Abstract

Sumbawa Besar Institution Class II A Correctional System in April 2021 has been inhabited by 558 prison inmates assisted whose capacity ideal should be 250 inmates. For this reason, it is predicted that the number of inmates will continue to increase in the next few years, excess capacity tends to negative implications for the inmates, for example the low level of supervision. In managing prisons, it is necessary to pay attention to factors that worsen conditions in prisons, including: excess inmates, poor prison conditions, riots among prisoners and others. This condition is made worse by the occurrence of a Coronavirus Disease 2019 (Covid-19) which has spread and caused an increasing number of victims losses in Indonesia. It was found that the social reintegration development model carried out in class II A Sumbawa prisons is guided by the two Decrees of the Ministry of Law and Human Rights. In the prison, circulation of visitors is limited in order to prevent the spread of the virus. Spiritual cleansing activity is no longer uses preachers from the Ministry of Religion but rather maximizes religious assistants taken from Class II A Sumbawa Correctional Institution employees, as well as agricultural, workshop and carpentry activities that no longer involve third parties.

Abstract

Implications of Constitutional Court Decision No. 14 / PUU-XI / 2013 on General Election In Unison. Law No. 8 Year 2011 concerning the Constitutional Court in Article 47 states that the Constitutional Court's decision had permanent legal power since completed pronounced a plenary session open to the public, so that the provisions of article that declared contrary to the 1945 Constitution as positive since the Constitutional Court decision was read, missing positive qualities as legal and can not be used as a basis for legitimate legal action. However, in order to enforce the law and justice for the people as holders of constitutional rights, the Constitutional Court is required to make breakthroughs law to be able to arrive in the idea that sometimes can not be reached by applicable law, as well as legal consequences in delaying the decision.Keywords: Constitutional Court, Effects,Simultaneous Election

Abstract

The purpose of this research is to find out the constitutionality of dismissal of judges of the Constitutional Court by the House of Representatives People. This research is a type of normative legal research that uses approach methods with legislation. The research results explain that The move of the House of Representatives towards the Constitutional Court is getting worse shows an attitude of authoritarianism and lawlessness, because the DPR violates the provisions of Article 24 paragraph (1) of the 1945 Constitution (1945 Constitution) which guarantee the existence of the independence of the judiciary power institution, the existence of regulations clear and firm regarding the possibility of dismissing a constitutional judge before the expiration of the term of office is intended to maintain independence and at the same time maintain the independence of judges, for this reason the dismissal of constitutional judges who do not referring to the rules of the Constitutional Court Law can be stated unconstitutional. Actions taken outside the provisions of the norms of Article 23 of the Constitutional Court Law is not in line with the 1945 Constitution because it has the potential to damage and disrupt judicial power as the main stronghold of the rule of law.

Abstract

Controversy ensued when the public judged that the President had turned a blind eye to the unconstitutional removal of Aswanto by issuing a policy on dismissing Aswanto and at the same time appointing Guntur judges, namely Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges. Based on this, problems were found, regarding the validity of a state administrative decision and how the validity of Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges. The research method used is normative juridical method, using statutory approach, case approach, and conceptual approach. The results of the study show that the KTUN has validity if it fulfills the material and formal requirements, as well as the conditions specified in Article 52 of Law Number 30 of 2014. Then Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges is invalid because it does not comply with the provisions in Article 52 paragraph (2) of Law Number 30 of 2014.

