Abstract

Banyaknya regulasi atau peraturan perundang undangan yang di buat tidak berdasarkan standar penulisan dan tata cara penulisan serta asas pemberlakuan perundang undang Harmonisasi peraturan perundang undangan berkaitan dengan hirarki peraturan perundang undangan yang mana peraturan yang lebih rendah kedudukannya tidak boleh bertentangan dengan peraturan perundang undangan yang lebih tinggi. Tujuan harmonisasi peraturan perundang undangan mencegah dan mengatasi terjadinya disharmonisasi hukum. Harmonisasi juga dapat menjamin proses pembentukan rancangan Undang-Undang yang taat asas demi kepastian hukum. Metode penelitian yang digunakan adalah metode penelitian empiris dengan pendekatan kajian perundang undangan dan pendekatan konsep dan sosiologis. Analisa data yang digunakan adalah metode penafsiran perundang undangan dan penafsiran autentik serta data lapangan. Hasil penelitian ini diharapkan untuk mewujudkan norma yang harmonis di antara peraturan perundang undangan, baik harmonisasi vertical dan harmonisasi horizontal.         Dengan terlaksananya harmonisasi peraturan perundang undangan baik harmonisasi vertikal maupun harmonisasi horizontal akan membawa dampak yang lebih baik dalam penyelenggaraan pemerintahan karena ciri pemerintahan yang baik adalah akuntabilitas, transparansi, keterbukaan dan adanya aturan hukum .

Abstract

Pemerintah Provinsi Nusa Tenggara Barat mengeluarkan Peraturan Daerah (Perda) Nomor 2 Tahun 2016 tentang Pariwisata Halal, regulasi tersebut tentunya tidak keluar begitu saja namun melalui proses yang panjang dan sering disebut dengan proses kebijakan Setiap. langkah dari proses kebijakan ini memerlukan kajian yang mendalam dan ekstensif terhadap seluruh unsur dan komponen pemerintah daerah agar kebijakan publik tersebut dapat terwujud. Dari tahapan proses kebijakan tersebut salah satu yang terpenting adalah implementasi kebijakan karena sebaik apapun yang dilakukan pada langkah-langkah sebelumnya jika implementasinya tidak berhasil maka gagallah kebijakan publik. Tujuan penelitian ini untuk mengetahui Implementasi Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 2 Tahun 2016 Tentang Pariwisata Halal dan faktor penghambat dan pendukungnya, jenis penelitian ini adalah penelitian empiris, metode yang digunakan dalam penelitian ini adalah metode penelitian deskriptif kualitatif dengan pendekatan induktif sehingga dapat mengungkap kejadian nyata di lapangan. Hasil penelitian ini berdasarkan Analisis yang dilakukan bahwa implementasi peraturan daerah Nomor 2 Tahun 2016 masih belum optimal mengingat Wisata halal menjadi pilihan karena baik pengusaha maupun masyarakat diberikan 2 (dua) alternatif Wisata Konvensional atau Wisata Halal, disamping itu juga kegiatan wisata halal ini sangat sedikit koordinasi kerjasama dengan Dinas Pariwisata Provinsi, terutama terkait keuangan dan studi banding dengan negara-negara yang mengembangkan wisata halal, sementara kendalanya adalah  Sarana dan Sumber Daya Pembiayaan, dalam mengembangkan sarana wisata Halal di Dinas Pariwisata Provinsi mengalami kesulitan karena Destinasi Wisata terletak di Kabupaten/Kota, karena Kabupaten/Kota belum siap Sumber Daya termasuk Anggaran Sementara Destinasi Pariwisata merupakan daerah atau wilayah geografis di dalam atau lebih wilayah administratif (kabupaten/kota) yang di dalamnya terdapat unsur: daya tarik wisata, sarana wisata, aksesibilitas, masyarakat dan wisatawan yang saling berhubungan dan utuh untuk terwujudnya kegiatan kepariwisataan, selain itu sturuktur orgnisasi penyelenggara wisata halal dari non pemerintah cukup banyak sehingga sulit mendapatkan kesepakatan gerak dan arah meningkatkan pembangunan dan pengembangan wisata halal di Nusa Tenggara Barat.

