Abstract

This research is about the function of immigration as a facilitator of community welfare development. In the explanation of Law Number 6 of 2011 concerning Immigration (Immigration Law), it is stated that foreigners who are allowed to enter and reside in Indonesia are people who bring benefits to the nation, state, and Indonesian society. The Medan Immigration Detention Center is one of the technical implementation units of the Directorate General of Immigration which carries out immigration functions. This research was conducted for whether the Medan Immigration Detention Center as mandated in the Immigration Law as a temporary shelter for foreigners subject to immigration administrative measures can carry out its immigration function as a facilitator for community welfare development by playing a role in increasing the capacity of the people of Medan city. This research was designed using qualitative research methods with a case study approach. The results of the research prove that the Medan Immigration Detention Center with the My Hobby Is innovative and collaborating with stakeholders can transfer knowledge from the detention center to the Medan city community, in this case, the inmates of the Medan State Women's Detention Center. It was proven that the training carried out together had a role from the Medan Immigration Detention Center

Abstract

This study aims to analyze and compare the legal regulations governing consignment services between Indonesia and Thailand, particularly regarding licensing, consumer protection, and taxation. This research employs a normative juridical approach with a descriptive analytical method, utilizing primary data from the legal regulations of both countries, such as Law No. 8 of 1999 on Consumer Protection in Indonesia and the Consumer Protection Act B.E. 2522 (1979) in Thailand, as well as secondary data from legal literature. The findings reveal that consignment service regulations in Indonesia are still minimal and fragmented, leading to legal uncertainty for business actors and consumers. In contrast, Thailand has more structured regulations that support consignment services in terms of business licensing and consumer protection. This study highlights the need for regulatory improvements in Indonesia to create a more conducive and harmonious business climate.

Abstract

Penelitian ini bertujuan untuk menganalisis perbandingan hukum e-commerce antara Indonesia, yang menggunakan sistem civil law, dan Amerika Serikat, yang menggunakan sistem common law. Perbedaan pendekatan hukum ini mempengaruhi perlindungan konsumen di kedua negara, khususnya dalam menghadapi tantangan transaksi digital. Di Indonesia, kerangka hukum e-commerce didasarkan pada Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), Undang-Undang Perlindungan Konsumen, serta Kitab Undang-Undang Hukum Perdata (KUHPer). Peraturan ini mencakup hak dan kewajiban konsumen serta pelaku usaha dalam transaksi digital, tetapi implementasinya masih menghadapi kendala, seperti kesadaran hukum konsumen yang rendah dan lemahnya pengawasan hukum. Sebaliknya, Amerika Serikat mengatur perlindungan konsumen dalam e-commerce melalui Federal Trade Commission Act (FTC Act) dan Consumer Product Safety Act (CPSA). FTC diberikan otoritas untuk menindak pelanggaran hukum oleh pelaku usaha, termasuk penipuan dan kelalaian yang merugikan konsumen. CPSA juga memperkuat perlindungan konsumen dengan mengatur standar keamanan produk serta memberikan kewenangan kepada Consumer Product Safety Commission (CPSC) untuk melarang peredaran produk yang berisiko. Perbandingan ini menunjukkan bahwa regulasi di Amerika Serikat lebih terpadu dan tegas dalam menindak pelanggaran dan menjaga keamanan konsumen. Di sisi lain, Indonesia perlu meningkatkan efektivitas perlindungan hukum e-commerce, terutama dalam pengawasan dan kesadaran konsumen, serta memperbaiki mekanisme pengaduan. Penelitian ini merekomendasikan peningkatan kerangka hukum e-commerce di Indonesia agar lebih komprehensif dan mampu menyesuaikan diri dengan kemajuan teknologi.

Abstract

Cross-border e-commerce (CBEC) semakin berkembang melalui teknologi untuk melakukan transaksi jual beli secara internasional. Perkembangan CBEC muncul untuk memberikan solusi terbaik, seperti kemudahan perdagangan, untuk menjangkau konsumen di berbagai negara. Penelitian ini bertujuan untuk mengetahui CBEC, ketentuan yang mengatur CBEC dalam melindungi pelaku usaha dan konsumen, penerapan CBEC, dan pengaruh CBEC di Indonesia terhadap usaha mikro (UMKM) untuk memperluas dan mengembangkan sektor perekonomian secara global melalui teknologi.

Abstract

Pemanasan global dan emisi gas rumah kaca merupakan isu global yang terus menjadi perhatian, terutama karena berdampak terhadap lingkungan dan aktivitas makhluk hidup. Aktivitas manusia seperti pembakaran hukun dan aktivitas industri menjadi penyebab utama dalam hal ini. Teknologi Carbon Capture and Storage (CCS) muncul sebagai solusi yang signifikan untuk mengurangi emisi karbon. Dalam upaya memahami dan mengevaluasi kebijakan CCS, penting untuk melakukan studi literatur yang komprehensif. Studi ini melibatkan pengumpulan berbagai sumber hukum, laporan pemerintah dan penelitian akademis yang relavan seperti jurnal dan buku. Sumber-sumber hukum memberikan kerangka yang mengatur penerapan regulasi dan teknologi CCS. Setelah mengumpulkan dan menganalisis literatur yang ada, langkah selanjutnya adalah melakukan analisis perbandingan. Dalam tahap ini, metode analisis kualitatif digunakan untuk membandingkan regulasi dan penerapan CCS di dua negara baik Indonesia dan Singapura. Dalam penerapan dan regulasi CCS terdapat perbedaan signifikan antara Indonesia danĀ  Singapura sebagai konteks penulisan ini. Singapura menunjukkan kemajuan yang lebih cepat dalam penerapan CCS berkat regulasi yang lebih jelas dan dukungan finansial yang kuat. Indonesia perlu memperkuat kerangka hukum dan meningkatkan investasi untuk memaksimalkan potensi CCS.