Abstract

Meskipun perubahan UUD 1945 dimaksudkan untuk memberikan pembatasan kekuasaan tehadap kekuasaan Presiden yang terlalu besar (executive heavy) dan meletakkan pembagian kekuasaan dalam prinsip yang saling seimbang (checks and balances), bukan berarti perubahan UUD 1945 sudah berhasil menata karut marut pembatasan kekuasaan dan kinerja lembaga negara. Penelitian ini bertujuan menganalisis hakikat/esensi prinsip checks and balances dalam perspektif negara hukum Pancasila dan bagaimana rekonstruksi prinsip checks and balances antara lembaga eksekutif, legislatif dan yudikatif berdasarkan Pancasila. Penelitian merupakan penelitian hukum normatif yang mengutamakan data sekunder, dengan pendekatan, Statuta Approach, Conceptual Approach, dan Historical Approach. Hasil penelitian ini menunjukkan bahwa Prinsip checks and balances antar lembaga negara merupakan suatu hal yang sangat penting, yaitu untuk membatasi kekuasaan antar lembaga negara. Meskipun demikian, masih ada kelemahan-kelemahan checks and balances yang dirasakan. Dengan demikian, perlu gagasan rekonstruksi prinsip checks and balances yang bersumber pada Pancasila, yang terbukti telah mampu bertahan meski telah diuji dengan berbagai problematika ketatanegaraan. apabila Prinsip checks and balances itu memperhatikan dan mengamalkan nilai-nilai yang terkandung dalam Pancasila, lembaga negara di Indonesia akan kembali pada khittohnya sebagai bangsa yang berketuhanan, beradab, bersatu dalam hikmah kebijaksaan, dan berkeadilan sosial.

Abstract

Penelitian Studi Kasus : Tujuan penelitian ini adalah untuk mengetahui perkembangan Politik Hukum Agraria Indonesia pada Arus Globalisasi. Untuk mendapatkan hasil penelitian yang berkualitas, maka metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif-empiris. Dimana penelitian yang meneliti aturan terkait pengaturan hukum agraria dan pendapat-pendapat para ahli (law in the book), serta melihat implementatifnya (konflik agraria di lapangan) guna mengetahui bagaimana pelaksanaannya di lapangan (law in action). Guna mempermudah penelitian ini digunakan metode pendekatan undang-undang (stattue approach), pendekatan konseptual (conceptual approach) dan pendekataan sosiologis (sociologist approach). Hasil pemelitian yang dihasilkan adalah bahwa politik agraria populis/neo populis, yaitu politik agraria yang mengakui hak individu atas tanah, tetapi hak tersebut mempunyai fungsi sosial. Maka sentralisasi kekuasaan pemerintah di bidang pertanahan yang selama ini banyak menimbulkan sengketa dan konflik yang berkepanjangan perlu dilakukan pengkajian ulang dalam bentuk kebijakan pro rakyat yang konkrit dalam rangka menghadapi arus Globalisasi, Setidaknya ada tiga 3 (tiga) aspek yang perlu direformasi dalam rangka adaptasi arus Globalisasi antara lain Aspek Isi (Content of The Law); Struktur (Structure of The law/Administrative of Law),dan Aspek Budaya Hukum (Culture of Law).

Abstract

This research aims to confirm that public participation has been accommodated and actualized in the policy and the implementation of the zero-waste policy in Mataram City from a sustainable development perspective. The particular purpose of this research is to identify the involvement of the community, viewed through public participation and sustainable development indicators, in the policy and its implementation of the Zero Waste policy, which can be used as correction and evaluation for related stakeholders. The method used in this research is the normative-empirical research method, which incorporates normative legal elements supported by additional data or empirical elements. The approaches adopted were conceptual, statutory approaches, and observation of facts in the field. The types of data employed include primary data (in the form of observation of data or facts in the field) and secondary data, consisting of primary legal materials, that is, a regional regulation related to the Zero Waste Policy. Data collection techniques were literature studies and field studies, and then the data were analyzed using qualitative methods and presented descriptively.

Abstract

This study discusses the Corruption Eradication Commission (KPK) since 2019 there has been a significant change, because the second amendment to the KPK Law has been ratified through Law Number 19 of 2019, Indonesia's ranking index is at 115, amputated authority and declining performance. The study conducted a comparative approach between the Indonesian KPK and the corruption eradication institutions of Hong Kong, Japan, Australia and New Zealand. It was found that Asian and Australian countries have less authority, but are ranked high (3 to 14) in eradicating corruption compared to Indonesia which is ranked 115. The results of the study show that there has been a change in the position of the KPK institution in terms of state administration which is no longer an Auxiliary body but a state organ, full authority but requires permission from the supervisory board, accountability and full control by the government (executive).