Abstract

Introduction: Communal Intellectual Property can be used to support the development of Intellectual Property-based Tourism.Purposes of the Research: The purpose of this study is to examine the effectiveness of the law in implementing the Identification and Inventory of Communal Intellectual Property as a form of preventive legal protection for Communal Intellectual Property (IPR) and government efforts in implementing the Identification and Inventory of Communal Intellectual Property to support Intellectual Property-based Tourism Development.Methods of the Research: The research method used in this study is a socio-legal approach. The data analysis technique used is a qualitative descriptive analysis technique.Results of the Research: The implementation of the Identification and Inventory of Communal Intellectual Property in Central Lombok Regency has not been effective. This is because the identification and inventory of Communal Intellectual Property (CIP) has not been implemented in an orderly manner by the local government/community so that legal certainty and justice are achieved for CIP owners/Communal communities. The Government Regulation has not been complied with and enforced. There is a discrepancy between the rules and their implementation. In addition, the level of community compliance, Law enforcement by law enforcement officers also has a major influence on the effectiveness of the law. Government efforts to overcome the ineffective implementation of Identification and Inventory, include making Regional Regulations that require each Village to identify and inventory Communal Intellectual Property, establishing Partnerships and Cooperation with third parties or managers in utilizing Communal Intellectual Property for the development of Intellectual Property-based tourism, Regional Governments must encourage investors to invest their capital in building Infrastructure and Facilities for Tourism Destinations based on Intellectual Property, Utilizing Technology and Digital Marketing for the development of Intellectual Property-based Tourism, and Regional Governments must focus and pay special attention to the Intellectual Property-based tourism industry.

Abstract

The province of West Nusa Tenggara, which consists of two islands (Lombok and Sumbawa), has 8 regencies and 2 cities with its capital in Mataram. It is one of the provinces in Indonesia, and its vision and mission is to lead its people towards prosperity, as outlined in the vision and mission of the province of West Nusa Tenggara, namely: ‘Moving forward’ is the vision of the Acting Governor of West Nusa Tenggara in leading the provincial government to make West Nusa Tenggara more advanced and move forward with a stronger accelerative spirit. The West Nusa Tenggara government continues to develop and advance the region. Its efforts for a more advanced West Nusa Tenggara are not merely about appearance but also about acceleration. West Nusa Tenggara is ready to continue moving forward and become an even better province in the future. However, in implementing this vision and mission, West Nusa Tenggara faces significant challenges related to achieving the well-being of its people, particularly the high rate of early marriage. This is a major issue in West Nusa Tenggara and requires special attention to resolve it, ensuring that the people of West Nusa Tenggara can achieve their well-being. The objectives of this study are: 1. To analyse the causes of child marriage, 2. To understand local wisdom and the role of local governments in addressing child marriage, 3. To analyse the challenges faced in addressing child marriage. This research employs a qualitative research approach. Data collection methods include interviews, documentation, observation, and literature review. Child marriage occurs due to several factors, including technology, such as smartphones, as most children now own Android smartphones, leading to free-wheeling social interactions. There is also a lack of clear guidelines addressing this issue, and there is a need for a Memorandum of Understanding (MOU) between traditional leaders, community leaders, and the local government to reduce the incidence of child marriage.

Abstract

The legal principles of agreements in employment agreements for Indonesian migrant workers (TKI) abroad aim to determine the application of legal principles of agreements in the placement of Indonesian migrant workers (PMI) abroad, and entering into employment agreements with people we do not know as well as the factors that cause violations of employment agreements for the placement of TKI abroad. This research is normative research, namely legal research conducted by examining library materials or in other words using secondary data, namely laws and regulations, Ministerial decisions, legal theories and expert opinions. The results of the research on the application of legal principles of agreements in the placement of Indonesian migrant workers (PMI) abroad have not been implemented properly. Coercion, fraud and abuse of circumstances occur in the placement of PMI abroad caused by the economic, social, educational or psychological conditions of the prospective PMI in the employment agreement which results in the service user in this case through the PMI placement company being more dominant in determining the terms and conditions of the employment agreement. This kind of agreement is known as Adhesie Contracten. This agreement condition is possible considering that the Civil Code does not adhere to the principle of Justuta Pretitum, so there are no requirements that require the creation of a balance between the achievements of both parties, as a result many PMI are required to carry out work that is identical to the 4Ds, namely Dirdy (dirty), and Gerous (dangerous), Demand (demand), and Death (death) which usually occurs in a closed (domestic) work environment. Factors that violate the law against TKI who are abroad are caused by, among other things, the structure of the labor market in Indonesia.