Abstract

Sea transportation is an important component in international trade, which plays an important role in the distribution of goods. However, there are losses greater than the losses caused by the transportation itself, such as shortages, damages, and loss of goods, which can arise during the process of unloading at the port carried out by the freight forwarding company by sea. This study aims to examine the limitation of responsibility in the legal relationship between freight forwarding companies, carriers, and sea transportation expedition companies in the context of sea transportation activities. Using a normative legal research methodology, this research relies on sources of legal materials, including laws and regulations and court decisions/rulings, using a legislative approach and a case approach. The results of this study show that, first, the limitations on the responsibility of the expedition party are regulated in Article 87 of the Commercial Code, as well as the limitations on the responsibility of the carrier regulated in Article 40 and Article 41 of Law Number 17 of 2008, and the responsibility of the sea freight expedition company in terms of providing facilities, licensing, supervision, and the implementation of order of sea transportation activities, as stipulated in Cassation Decision Number 2665 K/Pdt/2022 which corroborates the decision of the first judge in case Number 728/Pdt.G.2016/PN.Mdn, has been appropriate and fulfills the legal objectives that provide certainty, justice, and usefulness.

Abstract

Resolving disputes related to foreign investment is not as straightforward as one might think, as it involves investment disputes that engage two or more legal systems. Therefore, the resolution is not solely determined by the law applicable within the territory of Indonesia, but also takes into account the laws of other countries participating in the convention. When a settlement between the parties cannot be reached, the dispute can be resolved through an arbitration body designated by the parties to facilitate the resolution or through conventional judicial bodies in accordance with their authority as regulated by legislation. Alternative dispute resolution through arbitration will be more efficient and effective as it is achieved through deliberation and consensus or a win-win solution. This research is descriptive in nature, aiming to provide an overview or description of the law on divestment in foreign companies in Indonesia. As a descriptive study, a normative approach is used, focusing on the examination of legal principles, legal systems, vertical and horizontal synchronization of legislation, and legal history. The Bilateral Investment Treaty (BIT) serves as a legal basis that needs to be revised. The initial role of this agreement was to attract investors to enter Indonesia, with the hope of reaching a balanced agreement between the two countries. However, in practice, the BIT has become the foundation relied upon by foreign investors in Indonesia. The recommendation made in this study is that the Government of the Republic of Indonesia, in establishing Bilateral Investment Treaties, must include clear provisions so that the description of the agreement does not overlap with the positive law already established in Indonesia.

Abstract

Companies play a crucial role in the economy, both in terms of business, social, and environmental aspects. In facing global competition, merger strategies are one way companies use to improve efficiency, competitiveness, and market share. However, mergers also bring significant legal impacts, particularly regarding changes in organizational structure, human resource management, and compliance with applicable regulations. This study aims to analyze the positive legal impacts of the merger carried out by PT Pelindo Regional 1, including its effects on the legal status and ownership of the company, asset transfer, employee rights, and the potential reduction in competition levels. This research uses a normative juridical method with a library research approach, examining relevant regulations such as Law No. 40 of 2007 on Limited Liability Companies and Government Regulation No. 101 of 2021 on Company Mergers. The study finds that while mergers have the potential to enhance company efficiency and competitiveness, this process must be carefully managed to avoid legal issues, especially concerning employee rights and competition supervision. Therefore, companies need to ensure compliance with existing regulations and conduct due diligence to mitigate potential legal risks.

Abstract

Flight cancellations often cause losses to consumers, both materially and immaterially, and cause uncertainty about the rights and amount of compensation in accordance with the regulations. This study aims to analyze the liability of Indonesian airlines in flight cancellations based on consumer protection regulations and the suitability of the airline's internal policies with applicable regulations. The method used is normative juridical research with a literature study approach. Primary legal materials include Consumer Protection Law No. 8 of 1999, Law No. 1 of 2009 concerning Aviation, as well as Ministerial Regulations PM 77/2011, PM 89/2015, and PM 30/2021. Secondary legal materials include internal airline policies, books, journals, and relevant legal literature. The analysis technique used is qualitative analysis with a descriptive approach. The results show that the internal policies of Indonesian airlines are generally in line with the laws and regulations related to flight cancellation. However, there are still some aspects that require optimization in the implementation of compensation and transparency of information to consumers. This regulatory alignment is expected to improve consumer protection, legal certainty, and the quality of airline services in handling flight cancellations.

Abstract

The purpose of this research includes the regulation of citizen residence permits in Indonesia based on the Law on Immigration and how sanctions for citizens who violate residency permits in Indonesia or commonly referred to as Overstay The research used by researchers is a type of normative juridical research (legal research), namely using the source of legal materials in the form of legislation, decisions / court provisions, legal theory, approaches from books related to legal issues that are examined. Violations committed in the form of exceeding the deadline for residence permits (overstay), are subject to deportation as a special measure of immigration, legal sanctions against citizens who do not have a residence permit through administrative measures and criminal sanctions, subject to 5 years in prison, a fine of 500 million for those who fake visas / residence permits with the intention of being used in / out of Indonesia. 6 Year 2011 on Immigration, In its implementation, immigration control is a shared responsibility between immigration officials and the public, with the investigation of immigration crimes carried out by Immigration Servant Investigators (PPNS) in coordination with the Indonesian National Police.
