. Dalam penelitian ini digunakan metode penelitian normatif dengan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian dan temuan menunjukkan bahwa dasar filosofis asas publisitas adalah pengakuan dan penghormatan atas hak orang lain, yang pada akhirnya bertujuan melindungi hak orang. Karekteristik publisitas dalam jaminan kebendaan tergantung pada jenis benda yang menjadi objek jaminan kebendaan. Publisitas pada Gadai dilakukan melalui penguasaan benda Gadai oleh Penerima Gadai, sedangkan pada Hipotek, Fidusia, dan Hak Tanggungan, publisitas dilakukan dengan pendaftaran benda jaminan.

Abstract

The legal issues of this research consist of the application of the consensualism principle in land procurement for development for the sake of public interest. The method of this research is normative legal research by applying statute approach, conceptual approach.The results of this research there is deviation in the enforcement of the consensualism principle in Article 66 paragraph 4 of Act Number 2 of 2012 which determines that deliberation towards consensus isn only in a form of compensation, is contrary to Article 37 paragraph 1 and 2 of Act Number 2 of 2012  which stipulates that deliberation is conducted in determining the form and/or the amount of compensation. The provision of Article 42 of Law Number 2 Year 2012 which determines the reason for consignment or care for compensation in a State court shall be done if the entitled to be denied the form and / or amount of compensation, replace with the principle of agreement because it is done without based on the agreement of the parties, With the essence of deliberation that requires an agreement.

Abstract

Fungsi notaris yang dimaksud adalah notaris yang ikut andil dalam transaksi dilakukan melalui sarana elektronik. Transaksi yang dilakukan melalui sarana elektronik termasuk dalam perbuatan hukum, dimana notaris berposisi sebagai pihak yang mempunyai kewenangan khusus secara langsung diatur dalam undang-undang. Notaris mempunyai kewenangan tambahan berupa melakukan validasi terhadap transaksi yang dibuat melalui sarana elektronik (cyber notary). Penelitian ini menggunakan metode penelitian normatif hukum, serta data primer dan sekunder. Teknik untuk mengumpulkan data statue approach untuk meneliti objek penelitian melalui peraturan-peraturan perundang-undangan serta regulasi terkait dengan isu hukum yang ditangani. Keikutsertaan notaris dalam proses sertifikasi telah diatur sebagian dalam UU ITE, tujuan dari sertifikasi sendiri adalah memastikan adanya kepastian hukum dan perlindungan bagi masyarakat dalam perkembangan teknologi. Secara eksklusif fungsi notaris dalam sertifikasi meliputi dua hal, yaitu sertifikasi (legalisasi) dan autentifikasi. Hasil dari penelitian menunjukkan bahwa notaris memiliki dua fungsi utama dalam penyelenggaraan sertifikasi elektronik, yaitu sertifikasi dan autentifikasi. Kedua fungsi tersebut dijelaskan dalam beberapa peraturan perundang-undangan dan lembar tambahan negara, salah satunya UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) dan Peraturan Pemerintah No. 82 Tahun 2012 tentang Penyelengaraan istem dan Transaksi Elektronik.

Abstract

Tujuan penelitian adalah untuk mengetahui eksistensi asas indissolubility dalam hukum kanonik dan hukum perkawinan nasional terhadap putusan pengadilan yang memutus perkawinan katolik; dan untuk mengetahui kedudukan hukum suami istri yang beragama katolik setelah putusan pengadilan akibat perceraian. Jenis penelitian hukum normatif merupakan penelitian hukum yang dilakukan dengan cara meneliti dan menggunakan bahan hukum yaitu bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang didapat dari penelitian kepustakaan (library research). Menurut hasil penelitian bahwa pengadilan tidak mempertimbangkan serta tidak memaknai ketentuan hukum agama Katolik.

