Abstract

There are so many problems overwhelming the bureaucracy, especially related to public services which is the main reason for government to reform the bureaucracy. In the process, bureaucratic reform can be said being left further than the reform on legal problems, political problems, and economic problems. Besides, the problems surrounding the bureaucratic reform are more complex and need to be handled immediately. One of the efforts from the government to support the reformation is by focusing to the improvement of the public service regulation including the regulation in favour of public servant's welfare. In order to support the good governance, the improvement of bureaucracy needs to be connected to the ethics of public servant. In doing so, we can hope that the culture and behaviour of public servant can be changed ploddingly in order to realize the success of the bureaucratic reform

Abstract

According to Article 1 paragraph (3) of constitution 1945 stated that "Indonesia is a state of law". However, there was no explanation of the meaning a state of law by the constitution 1945. While, conception the state of law always refers to two different streams, namely state of law in meaning rechtsstaat and state of law within the meaning of the rule of law. To answer meaning of state of law by the constitution 1945, it is necessary to understand subtance "Preamble", in particular the fourth paragraph of about the goal of the state of Republic Indonesia.Keywords: state of law, Pancasila, Constitution 1945.

Abstract

One of the fundamental changes on judicial power in the third amendment of UUD 1945 is the distributionof judicial review power to Supreme Court and Constitutional Court. The Supreme Court has the highestjurisdiction to execute the cassation cases and authority to review inferior regulations under law. TheConstitutional Court has the power to review laws against UUD 1945. Unfortunately, the judicial reviewmodel has several potential problems which can ruin the implementation of legal principles. That is whysome changes have to be taken. Salah satu poin mendasar dari penataan kekuasaan kehakiman pada perubahan ketiga UUD NRI Tahun1945 adalah dilakukannya pengaturan kewenangan judicial review atau hak menguji yang dijalankan oleh lembaga pelaksana kekuasaan kehakiman, yaitu Mahkamah Agung dan Mahkamah Konstitusi. Mahkamah Agung berwenang mengadili pada tingkat kasasi, menguji peraturan perundang-undangan di bawah Undang-Undang terhadap Undang-Undang, sedangkan Mahkamah Konstitusi berwenang menguji Undang-Undang terhadap Undang-Undang Dasar. Namun ternyata model kewenangan judicial review semacam ini rentan melahirkan persoalan hukum yang dapat merusak pilar-pilar hukum, sehingga perlu dilakukan penataan ulang.

Abstract

Local direct election is an attempt to realise an integral system of democracy and to encourage concept of popular sovereignty. The numerous obstacles on the way are challenges that eventually will help shaping the prevailing system to a more democratic one.Pemilihan umum kepala daerah secara langsung adalah merupakan sarana sekaligus upaya mewujudkan sistem demokrasi secara utuh serta sebagai langkah merealisasikan kedaulatan rakyat. Kendati dalam perjalanannya muncul sejumlah persoalan yang mengiringinya, namun hal itu haruslah dipandang sebagai tantangan sekaligus bagian dari proses pematangan dalam rangka mewujudkan pemerintahan daerah yang lebih demokratis.

Abstract

The obscurity of noodverordenings in issuing government regulation in-lieu-of-law attracts hot debate. Since the requirement of ‘compelling crisis situation’ is very subjective, it tends to be politically abused. Therefore, the will of Article 22 of 1945 Constitution that gives room for this regulation in-lieu-of-law should be re-thought and reviewed.  Ketidakjelasan noodverordenings dalam mengeluarkan perppu mengundang perdebatan di masyarakat. Karena Presiden dapat menentukan kondisi ‘kegentingan yang memaksa’, kondisi ini menjadi sangat subjektif dan berpotensi disalahgunakan secara politis. Dengan demikian, penting bagi kita untuk menelaah dan memikirkan kembali maksud Pasal 22 UUDNRI Tahun 1945 yang memberikan payung hukum untuk perppu ini.