Abstract

Pemerintah Kecamatan di era otonomi Daerah, sudah banyak mengalami perubahan seiring dengan perubahan paradigm pemerintahan sebagaimana diamanatkan di dalam Undang Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Tujuan kedudukan dan tugas Camat di era Otonomi Daerah untuk meningkatkan koordinasi penyelenggaraan pemerintahan, pelayanan public, melaksanakan pembangunan serta pemberdayaan masyarakat Desa/ Kelurahan. Metode yang digunakan adalah metode penelitian empiris dengan pendekatan kajian Perundang Undangan dan pendekatan konsep dan sosiologis. Analisis data yang digunakan adalah metode penafsiran perundang undangan dan penafsiran autentik serta data lapangan. Hasil yang diharapkan adalah pemerintah Kecamatan dituntut bersikap peka terhadap perubahan yang terjadi. Semua pelayanan public dan layanan sipil yang semula konvensional sekarang dituntut harus berbasis teknologi, Camat selaku kepala pemerintahan di tingkat Kecamatan serta unit unit pemerintahan lainnya termasuk pemerintahan Desa/Kelurahan hendaknya melakukan kerja sama dan koordinasi di semua sektor.Abstract. Subdistrict governments in the era of regional autonomy have experienced many changes in line with changes in the government paradigm as mandated in Law Number 23 of 2014 concerning Regional Government. The aim of the position and duties of the sub-district head in the Regional Autonomy era is to improve coordination of government administration, public services, carry out development and empower village/district communities. The method used is an empirical research method with a statutory study approach and a conceptual and sociological approach. The data analysis used is the method of statutory interpretation and authentic interpretation as well as field data. The expected result is that the sub-district government is required to be sensitive to the changes that occur. All public services and civil services that were previously conventional are now required to be technology-based. The sub-district head as head of government at the sub-district level and other government units, including village/sub-district governments, should collaborate and coordinate in all sectors.

Abstract

Desa Hu’u -Kecamatan Hu’u - Kabupaten Dompu, merupakan desa wisata yang ditetapkan berdasarkan Surat Keputusan Gubernur NTB tentang Penetapan 99 Desa Wisata di Provinsi NTB. Tujuan kegiatan penyuluhan adalah untuk memberikan pemahaman tentang perancangan peraturan desa, siapa saja yang terlibat dalam merancang peraturan desa, dan merancang peraturan desa tentang pungutan. Metode yang digunakan, partisipatif, mendengarkan materi perancangan peraturan desa, selanjutnya dilakukan focus group discussion (FGD). Metode ini diharapkan dapat menggali potensi pungutan di Desa Hu’u sebagai desa wisata, Simpulan, Peraturan desa tentang pungutan, dibuat untuk mempercepat terwujudnya kesejahteraan masyarakat melalui peningkatan pelayanan, pemberdayaan, dan peran serta masyarakat dengan memperhatikan prinsip demokrasi, pemerataan, keadilan, keistimewaan dan kekhususan suatu daerah, juga untuk mengefektifkan implementasi kewenangan dalam mengatur dan mengurus kepentingan masyarakat desa. Perancangan peraturan desa tentang pungutan dibuat oleh Kepala Desa dan BPD, wajib dikonsultasikan kepada masyarakat desa, dan dapat dikonsultasikan kepada Camat untuk mendapatkan masukan. Abstract

The Kelurahan (urban village) government in the era of Regional Autonomy has undergone many changes in line with the shift in governance paradigms as mandated by Law No. 23 of 2014 on Regional Government and Government Regulation No. 73 of 2005 on Kelurahan. The purpose of structuring Kelurahan and implementing governance in the Regional Autonomy era is to improve the coordination of governance, public services, development implementation, and the empowerment of village/kelurahan communities. The method used is empirical research with a legislative review approach, as well as conceptual and sociological approaches. The data analysis method employed is the interpretation of legislation and authentic interpretation. The expected outcome is that the Kelurahan government is required to be transparent with the community regarding both development programs and the budget received, thus fostering high levels of trust in the Kelurahan government from the public, thereby realizing the vision and mission of the Kelurahan. All public services and civil services, which were previously conventional, are now required to be technology-based. The Lurah, as the head of the government at the Kelurahan level, along with other government units including the Technical Implementation Unit, should cooperate and coordinate in all sectors by empowering the community, thereby creating a just, prosperous, and prosperous society.