Abstract

Notary Notaries as public officials have an important role in ensuring legal certainty and protection in every agreement, including in the transfer of subsidized home ownership credit. Many credit transfers are carried out underhand, without the consent of the bank and without an authentic deed from the notary, thus creating legal uncertainty for new debtors who take over credit obligations. This study uses a normative legal research method with a statute approach, a conceptual approach, and a legal theory approach. The data used are secondary data in the form of primary, secondary, and tertiary legal materials which are analyzed qualitatively with descriptive analysis techniques. The results of the study show that: Notaries have the authority to make authentic deeds in the transfer of home ownership credit as regulated in Article 15 paragraph (1) of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (UUJN). Credit transfers carried out without a notarial deed and without the bank's approval are not legally recognized and are only considered as underhand agreements that have limited evidentiary power, and the failure to involve a notary in the credit transfer process can have legal consequences for the parties, especially for new debtors who do not have a clear legal standing, and are at risk of losing their rights to the house they have paid for.

Abstract

Notaries as public officials have territorially limited authority in carrying out their duties based on Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Positions (UUJN). This study examines the legal problems that arise when a notary signs a deed outside his/her area of ??office, which is a violation of the provisions on the territorial authority of a notary. This study uses a normative legal research method with a statute approach and a conceptual approach. The data used are secondary data in the form of primary, secondary, and tertiary legal materials which are analyzed qualitatively using descriptive analysis techniques. The results of the study indicate that: First, the status of a deed signed outside the notary's area of ??office experiences a degradation of evidentiary power. Based on Article 15 paragraph (1) UUJN which states that a notary is authorized to make authentic deeds regarding all acts, agreements, and determinations required by laws and/or desired by the interested party to be stated in an authentic deed, but is limited to the area of ??his/her office as regulated in Article 17 paragraph (1) letter a UUJN. Deeds made outside the area of ??his/her office lose their authenticity and only have the power of proof as a private deed. Second, the legal consequences for a notary who signs a deed outside the area of ??his/her office can be in the form of administrative, civil, and criminal sanctions. Administrative sanctions are in the form of verbal warnings, written warnings, temporary dismissal, honorable dismissal, or dishonorable dismissal as regulated in Article 17 paragraph (2) UUJN.

Abstract

In inheritance law, it has been regulated regarding inheritance for extra-marital children differently in accordance with the principles regulated by civil inheritance law which certainly rests on justice. In a condition where an extra-marital child who does not get recognition, can get inheritance through testamentair or will. The granting of a will containing efrstelling in the form of an openbaar testament to an unrecognized extra-marital child is an effort to fulfill a sense of justice. Justice is basically a relative thing, which does not always have to be the same, something can be said to be fair if it has done something according to the appropriate provisions. As the concept of distributive justice put forward by Aristotle, namely justice that gives everyone a portion according to their achievements. This legal research method is normative legal research. The approaches in this research are statutory, and conceptual approaches. The results of this study state that wills containing efrsteling against unrecognized extra-marital children in the form of openbaar terstamen have provided a sense of justice. This is because the Openbaar testament to an unrecognized extra-marital child has fulfilled the provision of rights to all heirs including extra-marital children who get a share in the inheritance, in other words, the principle of justice has been fulfilled due to the openness of the testator made before a notary and in the presence of witnesses. The notary plays a role in providing legal counseling to the person who will make a testament on an extra-marital child. The granting of Openbaar Testamen to extra-marital children has fulfilled a sense of justice. This is because the Openbaar Testament is an open form of testament so that the child outside of marriage can know the part to which he is entitled.

Abstract

To achieve nationwide land registration in Indonesia, despite regulatory support, systematic challenges persist in expediting the process known as Complete Systematic Land Registration (PTSL). These hurdles may impede the fulfillment of the mandate outlined in Article 19(1) of Law No. 5 of 1960. The research conducted is of a normative legal nature, focusing on legal norms, aligning with Peter Mahmud Marzuki's definition of legal research as inherently normative. The findings on Complete Systematic Land Registration in the Tapin Regency Land Office Area indicate that unregistered land owners face uncertainty and lack legal protection until their land is officially registered. Although Indonesia's land registration publication system allows for objections or lawsuits, legal certainty and protection are only guaranteed post-registration. The government aims to enhance certainty and protection through the PTSL program, emphasizing the importance of land certificates. However, despite serving as legal evidence of ownership, these certificates are not absolute in legal proceedings and can be subject to civil, criminal, or administrative challenges due to Indonesia's adversarial land registration system.