Abstract

Keberadaan masyarakat hukum adat di Indonesia sudah lama tumbuh dan berkembang, baik sebelum Indonesia merdeka dan bahkan sampai dengan saat ini. Masyarakat hukum adat itu sendiri turut berkembang di kawasan tapanuli, khususnya di Kabupaten Toba. Sebagai upaya mengakui keberadaannya melalui regulasi, maka Pemerintah Kabupaten Toba telah membentuk Peraturan Daerah Nomor 1 Tahun 2020 tentang Hak Ulayat Masyarakat Hukum Adat Batak Kabupaten Toba. Peraturan daerah ini dimaksudkan sebagai upaya memberikan payung hukum atas keberadaan masyarakat hukum adat Batak di Kabupaten Toba. Penelitian ini merupakan gabungan dari penelitian yuridis empiris dimana bahan hukum yang ada diperkuat dengan data lapangan untuk mendapatkan kondisi yang sebenarnya mengenai objek yang diteliti. Berdasarkan hasil penelitian ditemukan bahwa implementasi Peraturan Daerah Nomor 1 Tahun 2020 tentang Hak Ulayat Masyarakat Hukum Adat Batak di Kabupaten Toba belum sepnuhnya berjalan dengan baik. Hal tersebut tidak terlepas dari aturan turunan peraturan daerah dimaksud yang belum mampu mengakomodir kebutuhan dan tuntutan masyarakat hukum adat Batak di Kabupaten Toba. Oleh sebab itu, sangat diharapkan agar segera ditetapkan dan diterapkan aturan turunan melalui Keputusan Kepala Daerah mengenai mekanisme konkret pengakuan hak ulayat masyarakat hukum adat Batak Toba di Kabupaten Toba. Hal ini sangat dibutuhkan masyarakat demi memberi kepastian hukum akan hak-hak tradisional masyarakat adat serta dalam upaya menjaga dan melestarikan keberadaan masyarakat adat itu sendiri.

Abstract

Determined of Supreme Court Regulation Number 1 of 2011 about the Right to Test Material, where one of the substances remove strained period the submission deadline Applications for approval were previously limited to 180 days after regulation laws and regulations determined as previously regulated in the Regulations Supreme Court Number 1 of 2004 should be welcomed as a positive step in in order to make the authority to review statutory regulations effective by Supreme Court. In the future, in order to further optimize authority Therefore, the Supreme Court Regulations Concerning the Right to Judicial Review need to be revised through the establishment of Supreme Court Regulations regarding regulatory review regulations that include the right to material review and the right to formal review, because However, the Supreme Court does not only have the authority to carry out material tests also formal testing where the two understanding authorities are better known as the term judicial review authority.

Abstract

Peran kejaksaan sangat penting sekali dalam sistem hukum pidana terutama terhadap penanganan barang bukti dan barang sitaan. Barang Bukti adalah segala sesuatu yang dimanfaatkan untuk membuktikan sebuah kejahatan yang ditangani dalam prosedur Hukum, sedangkan barang sitaan adalah barang yang sudah disita oleh negara setelah memperoleh kekuatan hukum tetap. Dalam praktiknya, penanganan barang bukti dan barang sitaan sering menghadapi berbagai tantangan dan resiko. Penelitian ini menerapkan metode yuridis normatif dengan pendekatan yang berfokus pada peraturan perundang-undangan serta pengelolaan barang bukti dan aset rampasan oleh Kejaksaan Negeri. Data yang mana dikumpul yaitu data sekunder Peraturan perundang-undangan yang mencakup Kitab Undang-Undang Hukum Acara Pidana (KUHAP), Undang-Undang Kejaksaan, serta Peraturan Jaksa Agung Republik Indonesia Nomor PER-006/A/JA/07/2017 mengenai penanganan barang bukti dan barang sitaan.serta dari buku dan literatur hukum. Kejaksaan RI bertanggung jawab menangani barang bukti yang menurut hakim perlu disita oleh pemerintah. Aturan Pokok Jaksa Ayat 8 Pasal 40, Pasal 1 Kemampuan mengelola barang bukti dalam rangka kebutuhan payung hukum pendukung diberikan dengan Peraturan Menteri Keuangan Nomor 96/PMK.06/2007 mengenai prosedur pelaksanaan penggunaan, pemanfaatan, penghapusan, dan pemindahtanganan barang milik negara.Kejaksaan Republik Indonesia memiliki tugas yang sangat utama terhadap sistem peradilan pidana, yaitu dalam penanganan barang fisik dan rampasan. Proses ini sangat penting karena beberapa alasan, seperti risiko kehilangan, kerusakan, Penanganan benda fisik dan benda sitaan merupakan fungsi utama Kejari yang mampu mengeksekusi penyitaan atas alat bukti yang terkait dengan Kejahatan, menghadirkan barang bukti serta mengelola barang fisik berupa rampasan.
