Abstract

The original income of the village is income derived from the business of the village, the result of the village's assets, self-help and community participation, mutual assistance, and other village income. All revenues originating from original village revenues, regional revenue, and regional retribution, ADD, financial assistance from provincial and district / municipal governments, both general and specific, and non-binding third-party donations or contributions other legitimate village revenues must be recorded in an orderly manner. Other Original Revenues The villages are among others derived from village levies. The levies in the village are levies on the use of village halls, levies on prospective villagers, and so on. In Article 25 paragraph (1) of Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 113 of 2014 concerning Village, Finance Management explains that the Village Government is prohibited from levies as acceptance of villages other than those stipulated in village regulations. Abstract

Menurut Pasal 19 ayat (2) huruf c Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Pokok-Pokok Agraria, dengan diberikannya sertifikat bukti hak atas bidang-bidang tanah yaitu dengan diterbitkannya sertifikat tanah tersebut. hak atas tanah, termasuk hak milik atas tanah, negara telah memberikan jaminan dan kepastian di bidang pertanahan. Bagi pemegang hak atas tanah, memiliki sertifikat berarti mempunyai kepastian hukum dan perlindungan hukum. Dibandingkan dengan alat bukti tertulis yang lain, sertifikat merupakan bukti suatu hak yang kuat, artinya pemegang hak atas tanah yang namanya tercantum dalam sertifikat harus dianggap benar sampai dibuktikan sebaliknya di pengadilan dengan alat bukti yang lain. Sebaliknya surat bukti hak atau sertifikat tanah dapat berfungsi untuk menciptakan tertib hukum pertanahan. Meski demikian, keberlakuan dibandingkan sertifikat-sertifikat tersebut sering dipertanyakan efektivitasnya dalam memberikan kepastian dan perlindungan hukum. apakah sertifikat tersebut benar-benar melindungi hak-hak subjek hukum atau melindungi objek yang berada di bawah sertifikat tersebut, atau bahkan hanya sekedar dapat dijadikan sebagai pembuktian sertifikat saja karena sering terjadi bahwa ada sertifikat yang dihadirkan dalam persidangan dapat menjadi tidak sah. diakui secara formal tetapi tidak dapat digunakan untuk melindungi subjek dan objek hukum.Kata Kunci : Sertifikat; Hak Atas Tanah; Hak Milik.According to Article 19 paragraph (2) letter c of Law No. 5 of 1960 concerning Basic Regulations on Agrarian, with the granting of a certificate of proof of the rights over the fields of the land that is with the issuance of the certificate of land rights for land rights, including property rights to land, the state has provided the guarantee and certainty in the land sector. For holders of the rights to land, have a certificate shall have legal certainty and the protection of the law. Compared with written evidence of the other, a certificate is proof of a strong right, meaning that the holder of land rights that the name listed in the certificate should be regarded as true until proven otherwise in a court with the other evidence. On the other hand a letter of proof of the right or the certificate of land that can serve to create orderly land law. Nevertheless, the applicability than the certificate-the certificate is often questioned its effectiveness in providing certainty and legal protection. if the certificate is really protecting the rights of the subjects of the law or protect the object under such a certificate, or even just can be used as proof certificate course because it often happens that there is a certificate that is presented in the trial can be formally recognized but can't be used to protect the subject and object of the law.Keywords: Certificate; Land Rights; Property Right.

Abstract

Pemerintah daerah memiliki peran dalam pemenuhan hak anak melalui ruang terbuka hijau sebagaimana tercantum dalam Undang-undang No. 26 Tahun 2007 tentang Penataan Ruang. Bahwa setidaknya pemerintah bisa memberikan sedikitnya 20% dari luasan wilayahnya untuk pemenuhan ruang terbuka hijau yang bisa digunakan oleh masyarakat dalam beraktivitas secara positif misalnya, di alun-alun kota. Penelitian ni menggunakan metode penelitian legal studies dimana mengungkap masalah yang ada di amasyarakat dengan kemudian memberikan solusi. Pada dasarnya dalam setiap upaya yang telah dilakukan oleh pemerintah telah mengarah pada pemenuhan hak ruang terbuka hijau baik publik mapun privat baik berupa regulasi maupun program-program yang pro terhadap kepentingan anak. Namun masih ada beberapa hal yang menjadi kendala dalam melaksanakan program karena masih belum maksimalnya partisipasi dari seluruh stakeholder terutama untuk kondisi di Kabupaten Jember, sedangkan untuk di Kabupaten Banyuwangi secara keseluruhan bisa dikategorikan sebagai pemerintah kabupaten yang secara partifsipatif dalam hal pemenuhan ruang terbuk ahijau bagi anak, karena hampir rata di setiap program yang dilaksanakan selalu melibatkan peran dari seluruh stakeholder terkait.Kata Kunci: Hak Anak; Ruang Terbuka Hijau; Penataan Ruang.Regional governments have a role in fulfilling children's rights through green open spaces as stated in Law no. 26 of 2007 concerning Spatial Planning. That at least the government can provide at least 20% of its territory to fulfill green open spaces that can be used by the community for positive activities, for example, in city squares. This research uses the legal studies research method which uncovers problems that exist in society and then provides solutions. Basically, every effort that has been made by the government has aimed at fulfilling the rights to green open spaces, both public and private, in the form of regulations and programs that are pro-child's interests. However, there are still several things that are obstacles in implementing the program because participation from all stakeholders is still not optimal, especially for conditions in Jember Regency, while Banyuwangi Regency as a whole can be categorized as a district government that is participatory in terms of providing green open space for children. because almost every program implemented always involves the role of all relevant stakeholders.Keywords: Children's Rights; Green open Space; Spatial Planning.
