Abstract

Hak atas aksesibilitas obat paten merupakan hak konstitusional Warga Negara sebagai hak atas kesehatan yang dijamin dalam Pasal 28H ayat (1) UUD NRI tahun 1945. Namun dalam kaitannya dengan hak atas obat paten yang memberi reward kepada penemunya dalam jangka waktu tertentu untuk memproduksi, mendistribusikan, mengeksploitasi secara ekonomis dan melarang pihak ketiga untuk memproduksinya, telah memberi efek negatif yaitu dibatasinya aksesibilitas publik atas obat paten. Masalah pokok yang akan dikaji adalah bagaimana ratio legis hak atas aksesibilitas obat paten bagi masyarakat dan bagaimana perbandingan hak atas akses obat bagi masyarakat dalam perjanjian Internasional dan Peraturan paten di Indonesia. Metode yang digunakan adalah yuridis normatif. Hasil penelitian menunjukkan bahwa monopoli obat paten mengakibatkan hak atas aksesibilitas obat paten bagi masyarakat semakin tidak terkontrol karena harga obat paten yang sangat mahal, dikarenakan bahwa pada realitanya TRIPs lebih dominan melindungi hak negara maju sebagai pemegang hak atas obat Paten, meskipun ada Deklarasi Doha yang di lahirkan untuk melindungi hak kesehatan masyarakat dikarenakan sulitnya akses obat dan harga obat yang mahal.

Abstract

Eksistensi keberadaan nikah siri yang terjadi hingga hari ini wajib mendapatkan perhatian serius, mengingat terjadi pembiaran yang di lakukan oleh Negara nantinya akan menjadi kebiasaan sehingga menjadi budaya yang tidak mendidik generasi muda. Polemic yang terjadi mengenai kekuatan putusan Perkara nomor 46/PUUVII/2010 hanya mengesahkan status dan kedudukan anak dari suatu pernikahan akan tetapi tidak memberikan tafsiran mengenai larangan atau batasan mengenai keberadaan nikah siri atau memiliki anak diluar perkawinan. Serta Eksistensi keberadaan putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 tentang persoalan hubungan keperdataan anak perlu di tinjau kembali menginggat Negara mengakui dan memberikan perlindungan keberadaan anak yang di buktikan dengan “asal-usul seorang anak pengakuan secara sah secara hukum merupakan langkah yang revolusioner akan tetapi pengakui sah negara terhadap anak perlu di gali kembali menginggat bagaimana mungkin Negara dapat mengakui anak dari suatu pernikahan yang tidak di lakukan secara sah menurut hukum yang berlaku, pengakui agama dari suatu pernikahan siri seyogyannya mengikat secara agama, akan tetapi yang terjadi pernikahan  secara siri (agama) tetapi konsekuensinya ketika mumpunyai anak mengikat secara hukum Seyogyannya pembaruan hukum atau regulasi dilaksankan dengan berabgai pertimbangan dan permasalahan yang terjadi dengan melihat hukum progresif dan penerapan pembentukan moralitas bangsa yang terjadi hingga hari ini, maka eksistensi dari keberadaan Undang Undang No 1 Tahun 1974 tentang perkawinan sudah tidak sesuai dengan kebutuhan.

Abstract

Ekonomi kreatif erat hubungannya dengan hak cipta karena perkembangan ekonomi kreatif berfokus kepada penciptaan barang dan jasa dengan mengandalkan keahlian, bakat dan kreativitas yang dapat mendatangkan manfaat ekonomi kepada penciptanya. Permasalahan yang diajukan pada penelitian ini adalah perlindungan hukum dan penyelesaian sengketa hak cipta fesyen terhadap ekonomi kreatif dalam Masyarakat Ekonomi ASEAN, membuat hak cipta fesyen rentan terkena pembajakan karena MEA memberlakukan pasar tunggal terhadap negara anggota ASEAN. Pembajakan mengakibatkan pencipta mengalami kerugian moril karena merasa hasil karyanya tidak dihargai dan kerugian materiil karena hasil karyanya telah tersebar namun tidak memberikan insentif kepada pencipta. Bentuk perlindungan hak cipta terhadap ekonomi kreatif dalam MEA terlihat dari kebijakan pemerintah memperbaharui UUHC dan pengesahan Peraturan Presiden No. 72 Tahun 2015 tentang Perubahan Atas Peraturan No. 6 Tahun 2015 tentang Badan Ekonomi Kreatif yang kemudian disingkat Perpres Bekraf. Bekraf bertugas untuk menetapkan kebijakan terhadap ekonomi kreatif. Pembaruan UUHC dan mengesahkan Perpres Bekraf diharapkan dapat memenuhi unsur perlindungan dan pengembangan ekonomi kreatif.The creative economy is closely related to copyright because the development of the creative economy focuses on the creation of goods and services by relying on the skills, talents and creativity that can bring economic benefits to its creators. The creative economy in the AEC era made the fashion copyright vulnerable to piracy because the MEA imposed a single market on ASEAN member countries. Hijacking resulted in the creator experiencing moral loss because he felt his work was not appreciated and material losses because his work has been scattered but did not provide incentives to the creator. The form of copyright protection to the creative economy in the MEA is an evident from the government’s policy of updating the UUHC and the approval of the Presidential Regulation on Bekraf. Bekraf is tasked with establishing policies toward the creative economy. The UUHC renewal and the endorsement of the Presidential Regulation on Bekraf are expected to meet the elements of protection and development of the creative economy.

