Abstract

The development of increasingly diverse and time-spanning work arrangements: remote work systems need to be known and understood with certainty and legal protections for remote employees. Remote Working workers are prone to non-compliance with the following rights in the company's work cycle. The United States, one of the developed countries, has regulations to protect remote workers, and interpreting these regulations according to the situation in Indonesia can be helpful if they are implemented appropriately. This study aims to obtain reference materials regarding regulations that can be applied in Indonesia to ensure legal protection for remote workers. This research is comparative legal research using literature studies. In Indonesia, Remote Working worker regulations do not exist specifically, so they are still based on the Job Creation and Manpower Law. Meanwhile, in the United States, regulations for Remote Working workers have existed since 1990 until now. Despite the differences in legal systems between Indonesia and the United States, efforts are being made to coordinate appropriate regulations to develop government regulations in line with the increasing diversity of employment systems. Therefore, the government must clarify and follow up on determining legal protection for remote workers.

Abstract

Suatu perusahan sering kali menghadapi situasi di mana debitor tidak mampu melunasi utang-utangnya yang sudah jatuh tempo minimal satu utang dan dapat ditagih. Kondisi seperti ini disebut dengan pailit. Dalam Undang-Undang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, terdapat asas yang memberikan kesempatan kepada debitor pailit untuk memperbaiki kondisi perusahaannya, yang dikenal dengan asas keberlangsungan usaha. Asas ini diterapkan pada perusahaan debitor yang masih memiliki potensi dan prospek baik, sehingga hakim mempertimbangkan hal ini sebelum memutuskan kepailitan. Penelitian ini menganalisis tanggung jawab kurator dalam mengelola harta debitor pailit dengan menerapkan asas keberlangsungan usaha. Dalam penulisan ini peneliti menggunakan metode kepustakaan (library research) dengan menggunakan bahan hukum yang relevan, seperti peraturan perundang-undangan, jurnal, karya ilmiah, yang dilakukan dengan menggunakan metode pendekatan perundang-undangan dan konseptual. Asas keberlangsungan usaha memberikan kesempatan kepada debitor yang beritikad baik untuk terus melanjutkan operasional perusahaan. Dalam proses penyelesaian perkara Kepailitan dan PKPU, penerapan prinsip ini membantu debitor merestrukturisasi utangnya, sehingga menghasilkan kesepakatan penyelesaian dan mengatasi masalah keuangan. Keberlanjutan usaha dalam kasus kebangkrutan memiliki dampak positif terhadap nilai ekonomi perusahaan debitor, karena aset yang dimiliki akan lebih bernilai dibandingkan aset perusahaan yang sudah berhenti beroperasi. Peningkatan nilai ekonomi ini menguntungkan baik debitor maupun kreditor. Oleh karena itu, perusahaan debitor yang menjalankan kegiatan usaha dalam skema PKPU seharusnya tidak hanya diberi kesempatan untuk merestrukturisasi utang, tetapi juga untuk merestrukturisasi perusahaan melalui pemberian pembiayaan ulang. Dalam kasus kepailitan, terutama setelah perusahaan debitor dinyatakan pailit, perusahaan yang memiliki itikad baik dan prospek positif seharusnya diberikan kesempatan untuk bangkit kembali.

Abstract

This study aims to analyze the legal actions that can be taken by creditors who are excluded from the final creditor's list and assess the legal consequences of a bankruptcy ruling if the Renvoi Procedure is granted. The research was conducted using a normative juridical approach through a literature study of primary and secondary legal materials, including Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations, court decisions, and expert opinions. A qualitative analysis technique was employed to interpret the norms, legal principles, and settlement practices in bankruptcy proceedings. The research findings indicate that a delay in submitting a claim by a creditor results in the rejection of that claim by the curator, causing the creditor's rights to be disregarded in the distribution of the debtor's assets. The Renvoi Procedure, as a legal mechanism available, provides the creditor with an opportunity to file an objection so that the rejected claim can be reinstated, without altering the status of the bankruptcy ruling that is binding on all creditors. Therefore, this study concludes that the Renvoi Procedure is an effective tool to address injustice in bankruptcy processes while ensuring the protection of creditor rights.