Abstract

Pemerintah Provinsi Nusa Tenggara Barat mengeluarkan Peraturan Daerah (Perda) Nomor 2 Tahun 2016 tentang Pariwisata Halal, regulasi tersebut tentunya tidak keluar begitu saja namun melalui proses yang panjang dan sering disebut dengan proses kebijakan Setiap. langkah dari proses kebijakan ini memerlukan kajian yang mendalam dan ekstensif terhadap seluruh unsur dan komponen pemerintah daerah agar kebijakan publik tersebut dapat terwujud. Dari tahapan proses kebijakan tersebut salah satu yang terpenting adalah implementasi kebijakan karena sebaik apapun yang dilakukan pada langkah-langkah sebelumnya jika implementasinya tidak berhasil maka gagallah kebijakan publik. Tujuan penelitian ini untuk mengetahui Implementasi Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 2 Tahun 2016 Tentang Pariwisata Halal dan faktor penghambat dan pendukungnya, jenis penelitian ini adalah penelitian empiris, metode yang digunakan dalam penelitian ini adalah metode penelitian deskriptif kualitatif dengan pendekatan induktif sehingga dapat mengungkap kejadian nyata di lapangan. Hasil penelitian ini berdasarkan Analisis yang dilakukan bahwa implementasi peraturan daerah Nomor 2 Tahun 2016 masih belum optimal mengingat Wisata halal menjadi pilihan karena baik pengusaha maupun masyarakat diberikan 2 (dua) alternatif Wisata Konvensional atau Wisata Halal, disamping itu juga kegiatan wisata halal ini sangat sedikit koordinasi kerjasama dengan Dinas Pariwisata Provinsi, terutama terkait keuangan dan studi banding dengan negara-negara yang mengembangkan wisata halal, sementara kendalanya adalah  Sarana dan Sumber Daya Pembiayaan, dalam mengembangkan sarana wisata Halal di Dinas Pariwisata Provinsi mengalami kesulitan karena Destinasi Wisata terletak di Kabupaten/Kota, karena Kabupaten/Kota belum siap Sumber Daya termasuk Anggaran Sementara Destinasi Pariwisata merupakan daerah atau wilayah geografis di dalam atau lebih wilayah administratif (kabupaten/kota) yang di dalamnya terdapat unsur: daya tarik wisata, sarana wisata, aksesibilitas, masyarakat dan wisatawan yang saling berhubungan dan utuh untuk terwujudnya kegiatan kepariwisataan, selain itu sturuktur orgnisasi penyelenggara wisata halal dari non pemerintah cukup banyak sehingga sulit mendapatkan kesepakatan gerak dan arah meningkatkan pembangunan dan pengembangan wisata halal di Nusa Tenggara Barat.

Abstract

The regulation of the execution of State Administrative Court (TUN) decisions in Law Number 51 of 2009 concerning the Second Amendment to Law Number 5 of 1986 on State Administrative Court does not include a mechanism for executing TUN decisions, which in practice has caused many problems that undermine legal certainty and justice for the public. The focus of the writing is to provide an understanding to the public about the urgency of implementing execution in administrative court decisions. The main issues include two aspects: the obstacles faced by administrative officials in executing administrative court decisions, and solutions to address the compliance problems of administrative officials in executing administrative court decisions. The research method used is a normative research method. The research findings indicate that the obstacles in the implementation of TUN Decisions are due to the non-compliance of TUN officials and the lack of enforcement power for TUN decisions. The solution to address the compliance issues of TUN officials in executing TUN Decisions is to file a maladministration complaint with the Indonesian Ombudsman to exert pressure and revise the PTUN law to provide enforcement measures against the relevant TUN officials.