Abstract

Article 28H and Article 34 of the 1945 Constitution of the Republic of Indonesia stipulate that fulfilling the health rights of Indonesian citizens is the responsibility of the state. Human rights require that individuals have access to the availability of medicines in society. The high price of medicines, especially patent medicines, results in limited access and availability of essential medicines. This study uses normative legal research methods, with a statutory approach, and a conceptual approach. The purpose of this study is to examine and analyze the state's goals in fulfilling the right to health as a human right by the state as well as access and availability of patented drugs to fulfill the right to health. In addition to ensuring the availability of complete medicines in sufficient quantity, quality, affordable and easily accessible to the public, the government is also responsible for protecting the rights of inventors as long as the drugs are still under patent protection. To balance these two rights, the government plays the role of provider, regulator, entrepreneur and umpire.

Abstract

TRIPs waiver is a bilateral or multilateral agreement proposed by member countries as an exception to the TRIPs agreement during the Covid-19 pandemic. The TRIPs waiver aims to urge WTO member countries to exclude and waive the obligation to protect Intellectual Property Rights and patent flexibility in the form of mandatory licenses, implementation of patents by the government, parallel imports, and bolar provision for the prevention, handling and treatment of Covid-19 during the pandemic. Most of the technology and pharmaceutical products used in handling Covid-19 are objects protected by IPR. This means that anyone is prohibited from producing, selling, importing and exporting these objects without the permission of the IPR holder. So this will hinder the access and availability of pharmaceutical products. This normative juridical study aims to examine the importance of the application of TRIPs waiver in access and availability of pharmaceutical products and examine the policies of WTO member countries towards the proposed implementation of TRIPs waiver. According to the findings of this article, TRIPs waivers are needed in the Covid-19 pandemic, but many regulations must be regulated for their implementation. It is better to use the patent flexibility that has been regulated in each member country. The implementation of patent flexibility can be adjusted according to the abilities of each member country in terms of access and availability of pharmaceutical products during Covid-19. Abstract

General Background: The availability of essential medicines is a critical determinant of healthcare quality, directly impacting public health needs. Specific Background: In Indonesia, the government is tasked with ensuring these medicines are accessible in adequate quantities, timely, and at affordable prices. Despite existing policies, challenges persist in achieving these objectives, particularly highlighted during the COVID-19 pandemic. Knowledge Gap: There is limited empirical analysis regarding the state’s role and effectiveness in providing essential medicines amidst regulatory frameworks and public health needs. Aims: This study aims to examine the state's responsibilities in ensuring the availability of essential medicines through literature reviews and policy analysis, focusing on relevant legal frameworks, including Law Number 17 of 2023 on health and constitutional provisions. Results: The findings indicate that the state plays a pivotal role in providing essential medicines via mechanisms such as subsidies, price monitoring, and incentives for the local pharmaceutical industry. Challenges in distribution, production capacity, and international collaboration were also identified. Novelty: This research offers a comprehensive overview of the essential medicines landscape in Indonesia, detailing the intersection of legal frameworks and public health requirements. Abstract

General Background: The continuous digitalization of social interaction has accelerated the creation and sharing of personal data, demanding effective mechanisms to manage and protect user privacy. Specific Background: Social media platforms have introduced segmented sharing options, such as the 'Close Friend' feature, as a technical control to mitigate the risks associated with generalized data exposure. Knowledge Gap: Limited legal research has specifically analyzed the extent to which these technical features and their underlying privacy policies align with comprehensive national data protection frameworks, particularly the Indonesian Personal Data Protection Law (UU PDP No. 27/2022). Aims: This study legally analyzes the privacy policies of the 'Close Friend' feature across major social media platforms and assesses its conformity with Indonesian legal principles concerning personal data protection. Results: The feature structurally implements the Privacy by Design principle, offering users granular control over their content access. This technical protection is generally found to be in line with the principles stipulated in the Indonesian UU PDP. Novelty: This study provides a necessary comparative legal examination of a specific technical privacy feature against a new, comprehensive national data protection law, confirming the feature's legal viability. Implications: Despite technical compliance, the persistent risk of content misuse highlights the necessity for platforms, users, and regulators to collaborate in enhancing digital literacy to ensure optimal and shared responsibility for data security. Highlights Close Friend feature technically complies with the Privacy by Design legal principle. The feature's data protection mechanism is in alignment with Indonesia's Personal Data Protection Law (UU PDP). Data misuse risk remains high due to low user digital literacy and awareness. Abstract

General Background: The movement of foreign workers across national borders has become increasingly common, requiring countries to regulate their entry and employment. Specific Background: In Indonesia, the implementation of work and visit visas for foreign workers is regulated under Law No. 6 of 2011 on Immigration and Government Regulation No. 34 of 2021. However, the application of these rules reveals inconsistencies in distinguishing between categories of foreign workers. Knowledge Gap: There is still no clear standard or boundary differentiating foreign workers from candidates undergoing work capability trials under the general visit visa scheme. Aims: This research aims to analyze the legal framework, administrative procedures, and regulatory gaps in the use of general visit visas for foreign workers. Results: Findings indicate the absence of explicit standards and overlapping regulations between work visa and visit visa categories, leading to legal uncertainty. Novelty: This study provides a normative legal perspective emphasizing the necessity for regulatory clarity and structured oversight mechanisms. Implications: The study suggests policy reform to establish transparent standards, ensuring lawful and efficient governance of foreign labor practices in Indonesia.
